The Entertainment Software Association (ESA) has reportedly asked the U.S. Trade Representative (USTR) to consider Anbernic for its 2026 Notorious Markets List, alleging that some retro handheld offerings include memory cards loaded with unauthorized games. That is an industry group’s recommendation—not a government finding, a confirmed listing, or a U.S. sales ban. The available sources do not establish that USTR has made a final decision.
What did the ESA ask USTR to do?
In reporting published October 13, 2026, Video Games Chronicle (VGC) said the ESA submitted recommendations for USTR’s 2026 Notorious Markets review and named Anbernic, a maker of retro handheld gaming consoles. The reported concern is that Anbernic devices are routinely offered or shipped with removable memory cards containing unauthorized copies of games published by ESA members. What does “superfake” mean in this dispute?
“Superfake” is the ESA’s analogy for a consumer-ready handheld that looks like an ordinary, polished retail product but, the association argues, derives its commercial appeal from a game library distributed without authorization. VGC quoted the ESA submission: “In the video game sector, illicit plug-and-play consoles and handheld devices are the functional equivalent of superfakes.”

The ESA also described the alleged configuration as having a “concealed memory card or internal drive loaded with hundreds, thousands, or even tens of thousands of unauthorized copies of copyright-protected games.” Those quantities are the association’s characterization, not an independently verified count or estimate of prevalence. “Superfake” is advocacy language in this submission, not a formal legal classification made by USTR.
Is Anbernic banned in the United States?
No U.S. ban is established by the available reporting. The sources describe an ESA recommendation for USTR to consider; they do not show that USTR accepted it, added Anbernic to a final list, prohibited imports, or ordered marketplaces to remove listings. The current USTR decision was not verified in the sources reviewed, so the nomination should not be treated as an enacted restriction or a prediction of one.

USTR’s Notorious Markets List is an annual report intended to raise awareness of reported online and physical markets and help governments and market operators prioritize enforcement. In its March 3, 2026 release, USTR said the list is not exhaustive and “does not constitute” findings of legal violations. The reporting does not establish that emulation hardware alone is unlawful, that every Anbernic model ships with games, or that every seller’s listing contains unauthorized files. The allegation concerns game files said to be bundled on memory cards or internal storage, and potentially related branding—not a model-by-model finding about the hardware.

An emulator is software that reproduces another system’s behavior; that is distinct from distributing copyrighted game files without authorization.
