Often, an unauthorized copy of a commercial video game can violate copyright law—but “reproduction game” can mean several different things. Downloading a ROM, making a backup, selling a reproduction cartridge, using an emulator, and creating a new game with similar mechanics are not the same legal question. The answer depends on your country, what was copied, whether you had permission, and what you did with the copy.
What does “reproduction game” mean?
The phrase is ambiguous. It may describe a ROM file, an unofficial physical cartridge containing copied game software, a personal backup, a preservation copy, or a new game inspired by an older one. Copyright concerns depend on the material copied and the act involved—not simply on the label “reproduction.”

Game code and audiovisual content, such as artwork and music, may contain protected expression. Copying those materials without permission can implicate copyright. Making a copy, downloading one, uploading it, and selling it are distinct acts; the applicable law and any exceptions vary by jurisdiction.
How does the law treat game copies in the United States?
Under 17 U.S.C. §106, copyright owners have exclusive rights to reproduce a protected work, prepare derivative works, and distribute copies, subject to statutory limitations. The U.S. Copyright Office’s overview of copyright summarizes these rights. This framework does not mean every use is infringement: limitations and the specific facts matter.

Exceptions are narrow, not a general ROM permission
The Copyright Office’s 37 CFR 201.40 exemptions describe limited circumstances involving lawfully acquired complete games. Examples include restoring access for personal local gameplay after an authentication server is discontinued and certain preservation activities by eligible libraries, archives, or museums. These defined situations do not establish a general consumer right to download a ROM or copy any game merely because the person owns a cartridge.
What is the UK position?
GOV.UK copyright guidance says copyright protects software and restricts unauthorized copying, distribution, adaptation, and putting works online. Section 17 of the Copyright, Designs and Patents Act 1988 defines copying to include reproduction in material form and electronic storage, as well as certain transient or incidental copies. These sources establish a general framework, not a decision about a particular person’s circumstances or every possible exception.

How do common reproduction-game scenarios differ?

What does Nintendo say about ROMs and circumvention products?
Nintendo UK says games offered through peer-to-peer networks or third-party file-hosting services are unauthorized copies, and states: “The uploading and downloading of pirate copies of Nintendo games is illegal.” Attribute this statement to Nintendo UK; it is the company’s guidance, not a complete account of law in every jurisdiction.
Nintendo UK also describes piracy cartridges, game copiers, USB piracy sticks, mod chips, and software that bypass security measures as circumvention products. It says importing, marketing, selling, or distributing such products is illegal and that using them with unauthorized game copies is unlawful. These statements concern Nintendo’s position and should not be treated as a case-specific legal determination.

What should you check before deciding whether a copy is lawful?
- Identify the jurisdiction. Copyright rules and exceptions differ by country.
- Identify what was copied. Separate game code, artwork, music, and other content from general ideas or mechanics.
- Check authorization. Determine whether the rights holder permitted the copy or the relevant use.
- Specify the act. Making, downloading, uploading, selling, and playing a copy may raise different issues.
- Check any claimed exception. Confirm that its conditions actually cover the game, person, purpose, and conduct at issue.
