Valve Cuts Binding Arbitration From the Steam Subscriber Agreement

Valve announced that unresolved Steam disputes would go to court rather than arbitration under updated terms, while stressing that the change does not guarantee any particular claim or class action.

Valve announced on September 26, 2024, that it had removed the Steam Subscriber Agreement’s requirement for individual binding arbitration, its class action waiver, and prior cost and fee-shifting provisions. Valve said Steam Support remains the first step it encourages users to try; if support cannot resolve a dispute, the updated agreement provides for disputes to go to court instead of arbitration. That change does not guarantee a particular legal outcome or ensure that any specific dispute can proceed as a class action.

What changed in the Steam Subscriber Agreement?

In its September 26, 2024 announcement, Valve described three removals from the agreement: the requirement for individual arbitration, the class action waiver, and certain cost and fee-shifting provisions. Valve said it made the change after hearing from users and explained that unresolved disputes would proceed in court under the updated agreement.

In practical terms, Valve’s announcement replaced the contract’s prior route of individual arbitration with court proceedings for disputes that Steam Support does not resolve. The removal of a contractual class action waiver means the waiver is no longer part of the terms Valve described; it does not itself guarantee that a user can bring or join a class action. Other legal requirements and the facts of a particular case still matter.

What should a Steam user do if a dispute arises?

  1. Contact Steam Support. Valve continues to encourage users to try support first.
  2. Check the agreement that applies to your account. Agreement pages and copies can reflect different versions, so look for the applicable text and its date rather than assuming every search result is current.
  3. Get legal advice for a specific dispute. Valve’s announcement describes its contractual change, not how a court would decide any individual claim.

Does the change apply equally in every region?

No. Valve said the revision had limited impact for many customers in the EU, UK, Australia, New Zealand, and Quebec because the arbitration terms did not apply to them before the update. This is Valve’s summary of the change, not a comprehensive account of local law or a claim that every user in those places has identical rights. The announcement should not be extended to jurisdictions or circumstances it did not address.

Why might an agreement page still show arbitration language?

An indexed Steam agreement instance contains older arbitration wording, but that instance is not reliable evidence by itself of the current general agreement. Its wording conflicts with Valve’s account of the September 2024 revision. Treat the page’s version and date as important: do not present an undated or older agreement copy as the current general policy without confirming which terms apply.

What did later litigation address?

A 2026 order from the U.S. District Court for the Western District of Washington in Valve Corporation v. Abbruzzese recounted that the updated agreement included a retroactive King County forum-selection clause. The court denied Valve’s motion for a preliminary injunction in that case. The ruling was at a preliminary stage and concerned that case; it does not resolve every user’s rights or every dispute involving the revised agreement.
