Buying a digital game usually gives you a license to use it, not ownership of the game’s copyright or a freely transferable copy. Whether you can keep playing depends on the store account, the platform’s download service, digital-rights management (DRM), the game’s servers, your hardware and the contract that applies in your country. A physical disc or cartridge can reduce some of those dependencies, but it is not an automatic promise of permanent playability.
That is why “buy” on a storefront is not the same as “keep forever.” The practical question is not only who holds the files, but whether the particular game can still be downloaded, activated and run when a store, publisher service or console generation changes.

What “buying” a digital game usually gives you
A storefront button labelled Buy does not, by itself, establish copyright ownership, transfer rights or an indefinite service commitment. In many digital stores, the transaction grants a personal license to access software under platform and publisher terms. You normally do not acquire the game’s underlying intellectual property, and the license may restrict copying, resale, transfer between accounts or use on unapproved devices.

It’s yours.” The agency’s 18 April 2024 consumer guidance immediately qualifies the digital side: “Another reason why you might not have full control of your digital product is that what you really got when you clicked ‘buy’ is often merely a license to access the content.” Those are consumer explanations, not a ruling on every store contract or dispute. Sony’s US PlayStation software terms express the contractual model directly: “The Software is licensed to you, not sold.” They describe a limited, non-exclusive, non-transferable, personal license for private, non-commercial use on the intended system or device. That wording applies to the covered software and territory; it is not a universal rule for every game or country. PlayStation Software EULA (US)
A license can still give you substantial, long-term use. “Licensed” does not automatically mean “temporary” or “worthless.” It means the scope and duration of your use come from the applicable terms and law rather than from possession of an unrestricted copy.
Why digital access can stop working
Several independent dependencies can sit between payment and playable software. Losing one does not always produce the same result: a title might remain playable offline after delisting, while another may fail at launch when its authentication server disappears.
Your account and the storefront
Digital purchases are commonly attached to a user account. You may need that account to redownload the game, restore licenses, install it on a new console or verify ownership after a factory reset. Account closure, suspension, loss of credentials or a store that no longer provides downloads can therefore matter even when you paid once.
The FTC warns that digital access may depend on an active account or on the platform remaining in business. It also notes that a seller’s own licensing problems can affect a buyer’s access. This guidance describes risks for consumers; it does not decide the outcome under a particular platform contract. FTC consumer guidance

DRM and activation checks
DRM can limit how, where and how many times software runs. A game may check a platform account, a launcher, a hardware entitlement or an online activation service. Some checks occur only at installation; others recur at launch or after a period offline. If the required service is retired, the publisher must provide a replacement or remove the check for the game to remain usable.
Publisher servers and online-only design
Multiplayer, cloud saves, leaderboards, live events and some single-player campaigns can rely on publisher servers. A server shutdown may remove only online features, or it may make the entire title unplayable. The result depends on whether an offline mode exists, whether it is complete and whether the game requires a server handshake before showing its main menu.

A disc or digital entitlement may not contain the whole playable build. Large patches, language packs, texture data or a day-one update can be required. Future consoles may not support the old operating system, accessories or backward-compatibility layer. A license can remain on your account while the software no longer runs on the hardware you have.
Subscriptions are a separate category
Games accessed through a subscription are normally licensed for the subscription term, not purchased as permanent entitlements. Nintendo’s US purchase terms, for example, state that some software and digital content are licensed rather than sold and that subscription features are licensed for the subscription period. The terms also describe account ties, territory limits, device restrictions and possible deletion of subscription-associated data after expiration or termination. These provisions are specific to the covered Nintendo terms and region, not every Nintendo product or another platform. Nintendo Purchase and Subscription Terms

- What did you acquire? Usually a personal right to use software under stated terms, rather than copyright ownership or a transferable master copy.
- Can you obtain the files? That depends on the account, the storefront’s redownload service, device support and any required activation.
- Will the game run? That depends on DRM, updates, hardware compatibility and online services, even if the files are already installed.
Checking only the second question—whether the game appears in your library—does not answer the third. An installed title can fail an online authentication check; a downloaded title can lose multiplayer while its offline campaign remains functional.

Delisted is not the same as deleted
Delisting means a game is removed from sale or distribution through a storefront. Loss of access means an existing purchaser can no longer download, activate or use it. The first does not automatically prove the second, and it does not establish a perpetual redownload right.
After a delisting, existing access can follow several patterns:
- Existing buyers can redownload and play, perhaps indefinitely, while new purchases are blocked.
- Redownload remains available only while the account and platform service continue.
- The game downloads but requires a license check or server that has been retired.
- Online modes end while an offline or local mode continues.
- The platform removes the title from libraries or stops supporting the hardware, ending practical access.
There is no universal rule covering every store, game, territory or purchase. Check the store’s current terms, the game’s support notices and the title’s technical requirements before assuming that a delisted game is safe—or lost.
What physical discs and cartridges really change
Physical media gives you a copy held in your possession, which can reduce dependence on a storefront account and future redownloads. It does not transfer copyright in the game, and it does not guarantee that every feature will work forever.

Sony’s US terms provide a narrow practical example: if a PlayStation device is suspended, disc games that run on the console can still be played when they do not need to connect to PlayStation services. The condition—does not need to connect—is the important part. It is not a promise that every disc is complete, offline-capable or compatible with future hardware. PlayStation Terms of Service (US)
Verify a physical edition before relying on it
- Playable data: Does the disc or cartridge contain a usable build, or is it primarily an installation key?
- Mandatory downloads: Is a patch, content package or language file required before the game starts?
- Activation: Does first launch require an account, code redemption or online check?
- Offline mode: Can the campaign or local modes run after disconnecting from the internet?
- Server dependence: Which modes, progression systems or features stop when publisher servers close?
- Hardware: Will the intended console, disc drive and backward-compatibility system still support this edition?
- Edition differences: Are you buying a standard disc, a code-in-box package or an edition whose extras are download-only?
A physical copy therefore changes the risk profile; it does not create a “forever-proof” format.
Digital versus physical: a decision table
| Question | Digital purchase | Physical copy |
|---|---|---|
| What you receive | Usually a personal software license tied to an account and platform terms. | A disc or cartridge containing some or all game data, plus the license to use the software. |
| Redownload dependence | Often high: replacement downloads come from the storefront. | Lower for data on the media, but patches, missing content or a damaged disc can still require downloads. |
| Account or activation | May be required for download, installation or launch. | May still be required for activation, updates, codes or online features. |
| Offline play | Depends on DRM, license checks and the game’s design. | Depends on whether the disc build is complete and the title runs without servers. |
| Resale or transfer | Often restricted by non-transferable account licenses. | The object can usually be handed to another person, but the software license, codes and online account benefits may not transfer. |
| Future hardware | Depends on platform support, backward compatibility and account access. | Depends on a working compatible drive, console support and the disc’s format. |
| Server shutdown | Can remove online or even all functionality. | Can remove online or even all functionality; the disc alone does not prevent that. |
How platform terms illustrate the difference
PlayStation software terms
The US PlayStation Software EULA says software is licensed, not sold, and characterizes the license as limited, personal and non-transferable. It also says Sony may stop supporting or discontinue software and terminate online services; that can mean loss of access to gameplay, progression or virtual content. The terms preserve applicable local-law consumer rights, including rights for residents in the EMEA region. Read the terms that apply to your country and the specific software. PlayStation Software EULA (US)
Nintendo purchase and subscription terms
Nintendo’s US terms describe licensed digital content, account and territory ties, restrictions across devices and subscription features that last only for the subscription term. They also address possible deletion of data associated with a subscription after expiration or termination. These clauses show why “I paid once” and “I can use every feature indefinitely” are not interchangeable propositions. Nintendo Purchase and Subscription Terms
Neither set of terms is a universal statement of law. Platform contracts, publisher terms, local consumer law and the game’s implementation all matter.

What a server shutdown can do
When a publisher retires servers, identify the affected function rather than treating “the game is shut down” as a single outcome:
- Online-only game: The title may become entirely unplayable because no local session exists.
- Online campaign or authentication: A nominally single-player game may fail to launch or load saves if it requires a server handshake.
- Multiplayer-only feature: The campaign, local multiplayer or practice mode may continue while matchmaking disappears.
- Cloud-dependent progression: Saves, inventories, user-created content or virtual items may be inaccessible even when the executable starts.
- Replacement service: A publisher may provide a patch or offline mode, but there is no general guarantee that it will.
Before purchase, look for an explicit offline mode and test whether it works with the console disconnected. For a game you already own, download updates while they remain available, back up permitted saves and record which features require a server. Those precautions cannot defeat an account termination or a hardware incompatibility, but they can preserve local play when the title supports it.
What consumer law may provide
United States
The FTC guidance is educational rather than a determination of a particular dispute. It warns that account status, platform continuity, DRM and the seller’s own content rights can affect access. The remedy available to an individual buyer depends on the contract, the facts and applicable state or federal law; the guidance does not announce a blanket US right to perpetual playability. FTC consumer guidance
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsEuropean Union
On 17 June 2026, the European Commission said modern games often rely on publisher servers and can become partly or wholly unplayable when support stops. Its current position is explicit: “The Commission considers that at this stage it cannot propose a legal obligation to keep video games playable after they stop being provided commercially.” That is an EU-level policy statement, not a decision on an individual claim. European Commission announcement, 17 June 2026
The Commission also says EU providers must inform consumers before signup about duration and termination conditions. Under the EU digital-content and digital-services rules, consumers can have remedies when supplied content or a service fails to conform to the contract or reasonable expectations; depending on the circumstances, those remedies can include bringing it into conformity, a proportionate price reduction or ending the contract. The Commission’s answer to a 2024 parliamentary question provides background on those Directive 2019/770 remedies. It does not create a universal promise that every delisted or server-dependent game must remain playable. European Commission answer (2024)
Consumer rights vary by country, transaction date, edition and contract. Treat US and EU explanations as separate frameworks, not interchangeable advice, and consult the law that applies where you bought the game.
A practical check before you buy
- Read the purchase and software terms. Search for license duration, account requirements, transfer restrictions, termination language and service-discontinuation clauses.
- Identify the exact edition and territory. Standard, deluxe, code-in-box and subscription versions can have different dependencies. Regional terms can differ.
- Check the store’s redownload policy. Confirm how you would reinstall after a console replacement, delisting or account migration.
- Check offline requirements. Look for an offline mode and determine whether first launch, saves or progression require authentication.
- Separate local and online features. List the modes you care about and note which rely on publisher servers.
- For physical media, inspect the contents. Determine whether the disc or cartridge is playable without a patch, code or substantial download.
- Check hardware support. Verify the console generation, drive, backward compatibility and any required peripherals.
- Decide what risk you accept. Digital convenience may be worth account and service dependence; physical media may be preferable when local, offline play matters most.
If a game is delisted or access fails
You bought it but cannot find it
- Sign in to the original purchasing account, not a family member’s or secondary account.
- Check the platform’s purchase history and library filters, then use its restore-license or restore-purchases function if available.
- Confirm that the console region and account territory match the purchase.
- Look for a publisher or platform notice explaining a delisting, migration or service retirement.
The game downloads but will not launch
- Test the console offline to distinguish a server or authentication failure from a damaged installation.
- Install any still-available update and verify available storage.
- Check whether the title requires a launcher, redeemed code or account different from the store account.
- For a physical copy, inspect the disc, drive and required installation data; do not assume the disc contains the complete game.
Only online features have stopped
Determine whether local campaign, split-screen or practice modes remain supported. Preserve local saves and document which purchased features are unavailable before contacting the platform or publisher. A service shutdown may affect only part of the product, but the license terms and local law determine whether any remedy is available.

The bottom line for “keep forever”
You can often keep using a digital game for many years, but “forever” is not a safe assumption. A digital purchase generally gives a conditional, account-bound license; continued play also depends on downloads, DRM, hardware compatibility and server operation. A disc or cartridge can preserve a local copy and reduce storefront dependence, yet it may still need updates, activation or online services. The only reliable answer is title-specific: read the applicable terms and verify exactly what runs offline on the hardware you intend to keep.
