Game mechanics vs. game expression: what copyright actually protects

Short answer: Copyright protects a game’s original expression—its code, art, text, characters, music, audiovisual output, and creative selection or arrangement—not abstract rules, procedures, systems, methods of operation, or the game idea itself. A developer can therefore use a familiar mechanic, but copying a distinctive combination of interface details, artwork, labels, sequences, and overall presentation can still infringe.

The boundary is fact-specific. U.S. law supplies the clearest framework, while courts in other countries may analyze combinations of game rules and presentation differently. The safest way to evaluate a project is to separate the mechanic from every expressive choice used to implement it.

The statutory line: ideas and systems are free, expression is protectable

Section 102(b) of the U.S. Copyright Act states: “In no case does copyright protection for an original work of authorship extend to any idea, procedure, process, system, method of operation, concept, principle, or discovery.” That rule prevents copyright from turning a game concept into a permanent monopoly.

The U.S. Patent and Trademark Office describes copyright as protection for the expression of an idea and lists video games among copyrightable works. In a game, expression can include source code, object code, character and environment art, animation, written dialogue, music, sound effects, cinematics, interface graphics, level artwork, and the creative way those components are selected and arranged.

Consider the difference between these descriptions:

  • Abstract idea: Players combine falling shapes to complete lines.
  • Expressive implementation: A particular rectangular field, piece silhouettes, color palette, labels, score treatment, ghost-piece visualization, next-piece panel, animation timing, sound design, and board styling.

The first description states a system of play. The second describes creative decisions that communicate the system to the player. Copyright generally leaves the first available while protecting qualifying original elements in the second.

Can someone copyright a game mechanic?

Not as an abstract mechanic. A rule such as “match three objects,” “roll dice to move,” “build a city from resources,” or “combine falling shapes to clear lines” is a procedure or method of operation. Granting exclusive rights over that rule would prevent other designers from making games in the same category.

That does not mean every implementation is safe. A mechanic is experienced through expressive material. The code that implements it may be protected as software; the art, text, sounds, animation, and interface may be protected as separate works; and a creative combination of otherwise commonplace elements may receive protection as an arrangement.

Mechanic versus implementation

Describe the mechanic in generic language first. If the description still works after removing names, colors, characters, artwork, interface labels, and story, it is probably describing the unprotected system. Then inventory the concrete choices that make the game look and sound the way it does.

Question Likely category Why it matters
What is the player required to do? Rule or procedure Abstract instructions normally remain available to other designers.
How are objects drawn, labeled, animated, and arranged? Expression Original visual and textual choices can be protected.
What code implements the behavior? Expression in software Literal code and some nonliteral structure may be protected, subject to limitations.
Is a feature dictated by the mechanic or hardware? Functional constraint or scènes à faire Necessary or standard features receive little or no protection.
How are individual choices selected and combined? Potentially protectable compilation or arrangement A distinctive combination can matter even when each component is familiar.

Why changing names or artwork may not be enough

Copyright does not use a percentage-change rule. There is no safe number of altered pixels, renamed characters, or added features. The question is whether the defendant appropriated protected expression, assessed in context and under the governing jurisdiction’s test.

A clone can therefore create risk without copying source code or every asset. Reproducing the same distinctive interface architecture, object shapes, labels, color relationships, screen layout, progression, and audiovisual feel may amount to copying the original’s expressive totality. Conversely, a game can share a mechanic, camera perspective, or genre convention while making independent expressive choices.

What Tetris Holding v. Xio Interactive teaches

In Tetris Holding, LLC v. Xio Interactive, Inc. (S.D.N.Y. 2012), the court separated the Tetris concept and rules from the way those ideas were rendered. The abstract falling-block puzzle was not owned as a copyright monopoly. The court nevertheless identified expressive details including game labels, board design, playing pieces, colors, sequences, arrangements, and audiovisual presentation.

The dispute involved more than a general falling-block mechanic. The defendant’s game reproduced details such as the dimensions of the playing field, garbage-line display, ghost pieces, and next-piece display. Those details, considered together with the broader presentation, supported an infringement finding even though the underlying rules were unprotectable.

The practical lesson is important for anyone making a “Tetris-like” game: using falling shapes or line clearing is not automatically unlawful, but reproducing the recognizable visual grammar of a particular game can be. A new title should make independent choices about field proportions, piece rendering, color logic, labels, previews, effects, animations, menus, sound, and progression rather than treating cosmetic substitutions as a complete redesign.

What the Triple Town and Yeti Town dispute adds

WIPO’s enforcement materials describe the dispute commonly referred to as Spry Fox v. LolApps, involving Triple Town and Yeti Town. The underlying match-and-grow concept remained available. The concern was the specific combination used to express it: an object hierarchy progressing from grass to bushes to trees to houses and beyond, a bear antagonist or comparable blocking creature, a field or meadow layout, and the particular progression and arrangement.

This illustrates why courts may look at a selection and combination rather than asking whether one isolated object is original. Grass, trees, houses, or a blocking creature may each be familiar. Their distinctive hierarchy, placement, progression, and relationship to the player’s actions can collectively communicate a particular expressive design.

Why game rules usually receive only thin protection

In DaVinci Editrice S.r.l. v. Ziko Games, concerning Bang! and Legends of the Three Kingdoms, the court explained that game rules receive, at most, thin protection. It also recognized that descriptions of player roles and interactions can contain creative expression and that an original selection and presentation may be protectable even when the game concept itself is not.

The court’s merger explanation captures the policy reason: “when an idea is so restrictive that it necessarily requires a particular form of expression, that is, when the idea and its expression are functionally inseparable, to permit the copyrighting of the expression would be to grant the copyright owner a monopoly of the idea.” If a rule can be communicated only, or almost only, through a particular wording or arrangement, copyright cannot be used to lock up the rule.

Merger in practical design work

Merger is strongest where the mechanic leaves very few workable ways to communicate it. A universally understood icon for a pause function, a conventional card value, or a required status indicator may be constrained by function. A designer’s distinctive metaphor, terminology, character voice, or ornamental layout usually leaves more room for creative alternatives and therefore presents a stronger expression argument.

Scènes à faire and functional constraints

Features that naturally flow from a genre, technical requirement, or rules of play are often treated as scènes à faire—standard elements that receive little or no protection. A health bar in a combat game, a grid needed to place tiles, or a conventional inventory function may be expected. That does not make every health bar or inventory screen unprotectable; it means the claim must focus on discretionary choices rather than the basic function.

Ask whether a feature was necessary for the mechanic to work, expected by players in the genre, dictated by hardware or software limitations, or selected from many viable alternatives. The more alternatives available and the more a feature reflects an author’s preferences, the stronger the argument that it is expression rather than an unprotectable constraint.

A practical comparison framework for two games

Use the following sequence when evaluating a proposed game against an existing title. It is an issue-spotting method, not a substitute for advice from counsel in the relevant jurisdiction.

  1. State each mechanic generically. Remove proper names, story terms, art descriptions, and interface language. Write only what the player must do and what the system does in response.
  2. Inventory the concrete implementation. List source-code modules, visual assets, animation, music, sound effects, dialogue, characters, menus, HUD elements, level layouts, labels, camera behavior, colors, and progression screens.
  3. Mark functional elements. Identify features required by the rule, genre, platform, or technical operation. Treat those as weaker copyright targets.
  4. Identify creative alternatives. For every remaining feature, record other designs that would have worked. A broad range of alternatives helps show independent expression.
  5. Compare combinations. Examine selection, sequence, hierarchy, spatial arrangement, and relationships among elements. A common item can become significant when reproduced as part of a distinctive combination.
  6. Review the total presentation. Compare representative gameplay, menus, loading screens, effects, audio, typography, and onboarding. Similarity in overall audiovisual impression can matter even when individual assets differ.
  7. Check authorship and access records. Preserve concept documents, dated prototypes, source-control history, contractor agreements, asset licenses, and independent-reference materials. These records help explain how the expression was created and who owns it.
  8. Get jurisdiction-specific advice before release. The cited U.S. authorities do not establish a universal international test, and other claims may apply even when copyright does not.

How different does a new game need to be?

There is no bright-line answer and no legally mandated number of differences. “Different” should mean independently expressive, not merely cosmetically altered. Changing a title, replacing a few colors, or redrawing one character may leave the same distinctive combination intact.

A stronger redesign changes the choices that communicate identity: the shape and proportions of the play area, object silhouettes, hierarchy and progression, terminology, interface layout, animation language, camera and framing, sound palette, character roles, narrative context, and the relationship among these elements. The goal is not to avoid every familiar convention; it is to avoid appropriating another game’s recognizable expressive package.

Is copying a game’s look and feel illegal?

“Look and feel” is not a separate automatic cause of action. Courts analyze the underlying expressive elements and the similarities between them. A general mood, genre, or visual trend is too abstract by itself. A close reproduction of distinctive screens, labels, arrangements, effects, characters, and audiovisual choices can be actionable when those elements are protected and the jurisdiction’s infringement test is met.

Analyze the claim component by component and then in combination. A single blue progress bar is ordinarily weak evidence. The same bar, placed in the same location with the same labels, typography, iconography, animation timing, menu hierarchy, and surrounding artwork may contribute to a stronger claim because the total presentation has been replicated.

What copyright does not answer by itself

Copyright is only one part of a game-clearance analysis. The cited authorities specifically warn that other legal regimes may matter even when a mechanic is outside copyright:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Trademark: Names, logos, and other source identifiers can create confusion independently of copyright.
  • Patent: A claimed technical process or design may be subject to patent rights, which operate differently from copyright.
  • Trade secret: Confidential source code, tools, or development information can be protected while secret and properly controlled.
  • Contract: Licenses, platform terms, employment agreements, and contractor assignments can restrict use regardless of copyright’s idea-expression boundary.
  • Unfair competition and related claims: Local law may provide remedies for conduct not covered by copyright.

These regimes have different requirements, durations, defenses, and geographic reach. A mechanic that is free to use under copyright may still require a separate review of names, technology, confidential materials, or contractual obligations.

Jurisdiction and international projects

The principal authorities discussed here are U.S. decisions and U.S. statutory language. Their reasoning is useful for developers everywhere, but it is not automatically controlling outside the United States. WIPO’s comparative materials note that other jurisdictions may assess combinations of game rules and expression differently.

For a project distributed internationally, identify the countries in which the game will be released, where development occurred, and where a dispute could be brought. Obtain advice under the laws that actually govern those activities. Do not assume that a design cleared under a U.S. analysis receives identical treatment elsewhere.

Documentation practices that reduce avoidable risk

Independent creation is easier to explain when the development record is organized. Keep dated design briefs that describe the mechanic in generic terms, mood boards showing independent references, version-control history, asset provenance, and written assignments from employees or contractors. Record why a particular interface, character, progression, or visual system was selected and what alternatives were considered.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

During review, place side-by-side captures in a matrix that separates rules, code, art, text, audio, interface, progression, and audiovisual presentation. Mark each similarity as functional, standard for the genre, independently developed, licensed, or requiring redesign. This does not guarantee a result, but it turns a vague “feel” concern into specific decisions that can be addressed before launch.

Bottom line for designers and publishers

You can build on a familiar mechanic. You should not treat that freedom as permission to reproduce a competitor’s expressive identity. Section 102(b), merger, and scènes à faire protect the availability of ideas, systems, and necessary conventions. The cases involving Tetris, Triple Town, and Bang! show that detailed implementation, creative combinations, and overall presentation can still be protected—sometimes even when no single copied element is novel on its own. Design independently, document the process, compare the full presentation, and obtain advice for every jurisdiction and other intellectual-property right that matters to the release.
