Who Owns Gex Now? What the 2022 Embracer Deal Did—and Didn’t—Include

Gex appears to remain with Square Enix rather than Embracer, but public announcements and trademark records do not settle the complete chain of rights.

Gex appears to remain with Square Enix, not Embracer Group. Embracer’s 2022 acquisition announcement named several franchises it acquired, but not Gex. Square Enix’s continued commercial association with the series and trademark records naming Square Enix Limited support that conclusion. However, those records do not establish the complete legal chain for every Gex right.

Did Embracer buy Gex when it acquired Crystal Dynamics?

There is no Gex-specific transfer in the public announcements cited here. Embracer announced the completion of its acquisition of Crystal Dynamics, Eidos-Montréal, Square Enix Montréal and a catalog of intellectual property on August 26, 2022. It named Tomb Raider, Deus Ex, Thief and Legacy of Kain among the included properties, but did not name Gex. The announcement also referred to more than 50 back-catalog games without listing every title, so that figure does not establish whether Gex was included. Embracer Group’s completion announcement.

On September 5, 2022, Crystal Dynamics said it or an affiliate had taken control of selected franchises from Square Enix Limited, naming Tomb Raider and Legacy of Kain. Gex was not named. That statement supports distinguishing those announced franchise transfers from any assumption that every property associated with Crystal Dynamics changed hands. Crystal Dynamics’ announcement.

What evidence points to Square Enix?

Trademark records

Trademark-history pages list Square Enix Limited as the current owner of GEX registrations and show historical Crystal Dynamics ownership entries. This is relevant evidence for the GEX name and marks, but trademark ownership is not the same as a complete accounting of copyright, licensing, or all other franchise rights. GEX trademark history.

Current release partnership

Limited Run Games describes its Gex Trilogy release as a partnership with Square Enix. Its product page lists the collection for Nintendo Switch, PlayStation 5, Xbox and PC, and describes it as containing the original Gex, Gex: Enter the Gecko and Gex 3: Deep Cover Gecko. That is evidence of Square Enix’s current commercial connection to Gex, but a release partnership alone does not prove the entire chain of title.
