Whether an influencer may promote gambling depends on the countries involved, the operator’s licence, the audience and the content. Disclosure rules are a separate check: a sponsorship can need an ad label even where the promotion itself is allowed. The guidance covered here applies to the United States and Great Britain; it should not be treated as a global rule or a campaign-specific legal opinion.
What determines whether an influencer gambling ad is legal?
Assess the campaign on two tracks: whether gambling promotion is permitted in the relevant jurisdiction, and whether the commercial relationship is disclosed properly. Meeting one requirement does not establish that the other is met.
- Jurisdiction and audience: Identify where the creator and intended audience are located, and whether the campaign targets consumers in another country.
- Operator and product: Check the operator’s licence and the local rules for the gambling product being promoted.
- Format: Determine which rules apply to the placement, such as social content or broadcast advertising.
- Commercial connection: Account for payment, affiliate commission, gifts, employment, ownership, or another personal or commercial relationship.
- Creative and audience: Review the claims, imagery, age appeal and likely effect on vulnerable viewers.
For Great Britain, the Advertising Standards Authority and Committee of Advertising Practice say gambling marketing rules can cover qualifying marketing by licensed operators, including third parties acting on an advertiser’s behalf. Their guidance says the Gambling Act does not apply outside Great Britain, so do not extend this position automatically to Northern Ireland, the Channel Islands or other countries. Do you need to label a gambling sponsorship as an ad?
Often, if there is a material commercial connection. The disclosure obligation is not the same as permission to advertise gambling: a clear label cannot make an otherwise prohibited promotion lawful.

United States: disclose the relationship
FTC guidance says influencers should disclose financial, employment, personal or family relationships with a brand. The connection can involve benefits other than cash, and creators should not assume followers already know about it. The FTC says the influencer should make the disclosure rather than relying on someone else to do so. Its endorsement guidance addresses disclosure of material connections; it does not by itself resolve whether a particular gambling promotion is permitted under applicable gambling laws.

Great Britain: make incentivised content identifiable
UK government guidance says content should be clearly identifiable as advertising when a creator has been incentivised in any way, and that it should reflect genuine experience. ASA/CAP guidance says a payment, another incentive, or a personal or commercial connection can make content an ad. A note in a creator’s profile does not, by itself, identify each individual post as advertising. Use a clear, prominent label such as “Ad” where appropriate, making it visible in the format in which the content appears. No particular label is a universal legal safe harbour.

Protect children, young people and vulnerable people
For non-broadcast marketing, CAP says gambling communications must be socially responsible, particularly in protecting children, young people and vulnerable people. Marketing should not be directed at under-18s through the medium or context, subject to limited exceptions for specified lottery and gaming categories. That means a creator or advertiser should examine not only the stated target audience but also the content’s context and appeal. ASA/CAP guidance on protecting young people
Avoid harmful portrayals and financial promises
CAP’s non-broadcast code prohibits irresponsible portrayals that could lead to financial, social or emotional harm. The broadcast code separately prohibits gambling ads from suggesting gambling can provide an escape from problems, solve financial concerns, replace employment or deliver financial security. Apply the code relevant to the placement rather than assuming the broadcast rule is the only standard for social content. CAP non-broadcast gambling guidance; BCAP Section 17: Gambling
Can you promote a betting app on Instagram or TikTok?
The available guidance does not establish a blanket yes or no for any particular platform. A platform name alone does not determine legality. Check the relevant gambling-ad rules, operator licence, intended audience, content and disclosure requirements, as well as any platform rules that apply to the campaign. Do not infer permission from the fact that another creator has published similar content.

Yes. The United States and Great Britain guidance described above address different issues and should not be treated as interchangeable. In the US, the FTC materials explain endorsement disclosures, while gambling permission depends on applicable jurisdiction-specific rules. Great Britain’s gambling advertising rules cover qualifying marketing by licensed operators and can apply to third parties acting for them; the CAP guidance expressly does not extend the Gambling Act position beyond Great Britain.

Cross-border targeting can matter. ASA/CAP reported that a 2025 change brought content marketing targeted at UK consumers by licensed operators registered outside the UK within the UK Advertising Code’s scope. Check the current rules for the target market and campaign before relying on an operator’s location alone. ASA/CAP gambling guidance
Pre-publication checklist for a creator or campaign team
- Map the jurisdictions. Record where the creator, audience and operator are located, and identify any market the campaign targets.
- Verify the operator and product. Confirm the relevant licence and check the rules that apply to the specific gambling product and market.
- Identify the connection. Include cash, commission, gifts, employment, ownership and other incentives or relationships when deciding whether disclosure is needed.
- Label the content itself. Put a clear advertising disclosure where viewers will see it in the post or video; do not rely only on a profile bio or another party to disclose it.
- Review audience and creative. Assess age appeal, context, claims and portrayals of gambling, including whether they could encourage harm or imply financial security.
- Check the format-specific and platform rules. Distinguish broadcast from non-broadcast requirements and verify current platform policies before publishing.
- Get local advice when facts are uncertain. A qualified lawyer or relevant regulator can assess the exact operator, audience, placement and creative.
