College football programs can help recruits and current players find and negotiate real commercial name, image and likeness (NIL) opportunities, but they cannot use NIL payments as a promise for choosing a school, staying enrolled or performing on the field. The distinction matters: a business paying for genuine promotional work is different from a school promising money to secure a commitment, and both are different from direct benefits a school may provide under the post-House settlement framework.
For a recruit or family, the practical question is not just how much a program says an athlete could earn. It is who pays, what work the athlete must do, whether the deal terms are clear and compliant, what support the program can provide, and how the opportunity fits alongside football, academics and personal goals.

How NIL fits into recruiting and retention
In Division I football, NIL can enter a recruiting conversation as a discussion of legitimate commercial opportunities and the help a program may provide in pursuing them. The NCAA’s April 1, 2025 consent judgment allows prospective and transferring Division I athletes to discuss, negotiate and enter qualifying third-party commercial NIL contracts before enrolling. The opportunities covered involve promoting or endorsing goods and services available to the general public. The NCAA’s announcement of the consent judgment explains the scope.

The same basic boundary applies when a program is trying to retain a current player. Staff may support the athlete’s pursuit of real commercial work, but an NIL payment cannot be conditioned on remaining at that school. A program’s general ability to help athletes find opportunities does not prove that NIL caused a particular recruit to commit or a player to stay.
What a program can do to support a deal
NCAA rules allow institutional assistance with NIL opportunities, including identifying potential opportunities and facilitating contact with third parties. The athlete, however, must retain control over whether to accept a deal and its terms; athletes may also use outside representation. School assistance can make the process easier to navigate, but it is not the same as the school guaranteeing a payment or deciding on the athlete’s behalf.
Permitted forms of assistance
- Explain the kinds of commercial opportunities available in the local or broader market, without presenting an unsupported estimate as guaranteed income.
- Help identify potential businesses or facilitate contact between an athlete and a third party.
- Explain the program’s available NIL support and direct athletes to current reporting guidance.
- Allow the athlete to review terms, decline an offer or seek independent advice and representation.
Questions that expose a weak pitch
- Is there a named payer and a real product or service to promote, or only a headline dollar amount?
- What specific deliverables must the athlete complete, and how and when will payment be made?
- Does the agreement include cancellation terms, a defined duration or other material obligations?
- Would the athlete still be paid if they did not enroll, remain at the school or meet a football performance target? If the deal depends on those conditions, it raises the core inducement or performance concerns.
These questions do not determine legality by themselves. They help a player distinguish a commercial agreement with work attached from a recruiting promise dressed up as one.

Why the payer matters
Third-party NIL deals are not all treated alike. A business with no relevant connection to an athletics program presents a different review question from an entity or individual associated with the school. Under the Division I rules, an associated party can include an organization that supports a school’s athletics program or an entity that has assisted with recruiting or retention. Deals involving associated entities or individuals face additional review; describing a payer as a collective or a business does not by itself settle how the rules apply.
For an associated-party deal, the review examines whether it has a valid commercial purpose related to promoting or endorsing goods or services offered to the general public for profit, and whether the compensation is commensurate with what similarly situated people with comparable NIL value receive. In practical terms, the agreement should make sense as a commercial transaction: the payer should have a business reason to buy the promotional work, and the payment should have a defensible relationship to the work and the athlete’s NIL value. The NCAA’s legislative text sets out these review criteria.
That scrutiny does not mean every associated-party agreement is automatically invalid, nor that every independent-business deal is automatically compliant. The terms, work, counterparty and applicable rules matter. Athletes should not rely on a verbal assurance that a deal is fine merely because it is called NIL.

Keep third-party NIL separate from school-provided benefits
After the House settlement framework, participating schools may provide athletes direct revenue-sharing benefits within an annual cap, while athletes may also earn third-party NIL income. These are distinct channels. A school-provided direct benefit is not the same thing as an endorsement payment from an outside business, so a recruiting pitch should identify what each amount represents rather than describing every form of athlete compensation as “NIL.” The College Sports Commission (CSC) describes the framework in its overview.

What recruits and families should compare
Compare programs using the same questions rather than treating a large projected figure as the answer. A useful evaluation separates opportunity quality, deal terms, support and broader fit.

Ask for explanations in concrete terms and take time to review any written agreement. A useful comparison is one that distinguishes what is available now from what is only a possibility, and separates an actual contract from a verbal projection. The same questions apply to a current player weighing whether to remain at a school, although an NIL agreement itself cannot require continued enrollment there.

The Division I legislative text requires reporting third-party NIL contracts or payment terms of $600 or more to the designated clearinghouse. The NCAA athlete-facing NIL page directs athletes to NIL Go and gives distinct reporting timelines for high school entrants, junior college transfers and Division I transfers. Because the timeline depends on an athlete’s status and implementation guidance can change, use the current NCAA and CSC instructions rather than relying on a general deadline repeated elsewhere.
- Identify the agreement and payer. Establish who is paying, whether the party may be associated with an athletics program, and what commercial work the athlete is expected to perform.
- Read the complete terms. Check deliverables, compensation, payment timing, duration, cancellation language and any conditions tied to school enrollment or football activity.
- Confirm reporting obligations. Use the current NIL Go process and instructions applicable to the athlete’s status. Do not assume that a timeline for one category of athlete applies to another.
- Keep records. Preserve the agreement, communications about the work and records showing whether the promised deliverables were completed. These make it easier to understand and document the actual transaction.
- Ask for qualified help when terms are unclear. The athlete can seek independent representation or other appropriate professional advice; school assistance does not eliminate the athlete’s need to understand the agreement.
This is a rules-sensitive area. The cited NCAA materials describe Division I requirements and the 2025 consent judgment; athletes should verify the current instructions that apply to their division, status and school rather than assuming the same process governs every college athlete.

What the recent numbers show—and what they do not
The CSC’s reported deal-review totals illustrate the scale of the system, not a football recruiting effect. The Associated Press reported that the CSC cleared more than $227 million in NIL deals for July and August 2026, including $188.6 million in associated-entity deal value. It also reported that 68% of deals processed from July 1 through August 31, 2026, were resolved within seven days. These figures cover the overall review system, not football alone; they do not establish an individual athlete’s market value or show that a deal caused a commitment, transfer or decision to remain. The figures are reported by the Associated Press.
Likewise, a roster limit does not explain why a particular player makes or leaves a roster. Aggregate totals and system rules can provide context, but claims about an individual’s motives need evidence about that individual. No football-only causal measure is established by these overall deal figures.
How much should NIL factor into a college decision?
NIL belongs in the comparison, but it should be weighed according to the quality and reliability of the specific opportunity rather than a headline number. An athlete should assess whether the payer and work are identifiable, whether the terms are clear, how much is contractual rather than speculative, and what role the program can properly play in helping the athlete pursue the deal. A commercial opportunity with defined deliverables is more informative than a general claim about earning potential.

Then compare it with the nonfinancial factors that shape the college experience: academic fit, coaching and player development, football opportunity, campus culture, location and the athlete’s own priorities. No aggregate CSC total answers those personal questions, and the available overall figures do not establish that NIL caused any particular recruiting or retention outcome.
How the rules have changed
The current structure is part of a recent transition. On April 1, 2025, the NCAA announced the consent judgment allowing prospective and transferring Division I athletes to negotiate qualifying commercial third-party NIL agreements before enrollment. On June 6, 2025, the NCAA announced approval of disclosure and transparency rules in the new framework. In a letter that day, NCAA President Charlie Baker described it as a framework that “enables schools to provide direct financial benefits to student-athletes and establishes clear and specific rules to regulate third-party NIL agreements.” The NCAA letter is dated June 6, 2025.
The practical lesson is to distinguish three things whenever a recruiting or retention pitch discusses money: commercial NIL paid by a third party for work, direct benefits a participating school may provide under the settlement framework, and an impermissible promise tied to enrolling, staying or athletic performance. They may all come up in the same conversation, but they are not interchangeable.
