The answer depends on your country, the game’s license and technical design, and what you mean by “keep playing.” Ordinary offline play, bypassing an authentication check, running a private server, and sharing a modified client are different legal questions. In the United States, a narrow federal rule permits certain circumvention to restore personal local play in qualifying games; it does not generally authorize bringing online play back. EU law does not guarantee that every discontinued game must remain playable, though consumer-protection remedies may apply in some circumstances.
First establish what the shutdown actually disables
A server closure does not have one standard effect. A game may still run offline or in local multiplayer; it may need a publisher server only to verify a license or authenticate a copy; or it may depend on remote systems for core gameplay, such as multiplayer, progression, or content. A shutdown can therefore leave a game partly playable or make it unusable. The technical effect alone does not settle whether a workaround is lawful.
Also separate keeping files from using them in a particular way. Having a disc or downloaded copy does not, by itself, answer whether you may bypass a software protection, access a discontinued online service, reproduce server-side content, or distribute a modified client. Check the game’s license and shutdown notice, then identify the exact activity you are considering.
What the U.S. rule allows—and where it stops
Under 37 C.F.R. § 201.40(b)(19), a person may circumvent a technological measure in a lawfully acquired complete game, in physical or downloaded form, when the copyright owner or its authorized representative has ceased providing access to an external server needed for authentication. The permitted purpose is restoring access for personal local gameplay on a PC or console. This is a limited exemption to the DMCA circumvention prohibition, not a general right to revive the game’s online service.

What counts as a qualifying game and shutdown
For the personal-play provision, a “complete game” must be playable without accessing or reproducing copyrightable content stored or previously stored on an external server. The owner must have affirmatively ended support and that support must actually be unavailable; alternatively, support must have been discontinued for at least six months and not restored. “Local gameplay” covers play on a PC or console, including locally connected PCs or consoles, but excludes play through an online service or facility.
What the exemption does not generally authorize
The rule is not a blanket authorization to host or access online play, operate a public or private server, obtain server-side copyrighted content, distribute a modified copy, or disregard other applicable laws. A private-server project or modified-client setup raises distinct questions; this rule alone does not resolve them. The specific game, software changes, server functions, and distribution arrangements matter.

Separate preservation provisions for institutions
Eligible libraries, archives, and museums have a restricted preservation pathway. For qualifying preservation, the regulation permits certain access and modification on a noncommercial basis, but the preserved game may not be distributed or made available outside the institution’s physical premises. This institutional provision is not a general public entitlement to play a preserved copy remotely. The regulation also covers certain games that are already independent of a server but are no longer reasonably available commercially, subject to institutional restrictions. For this preservation branch, “complete game” can include a game copy together with a copy of code stored or previously stored on an external server.
What EU rules say about discontinued games
The European Commission’s position as of 16 June 2026 is that it cannot at this stage propose a general legal obligation to keep video games playable after they stop being provided commercially. The Commission pointed to rights holders’ intellectual-property rights and existing consumer safeguards. That position is not a ruling on every contract or national dispute, and it does not mean consumers have no possible remedy.

In its 5 June 2024 answer to written question E-001023/24, the Commission said EU consumer-protection legislation “does not set specific requirements as to the duration of the supply of products, including of online video games.” It described protections involving transparency about material offer terms, unfair commercial practices and contract terms, and remedies if a product or service does not conform. Depending on the circumstances, remedies may include bringing the service into conformity or, if the supplier makes clear it will not do so, a proportionate price reduction or contract termination. For a terminated time-based digital supply, reimbursement may cover the prepaid portion of the remaining affected period. These outcomes are not automatic refunds for every server closure; national courts and administrative authorities handle individual cases.
On 16 June 2026, the Commission also announced that it would initiate an exchange with industry and consumer representatives by the end of 2026, with the aim of drawing up an industry code of conduct on game end-of-life and raising awareness of consumer rights. This was a planned policy process, not an enacted universal right to continue playing discontinued games.

How to assess a particular game or workaround
- Identify the applicable country and terms. Note where you live and any governing-law terms in the game’s license. The U.S. rule described above is a specific federal exemption; the EU framework concerns consumer rights and does not create a universal playability guarantee.
- Read the shutdown notice and identify the server’s role. Determine whether the server handled authentication only or supplied multiplayer, progression, content, anti-cheat, or other functions. Establish whether any ordinary offline or local mode still works.
- Describe the proposed activity precisely. Playing an existing offline mode is different from modifying files to bypass authentication, recreating a service, running a private server, or distributing a modified client. Do not assume the narrow U.S. local-play exemption covers those other activities.
- Compare the purchase terms with what was provided. Look for statements about duration, termination, and shutdown, as well as the notice given. If you are considering a consumer remedy, preserve the receipt, the product page and terms shown at purchase, and the shutdown notice.
A reliable general answer is therefore conditional: some local play may remain available without circumvention; qualifying U.S. games may fall within a narrow personal-local-play exemption; and other forms of online revival or modification need separate analysis. In the EU, consumer remedies depend on the contract and circumstances, rather than a general guarantee that a game will run indefinitely.
