Can You Use a Musician’s Face or Voice in an AI Video? Copyright and Publicity Rights Explained

By VGSources Team 9 min read

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For a commercial AI video, get written permission before using a recognizable musician’s face, cloned voice, name, or other likeness. Then clear every separate copyrighted work you include, such as a song, lyrics, sound recording, photograph, music-video clip, or artwork. Permission from the performer does not automatically cover a record label, music publisher, photographer, or estate.

These are separate legal layers. Copyright governs protected creative works; publicity and personality rights govern commercial use of someone’s identity; false-endorsement, contract, privacy, and platform rules may add further restrictions. Because the United States has no single federal law that resolves every AI face-or-voice scenario, the state connected to the creator, musician, audience, or distribution can change the analysis.

The two questions you must answer first

Before publishing an AI-generated music video, advertisement, game trailer, or social post, ask two different questions:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Does the video copy or adapt a protected work? A song, lyrics, master recording, photograph, or music-video footage can implicate the copyright owner’s exclusive rights under 17 U.S.C. §106, including reproduction, derivative works, distribution, public performance, and public display.
  2. Does the video use a person’s identity? A realistic synthetic face, voice, name, or combination that makes viewers reasonably recognize a musician can trigger publicity-rights, false-endorsement, or related claims even when every pixel and audio sample was generated by software.

Passing one test does not pass the other. A newly generated backing track may avoid copying a particular master recording while still using a recognizable singer’s cloned voice. Conversely, a licensed performer’s likeness may be used with permission while an uncleared photograph or song remains infringing.

When a synthetic musician is legally “recognizable”

Courts and lawmakers focus on what an ordinary viewer or listener would understand, not on whether the file was made with a camera or microphone. If the character’s face, vocal timbre, stage name, signature look, biography, or combination of cues points to a real musician, treat the use as permission-sensitive.

Face and visual likeness

A generated portrait can raise risk when it reproduces a distinctive face, hairstyle, tattoos, stage costume, signature pose, or a recognizable concert setting associated with one person. Changing the performer’s clothing or placing the face in a fictional venue does not automatically remove the identity issue.

Voice and vocal identity

A voice clone can be risky even when it says newly written words. A singer’s identity may be recognizable from timbre, phrasing, accent, vocal fry, ad-libs, or a characteristic performance style. Tennessee’s ELVIS Act, signed on March 21, 2024, specifically adds voice protection to that state’s personal-rights framework and targets unauthorized AI misuse of musicians’ voices and likenesses.

Name, persona, and implied participation

Using a musician’s name in a title, prompt, caption, metadata, or dialogue can suggest that the person participated in or approved the project. The risk increases when the video places the musician beside a product, sponsor, game, political message, or paid call to action.

Copyright: what the video may copy

Copyright protects original works, not a person’s identity by itself. Under 17 U.S.C. §106, owners control reproduction, preparation of derivative works, distribution, public performance, and public display. An AI video can implicate those rights at several points:

  • Composition: melody, harmony, lyrics, and musical arrangement are commonly controlled by a songwriter or music publisher.
  • Sound recording: a particular recorded performance, often called the master, may belong to a label or another rights holder.
  • Photograph or artwork: a press photo, album cover, poster, or fan image can have a separate photographer or artist as copyright owner.
  • Music-video footage: clips, choreography captured on video, and production design may be owned by a production company, label, or other party.
  • New derivative output: editing, transforming, or combining protected material can still implicate the owner’s derivative-work right.

Generating an image or song from scratch does not grant permission to use training references, prompts, or recognizable identity cues. It also does not transfer rights in material you upload. Review the ownership and license terms for every input and output before release.

Copyright and publicity rights are different layers

Layer What it protects Typical AI-video trigger Who may control it
Copyright Original expression in music, recordings, photos, video, artwork, and other works Copying a chorus, lyrics, master recording, photograph, or music-video clip Songwriter, publisher, label, photographer, filmmaker, or other copyright owner
Publicity or personality rights Commercial exploitation of an identifiable person’s name, voice, face, photograph, or likeness A realistic voice clone or face used in an advertisement or monetized post The individual, estate, or an authorized rights holder under applicable state law
False endorsement Consumer confusion about sponsorship, approval, or participation A musician appears to promote a game, product, charity, or political message without approval The affected person and, in some cases, businesses under applicable law
Contract Promises and restrictions in agreements, talent deals, label contracts, or platform terms Using a licensed image or voice outside the agreed media, territory, term, or purpose The contracting parties and their successors

A release must address these layers separately. A performer’s consent to an AI likeness does not automatically license a photograph, a song, a master recording, or a label-owned music video.

What written permission should cover

  • Commercial scope: sponsorship, product placement, affiliate or paid promotion, monetization, and whether the use implies endorsement.
  • Creative controls: script, lyrics, visual treatment, prohibited subjects, approval checkpoints, and limits on edits or future model training.
  • Takedown and misuse procedures: how either party can demand removal, correct an unauthorized version, or respond to impersonation.
  • Chain of title: evidence that the signer has authority to grant the rights, including estate or management authority where relevant.

For a high-value release, have an attorney in the relevant jurisdiction review the agreement. A model release, producer agreement, or general appearance consent may not mention synthetic replicas and may be too narrow.

Commercial use carries the highest practical risk

Advertising, sponsorship, product placement, paid endorsements, and monetized posts make it easier to argue that the musician’s identity was used to sell something. A disclaimer does not automatically cure an unauthorized commercial use, especially if the visual or vocal performance is designed to look like an endorsement.

Planned use Risk indicators Safer approach
Product or game advertisement Call to action, logo, paid placement, or a statement that appears to come from the musician Obtain a specific endorsement and AI-replica license; identify all media and territories
Monetized music video Recognizable singer plus advertising revenue or sponsorship License the likeness and clear composition, lyrics, master, photos, and footage separately
News or documentary Use connected to a genuine report or historical explanation Keep the depiction relevant, accurate, and no more extensive than needed; avoid implying approval
Criticism or commentary Purpose is discussion, review, or analysis rather than promotion Use only what supports the point and label synthetic elements clearly where appropriate
Parody or satire Audience understands the work as commentary rather than a real endorsement Preserve the transformative joke or criticism; avoid copying unnecessary music or footage

These categories are risk indicators, not automatic exemptions. A news label does not legalize a commercial ad, and calling an ad “parody” does not eliminate confusion or publicity claims.

Fair use is not an automatic defense

Fair use is a fact-specific analysis that weighs purpose and character, the nature of the original work, the amount used, and the effect on the market. An AI parody of a singer may have a stronger transformative argument than a straight promotional imitation, but the result depends on the details.

Copying a recognizable hook, lyrics, master recording, or music-video sequence can weigh against fair use, particularly when the new video competes with the original or uses the material to sell a product. A parody that comments on the musician or the original song is different from an imitation that merely borrows fame to attract clicks. Publicity-rights and false-endorsement claims can remain even when a copyright fair-use argument exists.

State laws can change the answer

Tennessee

The ELVIS Act was signed on March 21, 2024. It adds voice protection to Tennessee’s personal-rights framework and addresses unauthorized AI misuse of musicians’ voices and likenesses. A project connected to Tennessee should be reviewed under the statute’s current text and remedies.

New York

New York Civil Rights Law §50-F defines and regulates highly realistic computer-generated digital replicas. The statute is part of New York’s specific framework for digital-replica uses, so the facts, purpose, and parties’ connections to New York matter.

California

The Copyright Office identifies California Civil Code §3344 as protecting a person’s name, voice, signature, photograph, or likeness in the circumstances covered by that law. California also has additional common-law and unfair-competition theories that may be relevant to endorsement confusion.

No nationwide rule yet

The U.S. Copyright Office’s Part 1 report, released July 31, 2024, says digitally created or manipulated video, images, and audio can falsely depict an individual. The Office recommended that Congress create a federal right protecting all individuals during their lifetimes from the knowing distribution of unauthorized digital replicas, with licensing, remedies, and First Amendment safeguards. That recommendation is policy guidance, not an enacted nationwide statute.

A practical clearance workflow

  1. Describe the planned depiction. List whether the video uses a face, voice, name, signature look, or all of them. Note whether a reasonable viewer could identify the musician.
  2. Inventory every input. Record prompts, reference images, audio samples, lyrics, songs, photographs, footage, logos, and third-party performances.
  3. Separate the rights owners. Identify the performer, songwriter or publisher, master owner, photographer, filmmaker, estate, manager, and any other licensor.
  4. Choose the legal purpose. Mark the project as advertising, sponsorship, monetized entertainment, news, documentary, criticism, parody, or another purpose. Do not rely on a label alone; describe the actual distribution.
  5. Obtain written licenses. Make the permission explicit about AI or synthetic use, media, territory, term, paid promotion, approval, edits, takedown, and endorsement.
  6. Check jurisdiction. Review the laws connected to the creator, musician, audience, production, and distribution. State statutes and common-law claims can overlap.
  7. Build disclosures. Follow the platform’s synthetic-media, impersonation, advertising, and takedown rules. Disclose synthetic content when platform rules or applicable law require it.
  8. Preserve records. Keep signed agreements, invoices, source files, model settings, approval messages, licenses, and a chain-of-title log.
  9. Run a final confusion check. Ask whether a reasonable viewer could believe the musician participated in, approved, or endorsed the project. Remove or revise that implication if the license does not cover it.

Common mistakes and how to correct them

  • “I made it myself, so I own everything.” Creation of the file does not erase copyright in copied inputs or publicity rights in a recognizable person. Rebuild the asset with cleared materials and permission.
  • “The voice is not an exact copy.” Recognition can come from several vocal traits together. Obtain a voice license or use a voice that is not intended to evoke a specific musician.
  • “The musician said yes in a message.” An informal approval may not define media, territory, term, paid promotion, edits, or AI methods. Replace it with a signed agreement.
  • “A disclaimer makes it legal.” A caption saying “not affiliated” may reduce confusion but does not automatically cure unauthorized identity or copyright use. Fix the underlying rights problem.
  • “Fair use covers any parody.” Parody, criticism, and news can still require a fact-specific analysis, and publicity or endorsement claims may remain. Limit copying to what the commentary needs.
  • “One license covers the whole song.” Composition, lyrics, master recording, photograph, and video rights can belong to different parties. Clear each work and layer.

What current federal developments mean for creators

The Copyright Office reported receiving more than 10,000 comments in its AI inquiry by December 2023. It released Part 1 on digital replicas on July 31, 2024; Part 2 on copyrightability of generative-AI outputs on January 29, 2025; and Part 3 on generative-AI training in pre-publication form on May 9, 2025. These reports help explain policy direction, but they do not replace state law or create a general federal permission system for using a musician’s face or voice.

The Office’s 2024 release stated: “Given the gaps in existing legal protections, the Office recommends that Congress enact a new federal law that protects all individuals from the knowing distribution of unauthorized digital replicas.” Tennessee Governor Bill Lee said when discussing the state law: “Artists have intellectual property. They have gifts. They have a uniqueness that is theirs and theirs alone, certainly not artificial intelligence.” Those statements describe policy and legislative goals, not a blanket rule that every AI depiction is unlawful.

Bottom-line decision rule

If viewers can reasonably recognize the musician, assume the face or voice requires permission unless a lawyer has analyzed a specific news, criticism, documentary, or parody use. Get a written license that expressly covers the identity and synthetic techniques, clear every underlying copyrighted work separately, avoid any unlicensed suggestion of endorsement, follow platform disclosure and takedown rules, and obtain jurisdiction-specific advice before a high-value release.
