What New York alleges Valve’s loot boxes do
The plaintiff is the People of the State of New York, acting through Attorney General Letitia James; the defendant is Valve Corporation. The case was filed in the Supreme Court of the State of New York, New York County, as Index No. 450952/2026. In the State’s account, loot boxes are virtual containers that yield randomly selected items. Players may pay for a key or an opening, and some resulting items can be sold or traded and may have significant monetary value. New York’s theory is that paying for a chance to win such items constitutes gambling. Those are allegations in the complaint, not facts established by a judgment.
The complaint captures that theory in its own words: “This loot box model that Valve has developed—charging an individual for a chance to win something of value based on luck alone—is quintessential gambling, prohibited under New York’s Constitution and Penal Law.” The quote is the State’s position, not a court’s conclusion. What law the lawsuit invokes
The State cites Article I, Section 9 of the New York Constitution and Penal Law §§ 225.05 and 225.10. It uses Executive Law § 63(12) as the enforcement vehicle. Valve’s response and the competing arguments
Valve’s March 2026 public response, as summarized by PC Gamer, rejects New York’s claim that the containers are gambling under state law. What the reported market figures do—and do not—show
New York’s February 25, 2026 press release repeats a report from March 2025 that the Counter-Strike skin market had surpassed $4.3 billion. That is a reported market estimate cited by the Attorney General, not a finding by the court. The release also says research has found that children introduced to gambling are four times more likely to develop a gambling problem later in life. The passage does not identify the underlying study, so the figure should be understood as a claim made in the Attorney General’s release, not as an independently verified conclusion in this article. Has the court decided whether the loot boxes are gambling?
The available sources do not establish a final court ruling. A case tracker describes the action as active and as a government enforcement case rather than a private class action, but that secondary status summary does not confirm the latest docket activity.
