There are two different issues readers may mean by “Call of Duty ban lawsuit.” The Uvalde families’ civil case concerned allegations about products used by the teenage gunman; it was not established as a lawsuit seeking to ban Call of Duty. Separately, Activision offers a support appeal process for certain account penalties, but the available sources do not establish an active lawsuit over wrongful player bans. A January 2026 local report says Activision was dismissed from the Uvalde case; the dismissal order and any appeal status were not available in the retrieved reporting.
What the Uvalde lawsuit alleged
The Associated Press reported that Uvalde families sued Meta and Activision Blizzard in California on May 24, 2024, and also sued Daniel Defense, which manufactured the rifle used in the 2022 school shooting. The families alleged that the companies bore responsibility through products used by the teenage gunman. Those are plaintiffs’ allegations, not findings that a court has established. AP’s report on the filing describes the claims.

What happened in court—and what is known about Activision’s status
July 2025: Activision’s First Amendment argument
At a July 18, 2025 hearing, AP reported that Activision attorney Bethany Kristovich argued the First Amendment barred the families’ claims, saying, “First Amendment bars their claims, period full stop.” That was counsel’s argument, not a ruling. AP said the judge did not rule at the hearing and gave no timeframe for a decision. Read AP’s hearing report.
January 2026: a report of dismissal
A local Los Angeles news report dated January 29, 2026 says a judge dismissed Activision Blizzard as a defendant in the Uvalde lawsuit. The underlying dismissal order and a later docket entry were not available in the reporting retrieved for this article. As a result, the court’s reasoning, whether the dismissal is final or was appealed, and the verified status of claims against other defendants cannot be stated here. See the local report.

A lawsuit and a player ban appeal are different matters
| Issue | Uvalde civil lawsuit | Individual Call of Duty account penalty |
|---|---|---|
| Who is involved | Uvalde families sued companies, including Activision Blizzard, Meta, and Daniel Defense, according to AP’s May 2024 report. | A player asks Activision to review an account penalty through its support process. |
| What is at issue | Plaintiffs’ allegations about companies’ products and the shooting; these were not established as court findings. | Whether Activision’s published appeal rules permit review of the specific penalty, including whether a permanent ban resulted from a hacked account. |
| Where it proceeds | A civil court case. | Activision’s account-support and appeal process, not the Uvalde litigation. |
| Next step described in the sources | The available January 2026 report says Activision was dismissed; it does not establish appeal status or the claims’ current full procedural posture. | Use Activision’s ban appeal or hacked-account recovery guidance as applicable. |
A separate federal case, Johnson v. Activision, involved allegations of gaming addiction and brain damage, not an account-ban dispute. On February 18, 2025, the Eastern District of Arkansas ordered arbitration and stayed claims against Activision defendants. It should not be confused with either the Uvalde case or a lawsuit about wrongful bans. Read the court order.
How Activision says its ban appeal process works
Activision’s published policy says a permanent ban will be overturned only if Activision determines that the infraction resulted from a hacked Activision account. The policy states that temporary bans and limited matchmaking states are not eligible for appeal, and hardware bans are also ineligible. Activision says appeal decisions are final and that it may provide only the appeal status, rather than details of its detection methods, to protect security systems. These are Activision’s support rules, not a court’s assessment of whether a particular penalty was justified. Check Activision’s ban appeal guidance.

If you believe your account was hacked
- Use Activision’s account recovery process. Its hacked-account page is the route it identifies for an account compromise. Open the account recovery request.
- Try a linked platform account if needed. Activision’s recovery page lists linked platform accounts as a possible way to log in and submit a request.
- Follow the appeal guidance for the resulting penalty. Account recovery is not a promise that a ban will be reversed; Activision says it overturns a permanent ban only when it determines the infraction resulted from a hacked account.
What Activision’s terms say about disputes
Activision’s current U.S. Terms of Use describe individual binding arbitration and a class-action waiver for covered disputes. They also describe an informal dispute-resolution period and an opt-out mechanism. The agreement version, applicable law, jurisdiction, deadlines, and individual circumstances can matter, so the terms alone do not establish what rights or options a particular player has. Anyone considering a legal claim should consult a qualified lawyer. Read Activision’s U.S. Terms of Use.
Does a class action exist over wrongful Call of Duty bans?
The available sources do not establish an active class action specifically seeking relief for wrongful Call of Duty account or chat bans. An individual Reddit post asks whether such a class action exists, but one post is not evidence that bans are widespread or that litigation has been filed. Activision’s account-appeal policy is the documented route for eligible penalties; the sources cited here do not establish that an external lawsuit is available to a particular player.
