The safest places to obtain a legal game download are the rights holder’s official store, a clearly licensed re-release, or the developer’s own page for a game whose license permits your intended use. A file being old, free, called “abandonware,” or available from an archive does not establish that its distribution is authorized. “ROM” describes a game file—not its legal status.
Start with the rights holder or an authorized re-release
Check the game publisher’s or rights holder’s current official storefront first. Nintendo identifies the Nintendo eShop and its website as official download channels for its games, and describes third-party-hosted or peer-to-peer copies as unauthorized. For other publishers, look for the rights holder’s own store or a re-release whose licensing is clear. Store catalogs change, and availability can differ by title, region, and date, so verify the live listing. A licensed collection may let you play older games legally, but it is not necessarily a source of standalone ROM files; treat it as a ROM source only if the product explicitly supplies authorized files for that use.
Check the license on homebrew and free games
Some developers make original games for retro hardware available to download. Confirm the creator and the specific title’s license, including whether it allows downloading, redistribution, and your intended use. “Homebrew,” “free,” and “downloadable” are not licenses by themselves.

For example, CRT Play’s Terms of Service say hosted games are original or open-source works submitted by rights holders or with permission, and that each title is distributed under its own license. That platform-level policy does not replace checking the terms attached to the particular game.
Why preservation collections are not general ROM libraries
U.S. law provides limited exemptions for specified preservation activities by eligible libraries, archives, and museums. Under 37 CFR 201.40, eligibility and conditions matter. In covered circumstances, the rules require lawful acquisition, limit the purpose of the activity, and restrict making preserved games available outside the institution’s physical premises. This is not a general public right to download games that are no longer sold.

The Library of Congress notes that preserving software and video games may require the proprietary console or a virtual or emulated version. Its Recommended Formats Statement for Software and Video Games describes preservation needs; it does not authorize public distribution of game files.
Does owning the cartridge make a downloaded ROM legal?
Do not assume that owning a physical copy gives you permission to download a copy from an unrelated website. Nintendo Australia states that its position applies even when the person owns an authentic game. Copyright and anti-circumvention rules vary by jurisdiction. The U.S. preservation exemption and Nintendo Australia’s guidance address different contexts; neither should be treated as a universal legal answer for every game, copying method, or country.
How to assess a ROM download before using it
- Identify the rights holder or developer. Start from an official publisher or creator page rather than relying on a search result or a file-hosting site’s description.
- Find permission for the exact game file. Look for a license or explicit statement authorizing the download and the use you have in mind. If the terms are unclear, do not treat the file as authorized.
- Distinguish a playable re-release from a ROM. A licensed collection may authorize playing its included games without granting access to, or redistribution of, standalone ROM files.
- Consider your jurisdiction and the method involved. The rules may differ by country, and a preservation exception limited to eligible institutions does not automatically apply to an individual download.
- Do not rely on labels or circumstances as proof. “Abandonware,” a preservation mission, a game’s age, or its absence from current stores does not by itself establish permission.
ROM legality and emulator legality are separate questions
Whether a game file is authorized depends on the rights and permissions for that file and its distribution. That question is separate from whether a particular emulator or copying method is lawful. The sources cited here do not establish a universal legal conclusion about every emulator or method, so assess each issue under the rules that apply where you live.
