PEGI fined Activision Blizzard €5,000 each in 2023 after the companies failed to disclose paid random items in Diablo Immortal when applying for a rating license. That was a rating-code enforcement decision—not a fine for the price of the game’s microtransactions. Separate Italian and EU consumer-protection proceedings were still ongoing as of 8 October 2026; they are not a new PEGI fine.
Why did PEGI fine Diablo Immortal?
PEGI’s 2023 enforcement entry says Diablo Immortal was published in 2022 and contained paid random items, such as loot boxes or card packs, that were not disclosed when the game was submitted for a rating license. PEGI said this breached its Code of Conduct. Its Enforcement Committee fined both companies named in the entry €5,000 each.
The stated violation was nondisclosure in the rating submission. PEGI did not describe the fine as a penalty for charging too much, for all microtransactions, or for an established consumer-law violation. How much was the Diablo Immortal PEGI fine?
The recorded amount was €5,000 per company, according to PEGI’s 2023 decision. It should not be reported as a single €5,000 fine against the game or as a penalty imposed in 2026.

Was Diablo Immortal fined in 2026?
No new PEGI fine is established by the 2026 announcements. Instead, consumer-protection authorities opened or coordinated separate proceedings concerning broader practices in Diablo Immortal and other games. As of 8 October 2026, those matters were inquiries, not final findings or penalties.
Italy’s investigation
On 16 January 2026, Italy’s competition authority, AGCM, announced investigations concerning Diablo Immortal and Call of Duty Mobile. It cited possible misleading and aggressive commercial practices and possible consumer-rights violations. Its concerns included repeated prompts to claim time-limited content or make purchases, design that might encourage prolonged play, and potential effects on minors. The EU coordinated action
The European Commission says the Consumer Protection Cooperation (CPC) Network launched a coordinated action in early 2026 concerning Microsoft and Activision Blizzard games, including Diablo Immortal. Its listed concerns include virtual currencies, data collection, game design, default parental settings, direct exhortations to children, pre-contract information, and unilateral account blocking. AGCM’s October update
In an update dated 8 October 2026, AGCM said it was leading a coordinated action with Norwegian and Danish consumer-protection authorities, directed at Activision Blizzard UK and other Microsoft group companies. The authorities are examining whether a widespread infringement affecting consumers in at least three member states has occurred. AGCM connected this work to its earlier national investigations into Diablo Immortal and Call of Duty.

AGCM described concerns about virtual-currency transparency and fairness, bundles, dark patterns, parental controls, and assistance for blocked accounts. It explained that purchases may be priced in currencies such as platinum, globes, or diamonds while ultimately involving euros directly or through multiple virtual currencies. In AGCM’s view, bundles and related design practices can make it difficult for players—particularly minors and vulnerable consumers—to track spending. What the ESRB listing says
The ESRB’s Windows PC listing rates Diablo Immortal M for Mature 17+ for Blood and Gore and Violence, and also displays the notices “Users Interact” and “In-Game Purchases (Includes Random Items).” That is useful context for the ESRB listing, but it is separate from PEGI’s 2023 enforcement case and does not change the stated basis of that decision.
