Not necessarily. Steam’s current Subscriber Agreement directs covered disputes to courts in King County, Washington, and says the provision reaches some disputes that arose before the agreement. But in a case involving Steam users whose arbitrations were already pending, a federal district court found that retroactive clause likely unconscionable and unenforceable as applied to those defendants. That was a preliminary, fact-specific ruling—not a final decision that the agreement is illegal or that every Steam user can bring or join a class action.
What the updated Steam agreement says
The agreement’s dispute-resolution section directs disputes and claims between Valve and a user to be brought and maintained exclusively in a state or federal court in King County, Washington, if that court has subject-matter jurisdiction. It expressly includes disputes or claims that arose before the current or a prior agreement existed. The section also says the Federal Arbitration Act applies to it to the extent permitted by the laws of the user’s country.
That language describes Valve’s contractual position; it does not by itself settle whether a court will enforce the provision in every dispute. The agreement’s application can depend on the regional version, the law that applies, the relevant dates, and the user’s circumstances.
What the court decided in Valve v. Abbruzzese
On May 27, 2026, the U.S. District Court for the Western District of Washington denied Valve’s request for a preliminary injunction in Valve Corporation v. Abbruzzese. The case concerned defendants whose arbitrations were already pending when Valve sought to rely on the updated agreement’s retroactive forum-selection clause.

The court concluded Valve had not shown it was likely to succeed because the clause was likely unconscionable as applied to those defendants. It considered both procedural and substantive unconscionability. Judge Jamal N. Whitehead wrote: “The retroactive forum clause it drafted is unconscionable as applied to Defendants and is thus unlikely to be enforced.” The limiting words matter: the conclusion addressed those defendants and their circumstances.
Where the case stands on appeal
On July 30, 2026, the district court certified its order for interlocutory appeal and stayed the case while the appeal proceeded. Judge Whitehead described the issue as a “novel legal question on which fair-minded jurists might reach contradictory conclusions.” A later district-court order reports that the Ninth Circuit accepted the appeal on September 16, 2026.

As of October 8, 2026, the available court materials do not establish a Ninth Circuit decision on the merits. Acceptance of an interlocutory appeal is not the same as an appellate ruling that either validates or invalidates the clause.

That general background does not decide the distinct questions raised in this case: whether the updated terms were properly formed, whether applying them retroactively is unconscionable, and how the specific procedural history affects enforcement.

Nor does the agreement’s reference to the Federal Arbitration Act eliminate the agreement’s own qualification for the laws of a user’s country. A U.S. federal court’s decision in this litigation should not be treated as a universal answer for users in every jurisdiction.

There is no universal answer for every claim. The outcome may depend on where the user lives, which agreement version they accepted and when, whether they affirmatively accepted updated terms, the type and timing of the claim, and whether arbitration or court proceedings have already begun. The Abbruzzese order is especially relevant to the last circumstance, but it does not automatically resolve other users’ disputes.
