ACT has pledged to change resource-consent rules so developers could not be required to fund, arrange, perform or participate in karakia or other spiritual observances. The proposal was announced on 3 October 2026; it is a party pledge, not an enacted law. It would also prevent spiritual or religious beliefs alone from being treated as adverse effects in consent decisions, according to Te Ao Māori News.
Can developers be forced to pay for karakia now?
ACT’s announcement does not itself change the law. It describes what the party says it would introduce if elected. The available report includes no draft bill or enacted amendment, so it does not establish whether a particular existing consent condition is lawful or how the proposed rule would work in practice.
The pledge is broader than payment. As reported, it would bar consent conditions requiring people to fund, arrange, perform or take part in karakia and other spiritual observances. It would not ban voluntary ceremonies.
What would ACT change about resource-consent decisions?
ACT proposes that purely religious or spiritual beliefs, by themselves, could not be treated as an adverse effect, used to refuse or restrict consent, trigger requests for further information, or justify consent conditions. The party says the rule would apply across religions and belief systems, rather than only to karakia.

Simon Court, ACT’s Infrastructure, Energy and Climate Change spokesperson, argued: “Planning law should regulate effects that can be identified, measured and tested, and protect rights recognised by law. It should not require planners, councils or judges to rule on spiritual or religious beliefs.”
What protections does ACT say would remain?
ACT says its proposal would leave protections for heritage sites, urupā, archaeological sites, customary physical uses, water quality, ecosystems and rights recognised in Treaty-settlement legislation intact. Court’s stated distinction is between identifiable physical effects, places, resources or legal rights, which planning should address, and effects based only on spiritual propositions. That is ACT’s description of its intended boundary, not a settled interpretation of planning law.

Which development examples have been cited?
Te Ao Māori News reported examples given by ACT, including housing developments allegedly required to invite iwi to perform karakia before construction; IKEA’s Sylvia Park consent, reportedly requiring invitations to seven mana whenua groups for karakia and ceremonies at specified construction milestones; and solar farms at Ongaonga and Ōpunake, reportedly subject to similar conditions.
The report also mentioned the Ōtākiri water-bottling dispute, which reached the Supreme Court and involved evidence about te mauri o te wai. The underlying consent documents and court judgment are not included in the available sources here, so these examples’ legal details should be understood as reported, not independently verified. Court said: “Leaving a requirement out is not the same as ruling it out. Without a clear boundary, people can still bring spiritual matters back in under broader cultural-effects provisions, leaving councils and courts to draw the line case by case.”

Is this the same as ACT’s workplace karakia proposal?
No. ACT announced a separate public-service workplace proposal on 16 August 2026. That policy says public-service employers should not initiate or resource cultural or spiritual practices at work, while public servants would remain free to practise their own religion, culture or traditions in their own time, with reasonable accommodation where appropriate. It is distinct from the October pledge about resource consents.
Separate official correspondence offers context about workplaces, not developer obligations. In an email dated 22 July 2024, the Public Service Commission said there were no formal standards or expectations for agencies’ use of karakia, that agency practice was at each chief executive’s discretion, and that no data showed how widely karakia was used. It said agencies commonly made karakia available or encouraged it, for example to open and close meetings, and referred to Human Rights Commission guidance that karakia should not be compulsory. This does not establish that resource consents legally require developers to pay for karakia.

What remains unclear?
Without draft statutory wording, the proposal’s precise reach, the planning processes and decision-makers it would cover, and its interaction with existing legislation cannot be assessed from the announcement alone. The cited consent conditions and the Ōtākiri judgment also are not supplied in the reporting materials. No topic-specific published statistic establishes how often developers face such conditions; the Public Service Commission’s statement that it has no data concerns public-service use only.
