Yes. Modifying a Nintendo Switch can put its access to online features at risk, but Nintendo’s official policies do not say every modified console is automatically banned. The consequence can depend on the scope of the restriction: a particular game or service, or the console’s ability to connect online.
What Nintendo’s rules say about Switch modifications
Nintendo’s agreement for the original Switch, Switch Lite, and Switch OLED restricts bypassing, modifying, defeating, tampering with, or circumventing console protections unless otherwise permitted by law. It also says that content obtained using an unauthorized device or modification may be removed, and that updates or changes may render an unauthorized modification, device, console, or software permanently unusable. Nintendo Switch User Agreement
Nintendo’s piracy FAQ identifies mod chips, including HWFLY and PICOFLY, as circumvention devices. It warns that unauthorized products may damage a console, that damage caused by them is not covered by Nintendo’s warranty, that online play may be unavailable, and that a console may stop working after network updates. Nintendo’s piracy FAQ
That FAQ also discusses piracy and particular devices. Its legal statements about importing, selling, distributing, or using devices with unauthorized game copies should not be read as a blanket claim that every form of console modification is illegal everywhere.

What “banned” can mean
Nintendo documents different kinds of online restriction. One may affect an account or console’s access to a specific game or service; another can prevent the console from connecting online. They are not interchangeable, and the error code helps identify which type Nintendo is reporting.
| Nintendo error code | Scope described by Nintendo | Meaning |
|---|---|---|
| 2124-5114 | Account or console; specific game or service | Nintendo says the account or console has been banned from online features for a specific game or service due to a breach of user agreements. Nintendo Support: Error Code 2124-5114 |
| 2124-4517 | Console | Nintendo says the console has been banned from connecting online due to a breach of user agreements. Nintendo Support: Error Code 2124-4517 |
For 2124-5114, Nintendo’s exact description is: “This error code indicates the Nintendo Account or console you are using has been banned from using online features for a specific game or service due to a breach of the user agreements.” Nintendo Support

What is known—and not known—about enforcement
Nintendo warns of possible online-play loss and documents both service-specific restrictions and console-level bans. Its published materials do not quantify how often modified consoles are banned, provide a ban probability, or say that every modified Switch is automatically banned. They also do not establish a predictable sequence of enforcement steps. Avoid treating any particular outcome as guaranteed.
- Online access: Nintendo warns that online play may be unavailable, and its support pages describe both service-specific and console-level restrictions.
- Content: The original Switch agreement says content obtained using an unauthorized device or modification may be removed.
- Console or software function: Nintendo warns that updates or changes may render unauthorized modifications, devices, consoles, or software unusable; its piracy FAQ also warns that a console may stop working after network updates.
- Warranty: Nintendo says damage caused by unauthorized products is not covered by its warranty.
Switch 2 has separate terms
Nintendo has a separate user agreement for Switch 2. That agreement explicitly says Nintendo may implement technical measures designed to disable access to software or the console if it determines or reasonably suspects a violation, and warns that unauthorized modifications may render the system unusable. Those are Switch 2 terms; they should not be attributed to the original Switch agreement. Nintendo Switch 2 User Agreement
