In the United States, a library, archive, or museum may be able to preserve a lawfully acquired game that is no longer reasonably available, including limited circumvention needed to keep some server-authenticated games playable locally. The permission is narrow: it is generally noncommercial, limited to eligible institutions, excludes many server-hosted materials, and keeps access on the institution’s physical premises. It is not a public license to download, trade, stream, or share ROMs.
Private collectors and ordinary players do not receive the same specific exemption. Their rights depend on other copyright rules, the way a copy was obtained, license terms, and whether circumvention occurred. The explanation below concerns U.S. federal law, not a worldwide rule or legal advice.

Which U.S. rules govern game preservation?
Three parts of federal copyright law matter most: the anti-circumvention rules in 17 U.S.C. §1201, the institution-focused exemption in 37 C.F.R. §201.40(b)(19), and the library and archive reproduction provisions in 17 U.S.C. §108. They overlap, but none creates a general right to distribute preserved games.
Section 1201 starts with a prohibition
Section 1201 generally prohibits bypassing a technological measure that controls access to a copyrighted work. A technological measure can include an access check, authentication mechanism, or other control that must be defeated before the game can run. The statute also restricts manufacturing, importing, offering, providing, or trafficking in circumvention technology.
#1 Best Overall
There is a narrow acquisition provision for a nonprofit library, archive, or educational institution making a good-faith decision about whether to acquire a copy when an identical copy is not reasonably available. That provision does not authorize trafficking in circumvention tools. Treating the acquisition language as a blanket permission to publish a bypass utility is therefore unsafe.
The preservation exemption is a regulatory exception
The Copyright Office describes §1201 as a general ban with limited exemptions selected through a triennial rulemaking process. The exemption in 37 C.F.R. §201.40(b)(19) applies to an eligible library, archives, or museum preserving a lawfully acquired complete video game that is no longer reasonably available in the commercial marketplace. The institution must act without direct or indirect commercial advantage.
Access under this exemption must remain within the institution’s physical premises. The rule does not authorize making the preserved game available to the general public, sending it to remote researchers, or streaming it over the internet from the collection.

Lawful acquisition and provenance
The institution must have lawfully acquired the game. A defensible project keeps acquisition records, such as purchase or donation documentation, collection numbers, and information identifying the edition or release. A download from an unknown source does not become lawful merely because the title is old or unavailable in stores.
No reasonable commercial availability
The complete game must no longer be reasonably available in the commercial marketplace. “Out of print” is not enough if an authorized digital or physical edition can still reasonably be obtained. An institution should record where it looked, which editions were checked, the date of each check, and why the available copy was not an identical or reasonably obtainable release.
Eligible institution and public-service purpose
The beneficiary is a qualifying library, archives, or museum carrying out a public-service mission. The activity must not provide direct or indirect commercial advantage. Staff or volunteers can perform technical work, but the institution remains responsible for the project’s controls, documentation, and security.
What “complete game” means
The regulation defines a complete game as one playable without accessing or reproducing copyrightable content stored, or previously stored, on an external server. A title whose executable and required assets are all in the lawfully acquired copy can fit this category even if modern operating systems require technical adjustments. A game that depends on server-hosted levels, dialogue, artwork, or other expressive material may not.
Can a library legally dump and emulate an old game?
Sometimes, but only when the project satisfies every applicable condition. Dumping a cartridge, disc, or downloaded package creates a preservation copy; emulation changes how that copy is executed. Neither step automatically grants permission to distribute the resulting ROM or emulator.
A practical institutional workflow
- Confirm the institution. Establish that the organization is a qualifying library, archives, or museum and document the public-service, noncommercial purpose.
- Prove lawful acquisition. Record the source, date, format, edition, and chain of custody for the physical or downloaded copy.
- Check marketplace availability. Conduct and document a reasonable search for an identical or equivalent authorized copy. If the title is still reasonably sold or licensed, the preservation exemption does not cover circumvention for it.
- Determine whether the game is complete. Identify every asset and service required for play. Separate files on the acquired media from material that a publisher’s server supplies at runtime.
- Create a controlled preservation image. Use trained personnel, write-protect or otherwise protect the source where appropriate, verify the resulting image, and retain documentation linking it to the original copy.
- Emulate or adapt inside the institution. Test the image on an isolated workstation or other controlled system. Keep access limited to the physical premises and authorized users acting under the institution’s policy.
- Secure and document the collection. Apply reasonable digital security, maintain checksums and metadata, record any modifications, and log who can access the preserved copy.
This workflow addresses the conditions in §201.40(b)(19); it does not eliminate separate questions about software licenses, contracts, privacy, or other laws.
How does the law treat games that depended on a dead authentication server?
The same regulation covers certain games for which the owner has stopped providing the external-server authentication needed to play. It permits copying and modification needed to restore local play, or to preserve the game in playable form, when the rule’s other conditions are met.
When is server support considered to have ceased?
Support is treated as ceased when the owner affirmatively states that it ended and the service is unavailable, or when support has been discontinued for at least six months and has not been restored. Institutions should preserve evidence of the announcement, outage history, and the date the six-month period was reached.

An institution may be able to remove or replace an authentication check so that a lawfully acquired, otherwise eligible game runs locally. The resulting build can be kept playable for preservation on the premises. The permission is tied to the institutional, noncommercial preservation purpose; it is not a right to operate a public replacement server or release a modified copy online.
Why server-hosted content is a separate problem
If gameplay requires reproducing copyrightable content that was stored on an external server, the title may fall outside the regulation’s definition of a complete game. Restoring an authentication handshake is different from recreating a publisher’s server database, artwork, story content, matchmaking service, or user-generated material. The exemption does not turn those server materials into institution-owned assets.
What additional rights can Section 108 provide?
Section 108 supplies separate reproduction rules for qualifying libraries and archives. These rules are conditional and do not replace the §1201 analysis.
Section 108(h): works in the final 20 years
During the final 20 years of a published work’s copyright term, §108(h) can allow a qualifying institution to reproduce, distribute, display, or perform copies for preservation, scholarship, or research. Before relying on it, the institution must make a reasonable investigation and find that the specified commercial-availability conditions are absent. The provision is not a general public-sharing license, and its conditions must be satisfied for the particular work and use.

Section 108(e): public performance of coin-operated games
Section 108(e) contains a distinct provision concerning lawfully made coin-operated electronic audiovisual games. It addresses certain public performances, but it does not authorize copying every game, distributing ROMs, or bypassing access controls. An institution should analyze the exact machine, copy, and performance rather than treating §108(e) as a universal arcade-game exception.
What preservation activities remain outside these protections?
- Public ROM distribution: Uploading a preserved image to a website, file locker, torrent, or public repository is not authorized by the institutional exemption.
- Remote access: The current video-game preservation exemption keeps access within eligible premises, so remote researcher logins and internet streaming are outside its stated scope.
- Games still reasonably available: Circumventing a protection for a title that can still be reasonably obtained commercially is not covered by the preservation rule.
- Circumvention-tool trafficking: The nonprofit acquisition language does not protect manufacturing, importing, selling, offering, or distributing circumvention technology.
- External-server expressive content: A game that needs copyrightable material from an external server may not qualify as a “complete game.”
- Unlawful copies: The exemption does not cure a bad acquisition, an unauthorized download, or a copy whose provenance cannot be established.
How should an institution compare preservation options?
A project decision should be based on the following legal and operational axes, not simply on whether a title is technically dumpable.
| Decision axis | Question to answer | Why it matters |
|---|---|---|
| Acquisition | Was the exact copy lawfully obtained, with records? | Lawful acquisition is an express condition of the preservation exemption. |
| Market status | Is an identical or equivalent authorized copy still reasonably available? | The exemption targets games no longer reasonably available commercially. |
| Technical dependency | Can the game run without external-server content or authentication? | Server-hosted expressive material can exclude a title; ceased authentication may permit limited local restoration. |
| Institution | Is the actor an eligible library, archives, or museum? | The regulation is institution-specific, not a general consumer exception. |
| Purpose | Is the work noncommercial and tied to preservation or related public-service activity? | Direct or indirect commercial advantage is disallowed. |
| Access location | Will users play it only on the physical premises? | Remote access and public streaming are outside the current exemption. |
| Operations | Are security, staffing, provenance, and change records adequate? | The rule contemplates controlled institutional activity and reasonable digital security. |
Examples: what is likely permitted, uncertain, or excluded?
Out-of-commerce cartridge in a museum collection
A museum owns a cartridge acquired through a documented donation. No authorized edition is reasonably available, the game is self-contained, and visitors play a local emulation station inside the museum. Those facts align with the preservation exemption, assuming the museum qualifies and maintains noncommercial, on-premises controls.
Disc game with a discontinued login check
An archive lawfully owns the complete disc, and the publisher has publicly ended authentication. The service has also remained unavailable for at least six months. Modifying the copy to bypass that check for local institutional play may fit the rule, provided the title is no longer reasonably available and the archive meets the other conditions.

Massively online game whose world lived on a server
An institution may preserve its lawfully acquired client software and documentation, but the exemption does not automatically authorize reproducing the server’s copyrighted world, databases, or community content. Building a public replacement service would require a separate rights analysis.

Collector sharing a ROM with friends
Owning an original cartridge does not place a private collector inside the library, archives, or museum exemption. Uploading or distributing a ROM remains outside that specific protection, even when the publisher no longer sells the game.
What should a preservation policy record?
A credible policy turns each legal condition into an auditable record:
- Institutional status and the public-service purpose of the project.
- Acquisition receipts, donor agreements, license records, and chain of custody.
- Search dates, stores or catalogs checked, and findings supporting the conclusion that the game is not reasonably available.
- A technical inventory identifying local files, authentication dependencies, and any external-server content.
- Evidence of a shutdown announcement or six months of uninterrupted, un-restored server discontinuation when relying on the ceased-support provision.
- Names or roles of staff and volunteers who performed imaging, emulation, or modification.
- Checksums, version notes, change logs, backup locations, and security controls.
- Physical-premises access rules, authentication for users, and a prohibition on public downloads or remote streaming.
Why the answer can change
The §1201 exemptions are temporary. The Librarian of Congress reviews classes of works through a triennial rulemaking process; an exemption can be renewed, revised, or declined in a later cycle. A policy that was valid under one rule should therefore be checked against the version in force before a new project begins or an existing project expands.
