Contest eligibility and copyright are separate questions. An organizer may prohibit any generative-AI use even when your human edits could support copyright protection. Before entering, read the rules for that contest edition, identify what it calls “AI assistance” or “generative AI,” and follow its disclosure and licensing requirements.
Contest rules come before copyright law
A game jam, art competition, or festival can set participation conditions that are stricter than copyright law. If the rules ban generative AI, using an image generator for a background, character concept, texture, interface element, or other project asset can make your entry ineligible, regardless of whether you later add substantial human work.

The official Just Play Game Jam rules illustrate the point. They require entrants to represent that “no generative AI was used by you or your team in the creation of your project.” That is an eligibility condition, not a ruling on whether any resulting image would qualify for copyright.
Rules can also distinguish between final assets and limited assistance. One contest might permit AI for brainstorming or temporary reference images but prohibit generated material in the submitted build. Another might allow generated assets if they are disclosed, while requiring proof that you have the necessary commercial rights. Treat the current edition’s wording as controlling; an older FAQ, social-media post, or rule set from a previous year may not apply.

What to check in a contest’s current rules
Search the complete rules, submission form, technical specification, code of conduct, and intellectual-property section for the terms below. Definitions often appear in one document while the penalty or disclosure procedure appears in another.
- Scope: Does “AI” mean any machine-learning tool, or specifically “generative AI”? Does it cover image, text, audio, code, upscaling, animation, and editing tools?
- Permitted uses: Are brainstorming, mood boards, placeholder assets, background removal, inpainting, upscaling, or grammar correction allowed? Are they allowed only if the material is not shipped?
- Final-asset rule: Must every visible, audible, or playable element be made by a human, or may generated material appear after disclosure?
- Team responsibility: Does the entrant have to certify that no teammate, contractor, or asset provider used a prohibited tool?
- Disclosure: Where must use be declared, and by what deadline? A text field, checklist, asset manifest, or process log may be required.
- Evidence: Can the organizer request prompts, source files, layer history, licenses, or a description of human edits?
- Ownership and promotion: Who receives rights to the entry, and may the organizer display, modify, or promote it?
- Governing law: Which country, state, or forum controls disputes?
If a rule is ambiguous, ask the organizer in writing before the deadline. Keep the reply with your project records. A verbal answer from a volunteer or an informal chat message may not protect you if the published rules say something different.
What counts as AI assistance versus AI-generated art?
There is no universal legal or contest definition. The practical distinction is how much of the final expressive material came from the tool and what the organizer’s rule says.

Commonly treated as assistance
Examples can include generating rough ideas that are discarded, using a tool to brainstorm color palettes or names, removing a background from your own photograph, enlarging a human-painted image, or using an automated filter while you retain the underlying artwork. These uses are not automatically permitted; a contest may define any generative step as prohibited.

Commonly treated as generated material
An image produced from a prompt and placed in the game with only cropping, resizing, or minor color adjustments is likely to be viewed as AI-generated art. The same is true of a generated character, tile set, texture, logo, animation frame, soundtrack, voice line, or promotional image that remains recognizable in the final submission.
Mixed or heavily edited work
A generated base that you substantially repaint, redraw, combine with your own elements, and arrange into a new composition may contain both generated and human-authored material. That can matter for copyright analysis, but it does not automatically satisfy a contest’s “no generative AI” rule. If the rule prohibits use during creation, later paint-over does not cure the eligibility problem.
When the text is unclear, describe the exact workflow to the organizer: the tool, what it produced, what remained in the final build, and the human changes. Ask whether that workflow is allowed, and save the response.

If AI use is allowed, disclose it in the form and at the time the organizer specifies. Do not assume that a later copyright application, credits page, or readme file replaces a contest disclosure.

Information a useful disclosure contains
- The tool and model or service used, including the version or plan when known.
- The date range of use and the team member who used it.
- What was generated: for example, a concept sketch, a background layer, or a final texture.
- Whether the material appears in the submitted game, trailer, screenshots, or promotional art.
- The human work performed afterward, such as drawing, compositing, repainting, animation, or layout.
- Licenses or terms that governed the tool and any source images at the time of creation.
Use the organizer’s requested format even if it asks for less detail. If there is no field, place a concise statement in the submission notes and ask whether a separate asset list is preferred. Keep a fuller internal record in case the organizer follows up.
How U.S. copyright treats AI-assisted game art
The U.S. Copyright Office’s Part 2 report, issued January 29, 2025, states that “the use of AI to assist in the process of creation or the inclusion of AI-generated material in a larger human-generated work does not bar copyrightability.” The key question is the human author’s contribution: which expressive elements did a person determine, create, select, arrange, or modify?
The Office explains that human-authored material perceptible in the output, along with sufficiently creative arrangement or modification, can qualify for protection. Merely entering prompts does not, by itself, supply enough human authorship. A prompt may communicate an idea or instruction without determining the detailed expressive elements that appear in the output.
This is an analysis of protectable human expression, not a guarantee that an entire image, game, or asset is protected. An image may contain protected human portions and unprotected generated portions. The scope depends on the actual file, the creative decisions, and the evidence showing how it was made.

Copyright registration and the duty to disclose AI material
The Copyright Office’s March 16, 2023 guidance says applicants have a duty to disclose AI-generated content in works submitted for registration. If an application omits that information, the public record may need to be corrected. Disclosure to a contest and disclosure in a copyright registration are separate obligations with different forms and timing.
If you later register a game, artwork, soundtrack, or audiovisual work that includes generated material, identify the AI portions and describe the human-authored material you are claiming. Keep the prompts, source images, intermediate files, layer history, and edit notes that support that description. Do not claim authorship over generated elements merely because you selected a prompt or paid for the service.
Which parts of a game can be protected?
Section 102 of Title 17 protects original works fixed in a tangible medium, including pictorial, graphic, sculptural, and audiovisual works. It excludes ideas, procedures, processes, systems, and methods of operation. The Copyright Office Compendium applies those principles to games.

Copyrightability is not the same as ownership under a contest contract, a tool’s license, or a third-party asset license. A contest can require you to grant promotional rights, and a tool’s terms can impose conditions that affect commercial use. Review each agreement independently.

A practical submission workflow
- Read the exact edition. Download or save the current rules and every linked policy. Note the contest dates, jurisdiction, definitions, and penalties.
- Inventory your tools. List image, text, audio, code, upscaling, editing, and asset-library tools used by every team member. Mark whether each output reached the final build or promotional materials.
- Classify each asset. Separate human-created layers, generated material, licensed third-party content, and temporary references. Record filenames and where each item appears.
- Capture process evidence. Save prompts, source images, dates, model or service information, exported files, layered originals, and notes describing substantial human edits or paint-overs.
- Check licenses and terms. Review the commercial-use, attribution, training-data, content-ownership, and redistribution terms in force when each asset was created. Retain copies rather than relying on a web page that may later change.
- Ask before submitting if uncertain. Send the organizer a factual workflow description and request a written ruling. Do not infer permission from silence.
- Make the required disclosure. Use the contest’s field or asset manifest. State what was generated, what was human-made, and whether any generated material remains in the entry.
- Recheck the final package. Inspect the game, trailer, screenshots, store page, and credits. A prohibited generated image in promotional material can still conflict with a rule covering the “project.”
What happens if the rules ban generative AI?
Do not submit AI-generated or AI-assisted art unless the organizer gives written clarification that your specific workflow is allowed. Replacing a generated asset at the last minute can create new licensing and attribution problems, so maintain human-made alternatives for critical elements when the rule is strict.
If you discover a teammate used a prohibited tool, pause submission and determine exactly what was created, where it appears, and whether the organizer permits replacement or withdrawal. Do not conceal the use. A false certification can create a separate rule violation even if the asset itself is later removed.
How to compare different contests
Use the same questions for every event rather than assuming that “AI-friendly” or “AI-free” labels mean the same thing.

Questions the U.S. guidance does not answer
The cited federal guidance does not create a universal rule for every country, platform, or contest edition. Other jurisdictions may apply different tests to human authorship, registration, moral rights, training data, or contractual ownership. The one contest example above cannot be generalized to all game jams.
Nor does copyright guidance decide whether a particular tool’s output is licensed for your intended use, whether an image resembles another person’s protected work, or whether a contest’s contract gives the organizer rights you did not expect. Those questions require the applicable terms and, for high-stakes commercial releases, advice from a qualified lawyer in the relevant jurisdiction.
Why careful records matter
The U.S. Copyright Office received more than 10,000 public comments by December 2023 during its notice-of-inquiry process on artificial intelligence. That volume reflects how quickly policy and practice are developing, not a single settled rule for every creative workflow. A dated record of your tools, edits, licenses, and disclosures lets you answer an organizer’s question accurately and describe your human contribution if you later seek registration or license the game.
