Fortnite is already available on the U.S. App Store. Apple approved the game on May 20, 2025, after a judge found that Apple had willfully violated an injunction in its legal fight with Epic Games and threatened further enforcement action. The current dispute is not mainly about whether Fortnite can return; it is about Apple’s App Store payment rules, developer commissions, contempt findings, and the remedies that may follow.
Can you download Fortnite from the U.S. App Store?
Yes. The U.S. App Store listing for Fortnite identifies the game as available to download for free, with in-app purchases. U.S. iPhone and iPad users do not need to sideload the game, change their Apple Account region, or use an alternative app marketplace.

Availability still depends on the storefront region associated with an Apple Account and on the device and software requirements shown in the live listing. Fortnite is not automatically compatible with every iPhone or iPad, so the App Store’s current compatibility information is more reliable than an old device list.
Regional availability can differ. Epic said in a May 2026 announcement that Fortnite had returned to App Stores around the world, with Australia specifically identified as an exception because of an unresolved payment arrangement. Apple also allows developers to manage app availability by country or region, subject to local law and storefront requirements.

The practical U.S. takeaway is simple: search for Fortnite in the U.S. App Store and use the official listing. A future removal would require a new event; the 2025 approval is not an irrevocable guarantee that Apple must host the app forever.
Why did Apple remove Fortnite?
The dispute began in August 2020. Epic Games added a payment option inside Fortnite that bypassed Apple’s required in-app purchase system. Epic also offered its own virtual currency at a discount through that alternative payment flow.
Apple removed Fortnite from the App Store because Epic had breached Apple’s developer rules. Epic then sued Apple, turning the removal into part of a much broader challenge to Apple’s control over iOS distribution and digital payments.
The central question was whether Apple could require apps selling digital goods to use Apple’s payment system and charge a commission on those transactions. Epic argued that Apple’s rules and control over the App Store harmed competition. Apple argued that its rules were part of the operation and security of its platform.
The removal was therefore not an ordinary App Review rejection. It followed Epic’s deliberate decision to use a payment mechanism that Apple’s rules prohibited.
What did the original court order require?
In 2021, the district court largely rejected Epic’s broader antitrust claims but issued an injunction concerning Apple’s so-called anti-steering rules. In plain English, the injunction barred Apple from preventing developers from using buttons, external links, or similar calls to action to tell customers about purchasing options outside Apple’s in-app payment system.
That order was narrower than many headlines suggested. It did not simply declare Apple’s entire App Store model unlawful, eliminate Apple’s commissions, or automatically require Apple to restore Fortnite.

In fact, the court had declined Epic’s initial request for Fortnite’s immediate reinstatement during the early phase of the litigation. The court did protect Epic’s ability to maintain access to developer tools for unrelated products, including Unreal Engine.
This distinction matters because two separate issues were involved:
- Payment communication: what developers could tell customers about external payment options.
- App distribution: whether Apple had to host Fortnite after Epic breached its developer agreement.
Epic later argued that Apple was using the termination of Epic’s developer account and the App Review process to retaliate against it and avoid complying with the spirit of the injunction.
Why did Fortnite return in May 2025?
In April 2025, Judge Yvonne Gonzalez Rogers found that Apple had willfully violated the injunction. The court concluded that Apple’s implementation of the external-payment rules—including a commission and design restrictions—undermined the purpose of the order rather than meaningfully complying with it. The Ninth Circuit later affirmed the contempt findings.
Epic then submitted a Fortnite update intended for the U.S. App Store. Apple initially did not approve it. Epic asked the court to compel Apple to accept the submission, arguing that the refusal was connected to the contempt dispute and amounted to retaliation.
Judge Rogers ordered Apple to explain its position and warned that the Apple executive responsible for App Store compliance could be required to appear personally at a May 27, 2025, hearing. That created substantial pressure for Apple to resolve the immediate dispute.
Apple subsequently approved Fortnite, and the game returned to the U.S. App Store on May 20, 2025, before the scheduled hearing. The return was the practical result of the contempt proceedings and the judge’s enforcement posture. It is more precise to say that Apple approved Fortnite under intense judicial pressure than to describe the episode as a simple final order saying, “Apple must list Fortnite.”

No. Fortnite’s return was an important practical victory for Epic, but the litigation produced a mixed result.
- The district court rejected most of Epic’s broader antitrust claims.
- Epic secured an injunction against Apple’s anti-steering restrictions.
- Apple was later found in contempt for how it implemented the injunction.
- Apple continues to challenge the contempt-related rulings and financial consequences.
It is inaccurate to say that Epic won the entire antitrust case or that Apple was ordered to abandon App Store commissions altogether. The legal success that drove Fortnite’s return concerned Apple’s restrictions on external payment links and related communications.

The continuing legal fight concerns the scope of the injunction, Apple’s contempt finding, the appropriate sanctions, and whether Apple may charge a commission on purchases initiated through qualifying external links.
On December 11, 2025, the Ninth Circuit affirmed the contempt findings but reversed and remanded part of the civil-contempt sanctions calculation. The opinion is available from the Ninth Circuit.

The Supreme Court docket for Apple Inc. v. Epic Games, No. 25-1311, shows that Apple filed its petition for a writ of certiorari on May 21, 2026, and Epic filed its opposition on June 4, 2026.
Apple also sought emergency relief in a related matter. Justice Elena Kagan denied Apple’s emergency stay application on May 6, 2026, according to the Supreme Court’s emergency docket.

Those proceedings do not mean that Fortnite is again unavailable in the United States. They concern the legal rules and remedies governing the App Store, not a Supreme Court order forcing the game’s 2025 return.
What the dispute means for iPhone users
For U.S. players
- Fortnite can be downloaded through the U.S. App Store.
- You do not need to sideload it or change your Apple Account region.
- The app is free to download and includes in-app purchases.
- Device compatibility is determined by the current App Store listing and may change as the game is updated.
If Fortnite does not appear, check the Apple Account’s storefront region and the device’s compatibility. App availability is managed by country or region, and Apple explains the process in its App Store availability documentation.

For developers
The case could affect how developers communicate with customers about external payment options. Its eventual outcome may also influence Apple’s commission structure, the warnings and interface restrictions Apple can impose, and the remedies available when a platform is found to have disobeyed an injunction.
The injunction primarily concerns steering customers toward payment options. It should not be confused with a general U.S. right to install competing app stores, and Fortnite’s presence on the U.S. App Store does not by itself establish that Epic’s own iOS marketplace is available there.
What happened to Fortnite outside the United States?
Epic announced on May 19, 2026, that Fortnite was back on the App Store around the world, while identifying Australia as an exception. That announcement does not establish identical availability in every country.

Availability can vary based on Apple Account region, local regulation, Epic’s submissions, Apple’s storefront policies, and any unresolved payment arrangements. The U.S., European Union, Australia, and other markets should therefore be treated separately rather than summarized as “Fortnite is back everywhere.”
The bottom line
Apple did not merely face the possibility of bringing Fortnite back: it approved the game for the U.S. App Store on May 20, 2025, after a judge’s contempt finding and threat of further enforcement action. Fortnite remains available to U.S. iPhone and iPad users.
What remains unresolved is the larger Apple–Epic battle over external payment links, commissions, contempt sanctions, and the scope of Apple’s obligations to App Store developers. Fortnite is back; the legal fight over the App Store rules that shaped its removal is still going.
