Check the law in the country relevant to the download, whether the source is authorized by the rights holder, and whether you are downloading someone else’s copy, making your own archival copy, or sharing a file. Those are different acts, and an exception for one does not automatically allow the others.
What determines whether a ROM download is legal?
A ROM contains game data. Copying or distributing that data can involve copyright, even if you own the cartridge or disc. WIPO-hosted legal analysis describes ROM creation as wholesale duplication and says that, in most jurisdictions, it would be clear-cut infringement without the rights holder’s authorization. That is a broad analysis, not a country-by-country legal survey.

Consider the specific game and rights holder, where you are downloading it, who supplied the file, whether that source is authorized, and what you intend to do with the copy. Owning an original, using an emulator, or calling a copy “personal” does not by itself answer all of those questions.
How to check the rules in your country
- Pin down the situation. Note the country relevant to the download, the game and platform, its rights holder, the website or service offering the file, and whether the file is an authorized release, your own archival copy, or a copy uploaded by someone else.
- Look for official local guidance. Check your national copyright office, government intellectual-property authority, or current statute. Look specifically for rules on software reproduction, private or archival copies, distribution, and circumvention of copy protection. Confirm that the material applies to your country and is current.
- Verify authorization at the source. Prefer an official store, publisher page, or explicit license that covers the game file. A third-party file-hosting page or peer-to-peer listing is not proof of authorization. Nintendo’s UK guidance, for example, identifies peer-to-peer offers and third-party file links as unauthorized copies for Nintendo games; that is a warning about those sources, not a substitute for checking local law or a specific license.
- Check the exact exception and its conditions. Do not rely on a general phrase such as “personal use.” Confirm that the rule covers game software, the source of the copy, and the act you plan to take. Pay attention to conditions such as lawful ownership, transfer or destruction of a copy, access to an online service, eligibility of an institution, and noncommercial use.
- Separate downloading, backing up, circumvention, and sharing. An exception allowing one act does not automatically allow the others. If the relevant sources conflict or the decision has significant consequences, seek advice from a qualified legal professional in your jurisdiction.
How common situations differ

Why owning the original is not a universal answer
Owning a cartridge or disc and obtaining a file from another person are not necessarily treated as the same act. The U.S. Copyright Office’s guidance on archival copies concerns a limited copy of computer software under stated conditions; it does not establish a general right to download a copy uploaded by someone else. In its guidance about Nintendo games, Nintendo Australia states: “It is illegal to download a Nintendo ROM from the internet whether or not you own an authentic copy of that game.” Attribute that statement to Nintendo Australia: it describes the company’s position on Nintendo ROMs, not the law in every country or the rules for every game.

What an emulator does—and does not—change
An emulator is software that can run games designed for another system. Its existence does not establish that a particular ROM was authorized or that obtaining it is lawful. Check the file’s rights and source independently, and assess any separate local rules on copy protection. A lawful or available emulator does not grant rights to game data.
When the answer remains uncertain
The sources discussed here do not provide an official rule for every country or an individual legal assessment of a particular title or download. In particular, a U.S. rule or a rights holder’s statement for Australia or the UK should not be applied as if it settled the law elsewhere. If your local official guidance is unclear, or the stakes matter, consult a qualified local lawyer rather than treating ownership, an emulator, or a site’s “personal use” label as proof of legality.
