The key differences are who brings the case, what must be proved, and what the court can order. Not every civil dispute belongs in federal court: federal courts can hear only cases within the jurisdiction granted by law and the Constitution.
How federal civil and criminal cases differ

The Administrative Office of the U.S. Courts describes a civil case as a legal dispute between two or more parties. In a criminal case, only the government initiates the prosecution. A person who believes a crime occurred can report it to authorities, but does not personally file federal criminal charges in district court. How each case starts
Civil lawsuit: complaint and service
A civil action begins when the plaintiff files a complaint and serves it on the defendant. The complaint generally explains the alleged injury or damages, how the defendant allegedly caused the harm, why the court has jurisdiction, and what relief the plaintiff wants. The court’s authority to hear the dispute must have a legal basis; the fact that a lawsuit is civil does not by itself make it a federal case. Criminal case: government prosecution
A federal criminal case is brought by the government, usually through a U.S. attorney’s office working with a law enforcement agency. A grand jury may review evidence presented by the prosecutor and decide whether there is sufficient basis to require the defendant to stand trial. At arraignment, the defendant enters a plea. A guilty plea can lead to sentencing; a not-guilty plea moves the case toward trial. The precise path depends on the case and applicable law.

Different proof burdens—and no duty to prove innocence
In a civil trial, the plaintiff generally has to prove the claim by a preponderance of the evidence, meaning the claim is more likely than not true. It is a comparative standard, not an official percentage assigned to the evidence.
In a criminal trial, the government must prove every element of the charged crime beyond a reasonable doubt. The defendant does not have to prove innocence. These standards are not interchangeable: a fact-finder can conclude that a civil claim is more likely than not while still finding that guilt has not been proved beyond a reasonable doubt.

What the court can decide or order
Possible civil relief
If the plaintiff proves the claim, a court may award money damages, issue an injunction ordering someone to do or stop doing something, declare the parties’ legal rights, or grant another form of relief allowed by law. The result addresses the civil claim; it is not a criminal sentence.
Possible criminal outcomes
A criminal defendant may be acquitted or convicted. A conviction can lead to a sentence that includes imprisonment, a fine, restitution to victims, or conditions of supervision. Restitution may require payment, but it is part of a criminal sentence rather than the same thing as a civil damages award.

Juries, judges, discovery, and rules
Either kind of federal case can be decided by a petit jury when a jury trial applies; a civil case may also be tried to a judge without a jury. The judge explains the law, and the fact-finder applies it to the evidence. Federal petit juries comprise 6–12 people, according to the U.S. Courts’ Types of Juries page.
Civil cases may include discovery, when parties exchange information relevant to the dispute. Criminal discovery is more limited and is subject to rules that can protect informants and witnesses. The procedural rulebooks are separate: the Civil Rules page reports amendments through 2025, while the Criminal Rules page reports amendments through 2023. For an active case, consult the current rules and any rules specific to the claim or proceeding.

Can the same conduct lead to both kinds of case?
Potentially. The same conduct may be the subject of a civil claim and a separate criminal prosecution, because the cases serve different purposes and use different procedures and proof standards. Whether either or both proceedings occur depends on the facts and applicable law; one does not automatically follow from the other.
Which distinction matters most?
For a person facing a dispute, the first practical question is who is bringing the case and what document or charge initiated it. A complaint signals a civil action seeking relief; a federal criminal charge is brought by the government and can expose a defendant to criminal sentencing. The case caption and filing documents can help identify the type, but jurisdiction and procedure are case-specific.
