Short answer: Nintendo says downloading or uploading pirate copies of its games is illegal. Nintendo also treats devices or software that bypass Switch security to enable unauthorized copies or modifications as piracy-related circumvention. The legal details can depend on where you live and the facts of a particular case, so Nintendo’s policy and agreement should not be mistaken for a complete legal analysis of every situation.
What Nintendo considers piracy on Switch
Nintendo defines piracy as copying, downloading, or distributing illegal video game products. Its Intellectual Property & Piracy FAQ says that pirate copies of Nintendo games shared through peer-to-peer networks or third-party file-hosting links are unauthorized copies, often called ROMs. Nintendo’s stated position is that uploading and downloading those copies is illegal.
The concern is not limited to game files. Nintendo also identifies products that bypass console security measures to enable unauthorized copies, modifications, or play of unauthorized game files. Its examples include piracy cartridges, game copiers, USB piracy sticks, and mod chips. In its guidance, Nintendo names MIG Switch/MIG Flash, R4 Switch, HWFLY, and PICOFLY as examples of products in this category; these are classifications, not recommendations.
Risks Nintendo warns about
Nintendo warns that unauthorized products may damage a console, and that resulting damage is not covered by its warranty. It also says unauthorized devices may limit functionality, including online play, and that a console may stop working after network updates. These are possible consequences Nintendo identifies, not guaranteed outcomes for every console or user.

The North American Nintendo Switch User Agreement says content obtained through an unauthorized device or unauthorized hardware or software modification may be removed. It also warns that updates or unauthorized modifications may render a console or software permanently unusable. Those statements describe Nintendo’s agreement terms and warnings; they do not establish that every user will experience those consequences.
Is every personal backup or mod covered by the same legal rule?
Nintendo’s guidance addresses piracy and circumvention broadly, but it does not resolve every jurisdiction’s copyright or anti-circumvention rules, or every possible personal-backup scenario. The agreement and FAQ are not a substitute for location-specific legal advice. If your question concerns a particular backup, modification, or legal dispute, consult authoritative guidance for your jurisdiction.

Where to get Switch games legitimately
Nintendo identifies the Nintendo eShop and its website as official channels for authentic game downloads. Use Nintendo-authorized storefronts and genuine game copies rather than unauthorized files or products that bypass console protections. When buying from another seller, verify that the specific seller and listing are legitimate.
