Double Fine Productions’ 2026 union petition was withdrawn, not rejected by the National Labor Relations Board (NLRB). The agency’s docket records a filing on May 7 and an approved withdrawal on May 20. Kotaku’s October investigation attributed the drive’s collapse to a mix of confusion over who belonged in the proposed bargaining unit, strained communication and workplace tensions. Those explanations come from interviews and reviewed messages; the NLRB docket gives no reason for the withdrawal.
What happened to the petition?
The NLRB docket lists an RC representation petition for Double Fine Productions Inc. in San Francisco, filed May 7, 2026. It lists 42 employees for the case, but that figure is not the number eligible for the proposed unit. The petition described a unit of regular part-time and full-time employees, excluding other employees, supervisors, guards and office clericals as defined in the National Labor Relations Act.
On May 20, the docket records both a withdrawal request and a letter approving that withdrawal. The case is marked closed. It does not record a union election, an NLRB rejection of the union, or a finding about why employees withdrew the petition. The NLRB case record establishes the procedural outcome, not the cause.
What did reporting say contributed to the collapse?
In an investigation published October 9, 2026, Kotaku said it interviewed 15 current and former employees, reviewed Slack messages and spoke with CEO Tim Schafer. Its account describes several overlapping sources of friction, rather than a single agreed explanation.

Disagreement over who belonged in the unit
Employees told Kotaku that there was confusion about which roles would be eligible for the proposed bargaining unit. The proposed unit’s exclusions mattered in a studio where, according to interviewees, responsibilities and management lines could be fluid or overlap. Some people outside the proposed unit reportedly felt excluded from a process that could affect their workplace; some interviewees said organizers could not give clear answers to direct questions about eligibility.
Those are accounts reported by Kotaku, not findings by the NLRB. The docket’s description defines the proposed unit in broad categories but does not resolve how particular jobs would have been classified.

Communication, workplace tensions and culture
Kotaku’s sources also described strained conversations, personal conflict and anti-union messaging during the two-week effort. Taken together, their accounts portray a campaign in which uncertainty about the unit and disagreements among colleagues reinforced one another. The reporting does not establish that every employee experienced those tensions in the same way or that any one factor alone caused the withdrawal.
An earlier organizing effort
Kotaku also described a separate organizing effort in 2019, including a meeting that became heated; later conversations were curtailed by the pandemic, according to the article. Game Developer’s summary likewise notes the earlier attempt and the pandemic’s role. That history provides context, but it should not be confused with the 2026 petition filed with the NLRB.

What Schafer said
Schafer told Kotaku that he generally supported unions and believed the games industry’s treatment of workers could create a need for protection. “I would say in general I’m pro-union and I think the games industry treats people terribly, and I can see where the need for protection comes from,” he said. He also said he did not want to intervene in employee organizing conversations because of his role as CEO. These statements describe Schafer’s stated views; they do not settle employees’ disputed accounts of the campaign.
Were the organizers laid off?
Kotaku reported that Double Fine laid off 23 employees on July 28, 2026, after the studio’s departure from Xbox. The report said all eight organizing committee members who signed the petition’s withdrawal letter were among those laid off. The overlap is notable, but the available reporting does not establish that union activity caused the layoffs.

Schafer denied that organizers were targeted. Game Developer quoted him saying, “That’s definitely not the reason. We didn’t target people for layoffs.” His denial is his account of the company’s decisions, not an independent determination of motive or a finding about retaliation.

The official procedural record is narrow: the petition was filed, withdrawal was requested and approved, and the case closed. Kotaku’s interviews and reviewed communications offer explanations for how the organizing effort unraveled, but those accounts are not NLRB findings. Neither the docket nor the cited reporting establishes an official conclusion that anti-union conduct or retaliation occurred.
