Yes, usually—but “the tool lets me generate it” is not the same as “the studio owns it” or “the asset is infringement-free.” A studio can generally ship AI-assisted or AI-generated art, text, music, voices, animation, code, or other assets in a commercial game when its provider contract permits that use, every uploaded reference is cleared, human creators make a meaningful contribution where copyright protection matters, and the release satisfies platform and jurisdiction-specific rules.
Commercial-use language is a contract permission. It does not automatically create exclusive copyright, prove that an output is original, or protect a studio from claims involving training data, substantial similarity, trademarks, publicity rights, or confidentiality. Treat each asset as a rights-clearance and provenance task, not as a simple export from an AI tool.

What “legal to use” actually means
Four separate questions are often collapsed into one:

The answer depends on the service, plan, model, inputs, and terms in force when the asset was made.
- Does anyone hold copyright in the output? In the United States, protection turns on human authorship, not on whether a prompt was clever.
- Could the asset infringe someone else’s rights? Commercial distribution increases the stakes; an output can be contractually usable and still resemble protected art, a logo, a character, a voice, or a person’s likeness.
- Can the game be released on the intended platform and in the intended markets? Storefront disclosure questions and regional rules change, so a launch review is required.
A defensible production process answers all four and preserves evidence for each shipped asset.

U.S. copyright: human authorship is the controlling issue
What the Copyright Office says
The U.S. Copyright Office’s Part 2 report, released January 29, 2025, says generative-AI output can be protected only when a human author determines sufficient expressive elements. A prompt by itself is generally not enough. The relevant human contribution may instead be perceptible creative material, a creative arrangement of elements, or meaningful modifications to the generated result.
The Office stated: “The Copyright Office confirms that the use of AI to assist in the process of creation or the inclusion of AI-generated material in a larger human-generated work does not bar copyrightability.” That means AI assistance does not automatically cancel copyright in an otherwise human-authored game, scene, cutscene, soundtrack, or composite image. Protection covers the studio’s human contribution, not necessarily the machine-generated portions.
Examples of contributions that can matter
For a game asset, documented human work could include an artist’s original character design, selection and arrangement of generated elements into a distinctive scene, texture painting, mesh and topology edits, animation cleanup, shader and lighting work, sound editing, dialogue direction, or compositing several sources into a new expressive result. The more the final expression reflects deliberate human decisions that can be identified in the finished work, the stronger the copyright position.

If registration is sought, the Copyright Office requires applicants to disclose AI-generated material and identify the human-authored contribution. Keep that distinction in the asset record and in any registration application.
Copyright in a complete game versus copyright in one generated file
A studio may own copyright in its original game code, writing, level design, art direction, editing, and overall compilation even when some component images, sounds, or text are not independently protectable. Copyright can cover the human-authored selection, coordination, and arrangement of material in a larger work. It does not turn every unprotectable generated element into exclusive studio property.
This distinction affects enforcement. A competitor might not be barred from making a similar standalone generated image if no protected human expression is copied, while copying the studio’s original level composition, edited character design, or distinctive human-created arrangement could still infringe. Maintain layered source files and contribution notes so the studio can show which parts it created and how they were combined.

Infringement risk: generation does not equal clearance
Review the inputs
Before generation, verify rights to every uploaded reference: concept art, photographs, scans, logos, fonts, texture samples, music stems, voice recordings, scripts, and likenesses. A reference supplied by a contractor, fan, freelancer, or another department may carry restrictions that do not appear in the AI tool’s terms. Obtain written permission or use material whose license covers the intended commercial game, territories, platforms, edits, and sublicensing.
Review the output
Check high-visibility output for substantial similarity to a protected work, recognizable fictional characters, logos and trade dress, real people’s faces or voices, and distinctive musical passages. An output can be newly generated yet still create legal exposure if it reproduces protected expression or evokes a person or brand in a way that triggers trademark, publicity, or unfair-competition claims. Escalate unusual likenesses, style imitation, celebrity voices, and requests to reproduce a named artist’s signature look to qualified intellectual-property counsel.
Fair use is a fact-specific defense
United States law lists four fair-use factors in 17 U.S.C. §107: the purpose and character of the use (including commercial purpose), the nature of the copyrighted work, the amount and substantiality used, and the effect on the potential market or value. A commercial game is not automatically outside fair use, but commercial distribution is an important part of the analysis. The factors must be applied to the particular input, output, and market circumstances; there is no blanket “AI safe harbor.”
The Copyright Office treats training on copyrighted works, infringement by outputs, and licensing as distinct policy questions. Therefore, a provider’s statement about its training practices does not by itself clear your uploaded references or guarantee that a particular result is non-infringing.
Provider contracts: commercial permission, ownership, and hidden obligations
Read the exact terms for the account and model used. Record the plan, effective date, model or version, and any enterprise addendum. The following positions are described in the cited provider materials and can change, so preserve a copy at generation time.

For every provider, ask whether prompts and uploads are private, how long they are retained, whether they are used to improve the service, and whether an enterprise plan changes those settings. If the provider offers an indemnity, read exclusions, caps, procedures, and the assets or jurisdictions it covers. A marketing phrase such as “commercial use” is not a substitute for those details.

EU obligations and vendor due diligence
European Commission guidance on general-purpose AI providers says the EU AI Act requires providers to establish copyright policies and publish summaries of training content, with the relevant obligations applying from August 2, 2025. These are primarily provider obligations, but they create practical procurement questions for a studio: can the vendor show its copyright policy, training-content summary, and applicable licensing or opt-out mechanisms?
Those documents do not grant a studio ownership of an output or remove national copyright, trademark, personality-right, or contract risks. For an EU release or a team operating in the EU, retain the vendor’s compliance documentation with the asset record and have counsel assess local rules where the project’s distribution, contractors, or subjects make the issue material.
Storefront disclosure and release requirements
There is no single permanent disclosure rule that applies to every game storefront, platform, region, and date. Before submission, read the current developer documentation for each target platform and answer AI-content questions accurately. Save the completed disclosure with the build and submission record.
Separate content players actually receive from behind-the-scenes assistance. Final generated art, sound, writing, voices, or live-generated player-facing output may be treated differently from an AI tool used only to brainstorm, refactor code, or make an internal placeholder. Do not assume that a platform’s policy for one category applies to another, and re-check requirements immediately before launch because labels and questionnaires can change.
A defensible AI-asset workflow
1. Inventory what will ship
List every AI-assisted asset in the game and in launch marketing. Classify whether it is player-facing, included only in promotional material, used internally, or generated live after release. Assign an owner and an asset identifier before approval.
2. Freeze the contractual record
Save the provider name, plan or subscription tier, model and version, terms URL, effective date, generation date, and any enterprise restrictions or indemnity. Re-check the terms before launch if generation occurred months earlier; a current webpage may not be the terms that governed the original creation.

3. Clear every input
Attach licenses or permissions for references, voices, likenesses, logos, photographs, scans, music, and text. Record territory, duration, media, modification, and sublicensing rights. Remove an input that cannot be documented rather than relying on a general tool license.
4. Make and record human contributions
Have artists and designers perform meaningful selection, editing, arrangement, compositing, or transformation where copyright protection is important. Preserve prompts, rejected generations, source files, layer histories, edit notes, and the names of human contributors. A final export alone cannot show how much human expression determined the result.
5. Run risk review
For prominent assets, check visual and audio similarity, trademarks, publicity rights, content-policy restrictions, and recognizable characters or styles. Route edge cases—especially celebrity likenesses, cloned voices, living-artist imitation, or uncertain training provenance—to IP counsel.
6. Document the final state
Record exactly which AI material remains in the shipped asset, which human edits are included, who approved it, and whether any material was removed. Keep the final file, source files, approvals, and terms snapshot together so a registration, platform inquiry, or dispute can be answered without reconstructing the history.
7. Complete launch checks
Immediately before submission, verify platform questionnaires, regional disclosures, privacy and publicity permissions, and any game-rating or content-safety requirements. Preserve the submitted answers and the build hash or version they describe.

What records should a studio keep?
Keep an auditable package for each asset or asset batch:
- Prompt, generation settings, input files, and permissions for those inputs.
- Provider, account plan, model or version, generation date, and terms snapshot.
- Original outputs, selected output, rejected alternatives, and edit history.
- Names of human contributors and a concise description of their creative decisions.
- Similarity, trademark, likeness, and content-policy review results.
- Approval owner, final asset hash or version, and where the asset appears in the game or marketing.
- Any copyright-registration disclosure, storefront questionnaire, vendor correspondence, or counsel advice.
Store records under normal access controls because prompts and references may contain unreleased designs, personal data, confidential contracts, or trade secrets. Preserve them for at least the life of the game’s distribution and any period required by your contracts, insurance, or legal hold policy.
Common mistakes and how to correct them
“The provider says commercial use, so we are covered.”
Commercial-use wording addresses contractual permission, not copyrightability or third-party infringement. Correct the mistake by completing input and output review and preserving the applicable terms.

Public availability is not a license. Trace the source and obtain permission or replace the reference with cleared material.

Platform rules are volatile and category-specific. Check each current developer policy and retain the submitted answer.
“A cancellation deletes our obligations.”
Provider terms can preserve ownership while also granting continuing licenses over inputs and assets. Review survival, publicity, confidentiality, and sublicense provisions before using sensitive material.

Bottom line for a commercial game
Use AI assets when the studio can prove a clean chain of permission and contribution: the provider contract allows the intended use; every input is licensed; human creators shape the final expression; high-risk outputs pass similarity, trademark, and likeness review; and platform and regional disclosures are complete. The result may be commercially shippable even when a purely machine-generated component is not independently copyrightable. What makes the workflow defensible is not the generation button—it is the documented combination of contract rights, human authorship, provenance, review, and release compliance.
