Not reliably. A genuinely public-domain film may be lawful to stream, but YouTube can still match it, interrupt a live broadcast, or place a Content ID claim on an archived replay. Public-domain status and avoiding a platform claim are separate questions; neither a film’s age nor a public-domain label guarantees a claim-free stream.
What can happen during and after a livestream
YouTube says it scans live streams for matches to third-party content, including material in another live broadcast. If it identifies such content, it may display a placeholder and warn you to stop streaming it. If the content remains, YouTube may temporarily interrupt or terminate the stream. If you choose to archive the livestream, YouTube says Content ID claims are made after the stream is complete. YouTube Help: Copyright issues with live streams.
A Content ID claim and a copyright removal request are not the same thing. Depending on the claimant’s settings, a claim may block, monetize, or track a video, and its effect may vary by country or region. A valid copyright removal request can remove content and result in a copyright strike. YouTube explains these distinctions in its Content ID claims guidance and copyright strike guidance.
Verify the exact film and the exact copy
Public domain means a work is not protected by copyright, for example because its copyright term expired or it was not eligible for protection. But status depends on the specific work and the relevant territory. YouTube’s general copyright overview says rules vary by country or region; its broad description of copyright terms is not enough to clear a particular film. YouTube Help: Copyright on YouTube.

Do not rely on a film’s age, a label on a video-sharing site, or the fact that you own a copy. Identify the film and the version you plan to stream, then look for reliable rights documentation. Record the country of origin, publication history, and the basis for your conclusion. Consider the soundtrack and any added or altered material in the specific print. A restoration or transfer does not automatically have a new copyright, but a particular version may contain separately protected contributions.
For films published in the United States
The U.S. Copyright Office says works published in the United States before January 1, 1931 are currently in the public domain because their copyright protection has expired. That date is specific to U.S.-published works and should not be applied to foreign works, later works, or another country’s law. The Copyright Office also documents restored copyrights for certain foreign works that had been in the U.S. public domain; consult its Notices of Restored Copyrights and linked official records when relevant.

Why public-domain footage can still trigger a match
YouTube’s Content ID eligibility guidance says public-domain footage, recordings, and compositions are not eligible as reference material, and that claimants must have exclusive rights to material they submit. That does not guarantee that a stream containing public-domain material will never be matched, mistakenly claimed, or interrupted. YouTube itself warns that none of its suggested ways to use content guarantees avoiding copyright issues. YouTube Help: Content eligible for Content ID.
The specific copy still matters. A soundtrack, restoration, edit, or other added material may present a separate rights question even when the underlying film is public domain. Check the version you will actually broadcast rather than assuming that the status of an earlier print or underlying story settles every issue.

What to do before going live
- Identify the work and version. Note the title, source, print or restoration, soundtrack, and any edits or additions.
- Check the relevant territory. Establish where the work was made and published, and assess its status where you expect the stream or replay to be available. Rules vary by country or region.
- Review reliable rights records. For a U.S.-focused review, consult Copyright Office records and, for potentially restored foreign works, the official restoration notices. Keep copies of the records and provenance supporting your conclusion.
- Consider rights in added elements. Check the soundtrack and version-specific restoration or other material separately; do not assume every element shares the underlying film’s status.
- Plan for platform enforcement anyway. A lawful basis to stream does not prevent a mistaken match or live interruption. Decide how you will respond and preserve relevant records.
If YouTube claims or interrupts the stream
Review a claim on an archived replay
In YouTube Studio, review the claim details, including the claimant, matched segment, and any territorial limits. Compare the identified material with the exact version you streamed and the records supporting your rights. YouTube says you may dispute a claim when you have the necessary rights, believe the content was misidentified, or have another valid basis. Credit, owning a copy, or not monetizing the video is not enough by itself. YouTube Help: Dispute a Content ID claim.
Dispute only when you have a supportable basis. A claimant may seek removal after a dispute, and a valid removal request can lead to a strike. A claim is not automatically a strike, but an unsupported dispute can escalate the problem.

Respond to a live warning
If YouTube displays a placeholder or warning, follow the on-screen notice and stop the identified content if required. Do not assume that a public-domain determination will prevent an interruption from continuing. If you are streaming under a license, YouTube advises asking the rights owner to add your channel to its Content ID allowlist; that is relevant to licensed material, not a substitute for verifying public-domain status.
