What you can claim depends first on the airports and operating airline involved, then on whether you want fixed compensation, a ticket refund or rebooking, care while you wait, or reimbursement for reasonable expenses you paid yourself. EU and UK rules can provide fixed compensation for qualifying long arrival delays; U.S. federal rules primarily provide a ticket refund when a traveler declines a cancellation or significant change.
First identify which rules cover your flight
Check the whole itinerary, not just the airline you booked with. Record the departure and arrival airports, the operating carrier for each flight, whether the flights were booked together, and the final destination shown on the ticket. A connection can make the delay at the final destination more important than the delay to one leg. Your citizenship generally is not the deciding factor under the EU rules described here.

The Council of the European Union describes stronger passenger protections approved in July 2026, including expanded rerouting choices and reimbursement provisions. Its page says those measures include a three-hour point for arranging rerouting yourself if no appropriate option is offered and reimbursement of reasonable, proportionate expenses within 14 calendar days. The operative law, start date, and transition rules are not established here, so do not assume those newer provisions govern a particular trip. Check the rules in force for your travel date.
Keep the four possible remedies separate
- Fixed compensation is a prescribed payment that may be available under EU or UK rules when their conditions are met. It is not the same as getting the ticket price back.
- Refund or rerouting concerns the unused journey. A refund returns the ticket price; rerouting means being offered another way to reach the destination. In the United States, the DOT refund right described here generally depends on declining the alternative or not traveling.
- Care while waiting can include meals or refreshments and, when an overnight stay is needed, accommodation and transport. Under EU and UK guidance, this duty is distinct from fixed compensation.
- Expense reimbursement is a request to recover reasonable costs you paid because required assistance was not provided. Keep receipts; it is not an automatic substitute for fixed compensation.
An extraordinary event may defeat fixed compensation under EU or UK rules without necessarily removing the separate right to care or to choose a refund or rerouting where applicable.

EU flights: when a long delay may mean compensation
Under EU guidance, the key delay for fixed compensation is generally arrival at the final destination at least three hours late. The delay must be assessed alongside route coverage, connections, and its cause. Extraordinary circumstances that could not have been avoided even if all reasonable measures had been taken can exclude compensation. The European Commission’s Your Europe guidance, last checked 21 September 2026, says passengers arriving at their final destination three hours or more late are entitled to compensation unless the delay was due to extraordinary circumstances.

These are standard bands, not a promise that every passenger with a three-hour delay will be paid. Coverage, the final-destination arrival delay, the cause, and the itinerary still matter. If the airline relies on extraordinary circumstances, ask it to explain the reason and provide its supporting basis. Your Europe says the airline must prove the exception; examples of supporting material include logbook extracts and incident reports.

Care, refund, and rerouting in the EU
Assistance at the airport is a separate issue from compensation. The assistance that may be due depends on the circumstances, including the flight distance and length of the departure delay. If departure is delayed by five hours or more, Your Europe says you can choose reimbursement and, where relevant, return transport to your departure airport. For a cancellation, passengers generally choose between reimbursement and rerouting, while care at the airport may still be due.
UK flights: compensation bands and claim escalation
UK261 uses its own territorial tests. The UK Government says a passenger whose arrival at the final destination is more than three hours late may qualify for compensation if the delay was caused by the airline. Events outside the airline’s control can exclude compensation. Care can include meals and refreshments during qualifying long delays and, if an overnight stay is necessary, accommodation and transport between the airport and accommodation. At five hours or more of departure delay, a passenger may choose not to travel and receive a refund.

Submit the claim to the airline first. If its final response is unsatisfactory, or it has not responded after eight weeks, the UK CAA says you can take the complaint to the airline’s alternative dispute resolution (ADR) provider if it participates, or to the CAA’s Passenger Advice and Complaints Team. The CAA’s current table and the carrier’s complaint route are the places to confirm the amount and next step for your case.
U.S. flights: a refund is not the same as delay compensation
The DOT rule described in its refund guidance is about getting the ticket price back after a cancellation or significant change when you do not accept the alternative itinerary or travel. For a qualifying change measured by late arrival, the DOT page specifies at least three hours for a domestic itinerary or at least six hours for an international itinerary. It also lists other significant-change scenarios, so those time thresholds are not the only possible basis for a refund.

If you take the significantly changed or delayed flight, or accept and travel on an airline-offered alternative, you generally are not entitled to a DOT ticket refund under this rule. The rule should not be mistaken for a universal federal payment for delay, or a general promise to reimburse hotel, meal, or other expenses. Airlines may offer amenities under their customer-service commitments for controllable disruptions, but those are distinct from the DOT ticket-refund obligation.

Transport Canada’s comparison table describes APPR protections that include standards of treatment, alternate travel arrangements or a refund in specified circumstances, and delay-based compensation. It lists compensation of up to C$2,400 in its comparison. The same page warns that important parts of APPR may change under Bill C-47 and later regulatory action. Treat the figure as a high-level comparison, not a determination of what a particular traveler can claim; check current Canadian Transportation Agency guidance and the applicable regulations for the trip.

How to prepare and submit a claim
- Build the itinerary record. Save the booking confirmation, ticket or itinerary, boarding passes, and the names of the operating carriers. For connections, keep details for every leg and identify the final destination on the booking.
- Document what happened. Keep cancellation or delay notices, note the scheduled and actual arrival times, and save any written explanation the airline gives for the disruption.
- Separate the remedy requests. State whether you seek fixed compensation, ticket refund or rerouting, reimbursement of expenses, or more than one of these. Some requests may need separate submissions.
- Keep receipts for necessary costs. If the airline did not provide required assistance and you paid for meals, a hotel, local transport, or communications, keep itemized receipts and limit the claim to reasonable costs. UK Government guidance warns that luxury hotels and alcohol are unlikely to be reimbursed.
- Write to the airline. Identify the route, travel date, booking reference, disruption, arrival delay, remedy requested, and supporting documents. Keep a copy of the submission and the response.
- Escalate through the right route. EU passengers can use the Your Europe portal to identify the national enforcement body relevant to the itinerary. In the UK, use the participating airline’s ADR provider or CAA PACT after the applicable response period. For other jurisdictions, use the relevant regulator or complaint process.
Claim time limits and complaint processes vary. Check the applicable authority and airline instructions for the itinerary rather than assuming one deadline applies everywhere.
