The Supreme Court’s 2018 decision did not make esports betting legal nationwide. It struck down a federal law that restricted states from authorizing sports wagering, leaving each state to decide whether to permit it and which events or markets qualify. Esports wagering can operate through licensed channels where local law and regulator rules allow it—but the ruling itself did not approve any game, tournament, operator, or bet.
What the Supreme Court decided
On May 14, 2018, the Supreme Court decided Murphy v. National Collegiate Athletic Association, 584 U.S. 453 (2018). The case concerned the Professional and Amateur Sports Protection Act (PASPA), which made it unlawful for states to authorize sports-gambling schemes. The Court held that PASPA’s anti-authorization provision unconstitutionally directed state legislatures, violating the constitutional rule against commandeering state governments. It also found the law’s related anti-licensing provision unconstitutional and held PASPA’s provisions nonseverable. Read the Supreme Court’s opinion.
Justice Samuel Alito, writing for the Court, put the division of responsibility plainly: “Congress can regulate sports gambling directly, but if it elects not to do so, each State is free to act on its own.” He also wrote: “The legalization of sports gambling requires an important policy choice, but the choice is not ours to make.”
What the ruling means—and does not mean—for esports
The decision removed PASPA’s federal restriction on states authorizing sports wagering. It did not itself legalize betting in every state, create a national sports-betting license, or address esports specifically. Any legal route for esports wagering depends on the laws and regulator decisions that apply where the bettor and operator are located.

- It did: leave states free to make their own policy choices after PASPA was invalidated.
- It did not: approve esports wagering across the country or guarantee that every esports event, title, or type of wager is permitted in a state that allows sports betting.
“Step out of the shadows” describes the possibility of esports wagering moving into licensed, regulated channels where permitted. It is not language from the Court’s ruling and does not establish that all esports betting is regulated or legal.
Why esports availability depends on the event and jurisdiction
Sports-wagering permission is only part of the answer. A regulator may also determine which event categories can be offered, while operator licenses and market rules can affect the specific titles, tournaments, and bets available. For example, North Carolina’s State Lottery Commission lists “eSports” among event types that may be approved for interactive sports wagering. Before treating a particular esports bet as available legally, check the current rules for your jurisdiction and confirm:
- Whether sports wagering is permitted where you are.
- Whether esports is an allowed or approved event category under the applicable rules.
- Whether the specific game, tournament, and wager type are permitted.
- Whether the operator is licensed for that jurisdiction and offers that market there.
- What age-verification, identity, and responsible-gambling requirements apply.
Availability can vary by state and change over time. A listing on a sportsbook, or permission in another state, is not proof that a wager is legal where you live. Consult your local gaming regulator for current rules and verify the event and market with the licensed operator.

Why regulation matters to esports
Moving wagering into licensed channels can bring activity within a regulator’s rules, but it does not remove the need for safeguards. Age and identity checks are relevant to who can participate; event approval and market rules shape what can be offered; and game integrity and publisher control remain important considerations for esports. The Supreme Court did not resolve those questions. They are addressed, if at all, through state law, regulator decisions, and the rules governing particular events and operators.
