Build your home arcade library from publisher-authorized re-releases and compilations, checking each game in your platform’s official local storefront before you buy. In the United States, owning an arcade cabinet, board, or one copy of a game does not automatically give you the right to download or make another copy of its software.
Start with the games, not the platform
Write down the specific coin-op titles you want to play. Then look for official re-releases and licensed collections on systems you already own. A game’s age, rarity, or absence from a storefront does not by itself make it free to copy.
- Make a title wishlist. Be as specific as possible about the game you want; a series listing does not establish that every entry is available.
- Search official regional storefronts and publisher catalogs. Confirm the exact title, platform, and purchase format before deciding. Listings and local availability can change.
- Compare practical fit. Consider whether you already own the platform, whether your target games are available for it locally, the purchase format, and the control setup you prefer.
- Buy through an authorized route. Prefer publisher-authorized releases and licensed compilations rather than ROM downloads from unrelated websites.
Check availability one title at a time
HAMSTER’s Arcade Archives catalog listed Arcade Archives 2 XEVIOUS 3D/G on September 24, 2026, for Nintendo Switch 2, PlayStation 5, and Xbox Series X|S. That is a concrete example of an authorized arcade re-release spanning current platforms; it does not show that every game in the series is on every platform, or establish which platform has the largest overall arcade library.

What U.S. copyright rules mean for home players
This legal overview is specific to the United States, not universal legal advice. U.S. copyright gives rights holders exclusive rights that include reproduction, distribution, derivative works, and certain public performances and displays. Buying a physical arcade board, cabinet, or retail copy does not, by itself, establish permission to make additional copies or download a ROM from an unrelated site. The U.S. Copyright Office describes buying or licensing as ways to use protected works, alongside applicable statutory exceptions and public-domain status.
A software backup is not a blanket ROM-download permission
The Copyright Office’s software FAQ describes a limited archival-copy provision in Section 117. Among its conditions, the person must be the program’s legal owner and make the copy only for archival purposes; the copy must be destroyed or transferred when the original is transferred. The Office also notes that the provision does not cover other copyrighted works on the computer and advises checking the software’s original sale or license terms. These conditions do not create a general right to download an arcade ROM from a third party.

Video-game preservation exemptions are narrow
The current 37 CFR 201.40 exemptions include specific cases involving lawfully acquired complete games whose required external server authentication service has ceased, for restoring local gameplay, and preservation by qualifying libraries, archives, or museums under stated conditions. Institutional access is limited outside the institution’s premises. These rules do not establish a general home-user right to download unavailable games.
Resale, public display, and performance have defined limits
Title 17 Section 109 provides a first-sale rule for disposing of a particular lawfully made copy, subject to statutory limits; it does not generally authorize making another copy. Section 110(e) addresses public performance or display of a particular lawfully made game copy in coin-operated equipment, with an express limitation when another work embodied in the game has a different copyright owner. Neither provision turns arbitrary ROM downloading into an authorized route.

Keep emulator licensing separate from game rights
MAME’s official legal page identifies its source code as licensed under GPL version 2 or later for the release described there. That license concerns the emulator code. It does not grant rights to the game’s program, graphics, sounds, or ROM data. Treat permission to use an emulator and authorization for each game’s content as separate questions.

A practical rule for uncertain titles
- If an authorized re-release or compilation is available for your platform and region, use that route and follow its license.
- If a title is unavailable, do not infer that it is public domain or lawful to download merely because it is old, difficult to find, or no longer sold.
- If you are considering a backup, preservation exception, or other legal theory, check the applicable statute, regulation, and original license terms; the provisions above are conditional and fact-specific.
