The original Max Payne has 22 numbered chapters on PC. The game also includes three prologues, a tutorial and a bonus level; those are separate from the chapter count. Console editions divide much of the same structure into sub-chapters, so their displayed breakdown can look different.
What counts toward the 22 chapters?
The 22 figure refers to the numbered chapters in the PC version, not every playable section. The three prologues, tutorial and bonus level are additional parts of the game rather than numbered chapters. The count and these distinctions are listed in the community-maintained Max Payne Wiki chapter reference.

Why can console chapter lists look different?
Console versions split much of the PC structure into sub-chapters. That changes how sections are displayed, but those subdivisions should not be counted as extra story chapters on top of the PC total. The exact presentation depends on the version; the community chapter reference describes the segmentation difference.
Which game does this count refer to?
This is the first Max Payne, not a count for the franchise. Rockstar’s official game page identifies the original title, credits Remedy Entertainment as its developer and gives its release date as July 25, 2001.
