Separately, a player with at least three years of service, prior-season Super Two status, or a previous career outright may be able to elect free agency instead of accepting an outright. A designation for assignment (DFA) alone is not an outright assignment.
What does “refuse an outright assignment” mean?
An outright assignment is the transaction that assigns a player’s contract to a Minor League club after he clears outright waivers. It is different from being designated for assignment, or DFA’d: a DFA removes a player from the 40-man roster and starts a process that can end in a trade, waiver claim, outright assignment, or release.
The rights involved are not all the same. One rule protects some players from being sent to the minors without consent; other provisions let a player choose free agency instead of accepting an outright.
Which players can refuse or elect free agency?

These categories can overlap. A player’s exact rights depend on his service record, prior-season status, outright history, and the transaction actually taken.

How the five-year consent right is calculated
Major League Rule 6(e)(1) sets the assignment-consent threshold at five or more years of Major League service, excluding time on the Military List; the rule also states a seven-year threshold when Military List service is counted. For this calculation, a full service season is 172 days, and service before or after a championship season is excluded. Major League Rules, Rule 6(e)(1).
This is protection against assignment to a non-Major-League club without written consent. It should not be read as an automatic guarantee that any refusal immediately makes the player a free agent. The MLBPA’s plain-language FAQ says such a refusal “may result” in free agency, while the agreement separately spells out circumstances where free agency is an election in lieu of accepting an outright. What happens after a DFA?
- The club designates the player for assignment. He is immediately removed from the 40-man roster.
- The club has seven days to resolve the DFA. It can trade the player or place him on outright or unconditional release waivers. MLB.com, “Designate for Assignment”.
- If he clears outright waivers, the club may make an outright assignment, subject to the player’s applicable consent rights and free-agency elections.
Thus, a DFA does not itself mean the player has been sent down, nor does it alone trigger a right tied to an actual outright assignment.
How this differs from ordinary six-year free agency
Ordinary free-agent eligibility is a separate route: the MLBPA describes a player with six or more years of Major League service whose contract is unsigned for the next season as eligible for free agency. That is not the same as refusing a minor-league assignment or electing free agency after an outright. MLBPA FAQ.

Which rules are current?
The provisions described here are based on the Major League Rules and the 2022–2026 Basic Agreement, which took effect March 10, 2022.
