Yes, in general. A commercial game can ship after AI-assisted development if the studio can show human review and testing, establish rights to code and assets, comply with its engine and AI-tool contracts, and complete each store’s disclosure and content requirements. AI generation does not transfer responsibility away from the developer or guarantee copyright protection.
What “AI-generated code” changes—and what it does not
Using an assistant to draft a function, refactor a system, generate tests, or explain an error is not, by itself, a shipping prohibition. The decisive questions are whether the team understands and tests the resulting software, whether its dependencies and licenses are acceptable, whether the relevant contracts permit commercial use, and whether the game’s distribution platform requires disclosure of any player-facing AI content.

The legal and operational position is best understood as ordinary software accountability plus an additional provenance problem. A studio must be able to explain where code came from, what humans changed, which licenses apply, and how the final build was validated. “The model wrote it” is not a defense to a security flaw, an infringing dependency, a breach of confidentiality, or a store-policy violation.

The U.S. rule is about expressive human authorship
The U.S. Copyright Office’s Part 2 report, published January 29, 2025, states: “The outputs of generative AI can be protected by copyright only where a human author has determined sufficient expressive elements.” A prompt alone does not meet that threshold. Human-authored material, a creative arrangement of generated material, and meaningful human modification are examples of contributions that can support protection.

This matters for a game’s source code, dialogue, illustrations, music, animation, and other copyrightable components. A programmer who accepts an output unchanged may have a weak claim over that portion, while a team that designs the architecture, selects and arranges elements, rewrites substantial sections, and makes creative implementation decisions has stronger evidence of human authorship. Copyright analysis is fact-specific; the presence of AI in the workflow does not automatically invalidate the whole game.
Registration requires separating human and AI material
When registering a work, the Copyright Office says applicants should identify the human-authored contribution, exclude more-than-de-minimis AI material from the claim, and not list the AI system as an author or co-author. Keep a component-level record so the registration application can distinguish original human code, edits, level design, writing, art direction, and arrangement from material generated by a system.
The Office reported reviewing more than 10,000 responsive comments during its AI study in 2025. That figure describes the scale of the policy process, not a guarantee that any particular output is protected. For a commercial release, preserve the decisions and edits that show how humans shaped the final expression.

Developer accountability remains total
Review every accepted change
Microsoft’s guidance puts the responsibility plainly: “The code your AI agent generates is code you ship, and you are accountable for everything in your app regardless of how it was written.” Treat generated code as an untrusted contribution until a qualified developer has read it line by line, understood its assumptions, and accepted it into version control.

- Check data handling, permissions, serialization, networking, file access, and error paths instead of reviewing only the happy path.
- Look for hidden performance costs such as allocations in update loops, unbounded searches, blocking calls on the main thread, and excessive logging in production builds.
- Review security-sensitive code for injection, authentication, authorization, insecure deserialization, secret exposure, and unsafe download or mod-loading behavior.
- Confirm that generated API calls match the exact engine and package versions used by the build.
Test it as thoroughly as hand-written code
Run the same functional, security, performance, compatibility, and regression tests used for hand-written code. Add tests for edge cases suggested by the generated implementation, because an assistant may produce plausible code that fails on malformed input, unusual frame timing, save-file upgrades, disconnects, or platform-specific behavior. A reviewer should be able to reproduce the result from the committed source and build configuration.
License and provenance checks are still required
AI tools can produce code that resembles open-source code. Microsoft advises commercial developers to apply the same open-source license compliance checks used for any other third-party code. An assistant’s output is not automatically free of obligations merely because no repository was copied into the prompt.

Replace or rewrite code when its provenance, license, or security behavior cannot be established. Do not rely on a model’s assertion that an output is “original.” Use the same approval process required for code copied from a forum, contractor, or external repository.
Steam disclosure focuses on content players receive
Coding assistance is not the same as player-facing generation
Steamworks says that “Efficiency gains through the use of these tools is not the focus of this section.” In practice, using an AI assistant to improve development efficiency is distinct from shipping AI-generated content that players consume. The relevant content can include art, sound, narrative, and localization, not just code.

Pre-generated content
If AI-generated material is created before release and included in the game, describe it accurately in the Steam Content Survey. Steam reviews that material under the same promise that a game will not contain illegal or infringing content. A disclosure does not cure an infringement problem; it makes the content and its production method transparent for the store’s review.
Live-generated content
If the shipped game generates text, images, audio, or other material during play, disclose that use and explain the guardrails that prevent illegal output. Document moderation, filtering, reporting, logging, fallback behavior, and the human process for responding to harmful results. A live system needs controls that operate after launch, not only a one-time review of sample outputs.
Steam’s requirement is therefore not a blanket ban on AI-assisted code. It is a content and safety review of what reaches players. Complete the Content Survey accurately and recheck the current wording immediately before submission because platform policies can change.
Engine, assistant, and model contracts are separate gates
Store approval and copyright analysis do not answer whether a tool’s contract permits your use. Unity’s AI principles state that users own input and output data from Unity AI tools and describe tracking and auditing generated content for intellectual-property and commercial considerations. That statement applies to the specified Unity tools; other engines, assistants, model providers, asset services, contractors, and employment agreements may use different terms.

Read the terms for the exact plan and region in effect when each output was made. Keep a copy of those terms and record material changes; a provider can revise commercial, retention, or audit provisions after development begins.
A release workflow that makes the decision defensible
- Inventory AI involvement. List every AI-generated or AI-assisted code file, shader, build script, asset, text, sound, localization file, test, and build-time artifact. Mark whether the output ships to players or exists only in development.
- Record provenance. For each material item, capture the tool and model name, version, date, relevant prompt or task, raw output where practical, human edits, and reviewer. Store this alongside the commit or asset identifier.
- Establish human contribution. Note the architecture, implementation choices, selection, arrangement, rewriting, level direction, editing, and other decisions made by people. This record is useful for copyright registration and for answering a takedown notice.
- Review and test code. Have an accountable engineer inspect every accepted change. Run normal unit, integration, functional, security, performance, platform, save/load, and regression tests; add tests for failure modes introduced by the generated implementation.
- Generate the dependency inventory. Identify direct and transitive packages, compare their licenses with the game’s distribution model, and prepare required notices or source offers. Remove dependencies whose terms cannot be satisfied.
- Check all agreements. Review engine, assistant, model, asset, contractor, and employment contracts for commercial-use rights, ownership, indemnity, confidentiality, retention, and audit restrictions. Escalate unclear terms to qualified counsel.
- Prepare the rights file. Keep licenses, permissions, contributor assignments, model terms, notices, provenance logs, review approvals, and human-authorship notes in one controlled record. Include the build hash or release identifier that the records support.
- Complete platform disclosures. In Steam’s Content Survey, describe pre-generated player-facing AI content and any live generation. For live systems, document guardrails against illegal output, moderation paths, and what happens when generation fails.
- Recheck before release. Confirm current platform and vendor policies, regenerate the final dependency inventory, and ensure the shipped build matches the reviewed source and assets.
How to prove the game is safe to ship
Proof is usually a coherent record rather than a single certificate. A publisher, platform, investor, or lawyer should be able to trace a shipped component from its source and tool history through human review, license analysis, tests, and final packaging.
- Code record: version-control history, pull-request approvals, reviewer identity, test results, static-analysis output, and security findings.
- Asset record: creator or provider, tool and model version, source files, edit history, licenses, permissions, and any restrictions on commercial use.
- Dependency record: package versions, license texts, attribution notices, vulnerability status, and removal decisions.
- Platform record: completed Content Survey answers, descriptions of pre-generated or live content, moderation design, and correspondence about unusual cases.
- Copyright record: a clear separation of human-authored expression, AI material excluded from a claim, and the human modifications or arrangement that remain claimable.
When a component cannot be documented, the practical remedy is to replace or rewrite it before launch. Shipping first and trying to reconstruct provenance after a complaint is substantially harder.

The meaningful comparison is not “AI” versus “no AI” in the abstract. Evaluate each workflow against the controls that determine release risk.

A conventional workflow may have simpler provenance, while an AI-assisted workflow may reduce drafting time. That productivity benefit is valuable only if the added review, licensing, security, and recordkeeping work remains manageable for the studio’s size and release schedule.
Common failure modes and fixes
“The assistant said the code was original”
Problem: A model’s confidence is not evidence of provenance or non-infringement.
Fix: Run dependency and license checks, search for distinctive copied sequences where risk warrants it, document the review, and rewrite uncertain code.
“We disclosed AI, so all rights issues are solved”
Problem: A store disclosure does not grant copyright, a license, or permission to use someone else’s material.
Fix: Treat disclosure, rights clearance, and human-authorship analysis as separate gates.

Problem: Build scripts, shaders, localization files, dependencies, and generated assets can create the same legal or security exposure as gameplay code.
Fix: Inventory development and build-time artifacts as well as files visible to players.
“Live generation is just a content toggle”
Problem: A runtime model can produce illegal or harmful output after launch and may expose user data to a provider.
Fix: Add filtering, moderation, reporting, logging, rate limits, fallback content, and a response owner before enabling the feature.
“We will check terms after launch”
Problem: The applicable plan, engine version, or model contract may not permit the shipped use, and records may be unavailable later.
Fix: Save the terms and approvals when each output is created, then perform a final policy review against the release build.
Bottom-line decision
You can sell a game whose code was generated or assisted by AI. Ship only when humans can explain and test the code, the studio has cleared dependencies and tool contracts, the rights file distinguishes human and AI contributions, and the platform disclosures accurately describe any AI content players receive. If any of those records is missing, rewriting or replacing the affected component is safer than treating AI assistance as a waiver of ordinary development obligations.
