Short answer: In the United States, a costume or character reference creates trademark risk when its use could make buyers think that the trademark owner supplied, sponsored, approved, or is connected with the goods or services. The name, logo, image, packaging, listing, tags, and advertising must be evaluated together with the goods being sold, the sales channels, the likely purchasers, and the strength of any earlier mark. Marks do not have to be identical for confusion to be possible.
A federal-record search is a useful first screen, not a legal clearance and not a court ruling. The process below helps you identify warning signs before a commercial launch. It does not decide copyright, right-of-publicity, licensing, or other claims, and it is general information under U.S. law rather than a legal conclusion about a particular costume.
What trademark infringement asks
The USPTO defines infringement as unauthorized use of a trademark or service mark on or in connection with goods or services in a way that is likely to cause confusion, deception, or mistake about the source of those goods or services. In practical terms, the question is not simply “Does this costume look like a known character?” It is whether an ordinary purchaser could believe the item, event, listing, or promotion comes from, is sponsored by, licensed by, or otherwise connected with the owner of a mark.
The USPTO’s formulation includes confusion about source and its materials also address confusion about sponsorship or connection. A reference that seems obvious to fans can therefore be risky if the presentation resembles an official product line, convention appearance, game event, or promotional partnership.

Courts use a group of nonexclusive factors. Similarity between the marks and the relationship between the goods or services are central, but courts may also examine advertising and sales channels, the likely purchasers and their care when buying, evidence of actual confusion, the user’s intent, and the strength or commercial recognition of the earlier mark. No single factor automatically wins, and the importance of each factor changes with the facts and the evidence.
First, describe exactly what you plan to do
Make a record before changing the design or publishing a listing. Save sketches, photographs, mock-ups, names, logos, tags, packaging, product descriptions, event flyers, social posts, and paid advertisements. For each element, write where it will appear and what job it performs.

- Each Women Cow Cosplay Lingerie Set includes: 1 x hair hoop, 1 x bodysuit, 1 x stockings
- Free Size: It has some stretch in the fabric and ranges from S to L. Please check the size carefully before ordering
- Cosplay Lingerie for Women Anime are perfect for Valentine's Day, cosplay, wedding night, date night, special night, brithday gift, honeymoon night, lingerie party, christmas, club wear, anime cosplay costumes, party dress
- Due to different camera lenses and different light environments, the color of the product may be slightly different from the listed pictures
- Care Instructions: Hand wash in cold water (Use a laundry bag if machine wash), lay flat to dry, no bleach, iron on low heat
- Words: Record the exact character name, catchphrase, series title, spelling variants, transliterations, and any shortened form.
- Graphics: Note symbols, emblems, typography, color arrangements, silhouettes, masks, and recurring iconography.
- Physical design: List distinctive armor panels, uniforms, props, insignia, color blocking, and other features that buyers will see.
- Presentation: Capture the product title, thumbnail, hashtags, storefront name, booth sign, sponsor language, and statements such as “official,” “authorized,” or “in collaboration with.”
- Placement: Distinguish a design element that is merely part of a costume from a word or symbol displayed as a badge, label, hangtag, packaging mark, or account name.
This inventory matters because the same image can carry different significance in different settings. A character-like drawing on a one-off personal costume may be perceived as decoration, while the identical drawing on a box, web-store banner, and recurring merchandise line can look like a brand identifier.

A name or image associated with a character does not automatically function as a trademark for every use. TMEP section 1202.10 discusses decisions involving a game-character image, names of characters in a book series, and an illustration of a frog on a book cover. Those examples show why the registration-function question must be separated from the character’s identity: an element can identify a character in a creative work without serving as a source indicator for the goods in a particular transaction.
Ask how a purchaser encounters the element:
- Is it used as the product or service name, account name, collection name, or event title?
- Does it appear where consumers normally expect a house mark, logo, hangtag, package badge, or seller identifier?
- Is the surrounding copy describing an unofficial depiction, or does it imply an official relationship?
- Would a buyer use the element to find your product, distinguish it from another seller’s product, or infer who made it?
These questions do not create a safe harbor. They help you identify the part of the presentation most likely to be treated as a trademark use and therefore most relevant to a confusion analysis.
Define the goods, services, and commercial setting
Write down what the customer is actually buying or being invited to attend. “Costume” is too broad for a useful assessment. Separate, for example, a made-to-order outfit, a downloadable pattern, a rental service, a photo package, an appearance at a ticketed event, a livestream promotion, and a convention booth selling accessories.
Then identify:
- the likely purchasers and whether they are making a quick, low-cost purchase or a deliberate, expensive decision;
- where the offer appears, such as a marketplace, your own store, a convention, social media, a game event, or an advertisement;
- the channels through which the possible senior mark is sold or promoted;
- whether the owner is known for related merchandise, costumes, events, entertainment, subscription services, or promotional collaborations.
Goods and services can be related even when they are not identical. The USPTO explains that relatedness may exist when products are used together, sold to the same purchasers, advertised together, compete, or are commonly offered through similar trade channels. A different product label therefore does not by itself remove the risk. A costume, an event appearance, and promotional media may be distinct offerings yet still reach the same audience through overlapping channels.

Search the USPTO records as an initial screen
Use the USPTO’s trademark search system to look for the exact wording, plausible spellings, phonetic variants, translations, and combined word-and-design records. Search both pending applications and registrations. When the reference is primarily visual, search design records and examine marks with similar dominant shapes or symbols.
- Start with the exact wording. Search the full character or series name, then separate the words and test singular, plural, possessive, abbreviated, and common misspelled forms.
- Test sound and meaning. Look for words that sound alike, have a similar meaning, or create a similar overall commercial impression, even when the spelling differs.
- Review the goods and services descriptions. Read the identification in each record rather than relying on the mark name. Note costumes, apparel, toys, games, entertainment, events, media, software, and promotional services that overlap or are commonly connected.
- Check status and ownership information. Record whether a filing is pending, registered, abandoned, cancelled, or otherwise shown in the system. Preserve the serial or registration number and the relevant filing details for a lawyer to review.
- Search designs separately. A word search may not reveal a distinctive emblem, character silhouette, or composite logo. Use the system’s design-search features where the visual element is important.
- Expand beyond one record. Related marks, older filings, and marks owned by connected entities can reveal a broader commercial program than the first result suggests.
The USPTO conducts its own federal-record search when examining an application, but that registration process is different from a court’s infringement determination. A clean or inconclusive search does not prove that your use is available. Rights can arise from use without a federal registration, and records do not capture every marketplace fact.

Compare the whole commercial impression
Do not compare a single isolated detail. Put your proposed presentation next to the relevant earlier mark and assess what a buyer would perceive at the point of purchase or encounter.
| Comparison axis | Questions to ask | Why it matters |
|---|---|---|
| Appearance | Do the lettering, emblem, silhouette, layout, dominant colors, or combined design look alike? | Visual similarity can contribute to a similar overall impression, especially when the element is prominent on packaging or a listing. |
| Sound | Would the names be pronounced alike or heard as variants in conversation, a video, or an event announcement? | Marks can be similar in sound even when their spelling differs. |
| Meaning | Do the words, symbols, or character concepts convey the same idea? | Conceptual similarity may matter alongside appearance and sound. |
| Overall commercial impression | When seen as presented, does the reference look like an official line, collaboration, or source identifier? | The analysis considers the total impression, not a checklist of matching pixels. |
| Goods and services | Are the offerings identical, complementary, competitive, or commonly provided by the same businesses? | Similarity of marks is less informative when the goods and services are unrelated; related offerings increase concern. |
| Channels | Do the offers appear in the same marketplaces, events, websites, social feeds, or advertising spaces? | Overlapping trade and advertising channels can make mistaken association more plausible. |
| Purchasers and care | Who buys, how much do they spend, and how carefully do they investigate the purchase? | Quick, inexpensive purchases can leave more room for a mistaken assumption than a researched, high-cost transaction, though care is only one factor. |
| Strength | How distinctive and commercially recognized is the earlier mark in the relevant market? | A strong mark may receive broader attention in the confusion analysis. |
| Actual confusion | Have buyers asked whether the item is official, sent mistaken inquiries, or made misdirected purchases? | Evidence can support a claim, but the absence of reports does not automatically make a use safe. |
| Intent | Do drafts, messages, naming choices, or launch plans show an effort to evoke or benefit from the earlier mark? | Intent can be relevant evidence, although it does not replace the other factors. |
The table is a working comparison, not a mathematical scorecard. Courts weigh these factors case by case, and the quality of the evidence can matter as much as the number of factors pointing in one direction.

Review the finished customer experience, not just the costume itself. A neutral design can become more problematic when the listing, booth, or advertisement supplies an official-looking context.
- Names and labels: A title that combines the character reference with “collection,” “official,” “licensed,” or a series-style logo can suggest a source relationship.
- Packaging: Branded boxes, hangtags, seals, or inserts can make an otherwise descriptive reference look like a manufacturer’s mark.
- Advertising: Statements about partnerships, appearances, launches, or “coming to” an event can imply authorization when none exists.
- Tags and account names: Search-friendly tags are not automatically infringing, but an account or storefront name built around another party’s mark can function as a source cue.
- Disclaimers: A notice that the item is unofficial may help explain your position, but it does not automatically defeat a confusion claim if the rest of the presentation looks official.
Keep contemporaneous evidence of genuine customer questions or mistaken messages. Actual confusion is relevant when it exists, but a lack of reports is not proof that confusion is impossible, particularly for a new or small launch.
Character references need a separate, careful analysis
Character names and images sit at the intersection of creative works and branding. A character’s name may identify a fictional person in a book, game, film, or series without acting as the trademark for every product that depicts that character. Conversely, the same name or image may be promoted as a line identifier for merchandise, events, or services.
Analyze the proposed use in its specific setting:
- Identify the reference. Is the customer being shown a depiction, told which character is represented, or invited to buy a product under that character name?
- Identify the source cue. Is the name or image placed where a buyer expects the seller’s or manufacturer’s brand?
- Check related commercial activity. Does the possible owner offer costumes, apparel, toys, game-related services, live appearances, or promotional events that overlap with your offer?
- Separate legal theories. Even if the element is not functioning as a trademark in your presentation, copying artwork, using a person’s likeness, or reproducing protected creative expression can raise copyright, right-of-publicity, or licensing issues that this trademark screen cannot answer.
Do not rely on either extreme: “character references are always free” and “any resemblance is trademark infringement” are both overbroad.

Common shortcuts that do not settle the question
A different color or a few changed details
Changing colors, adding accessories, or altering a small feature does not automatically remove similarity. The comparison concerns appearance, sound, meaning, and overall commercial impression, together with the relatedness of the goods and the marketplace context.
A disclaimer on the listing
An “unofficial” or “not affiliated” statement is one fact in the presentation. It cannot guarantee that buyers will not be confused when the name, logo, packaging, or advertising otherwise suggests sponsorship or approval.
Calling it parody
Whether a use is expressive, humorous, or critical does not turn the trademark analysis into an automatic exception. The facts, the presentation, and the applicable legal theory still matter, and other intellectual-property rights may apply.
No one has complained yet
Actual confusion can be useful evidence when it exists, but a new listing may simply have had too few purchasers or too little time to generate reports. Courts consider the complete record rather than treating silence as clearance.
The mark is not registered
Federal registration is not the only source of trademark rights. An unregistered mark can still be relevant to an infringement analysis, so searching only for registration records cannot establish that a name or design is free to use.

| Screen result | Typical indicators | Prudent next step |
|---|---|---|
| Lower apparent concern | The reference is incidental or descriptive, is not used as a seller or product identifier, goods and channels are remote, and the presentation does not imply approval. | Preserve the analysis, monitor the final listing and advertising, and reassess if the product or audience changes. |
| Uncertain or mixed | Some visual or conceptual similarities exist, goods or audiences overlap, or the owner’s commercial activity is unclear. | Remove avoidable source cues, test alternative naming and packaging, and obtain advice before committing substantial production or advertising spend. |
| High apparent concern | The name or logo is prominent, the goods or services are closely related, channels overlap, the owner is strongly associated with the category, or the presentation suggests an official collaboration. | Pause the launch and seek a comprehensive clearance review from qualified trademark counsel. |
Record why you placed the project in a category and which facts could change the assessment. For example, selling a one-time handmade prop to a known customer is a different context from building a recurring merchandise line with paid advertisements and an account name centered on the reference.
When to obtain professional clearance
The USPTO recommends a comprehensive clearance search for a serious commercial use. Escalate before launch when the project involves inventory, manufacturing commitments, paid promotion, a recurring event or service, a prominent character name or logo, or a possible conflict in closely related goods.

- the goods or services description and expected price range;
- where and how the offer will be sold, advertised, or displayed;
- the results and record numbers from your USPTO searches;

A worked example
Example: an unofficial convention costume
A maker sells a single custom outfit inspired by a space-faring game character. The character name appears only in a factual description of what the customer requested; the maker’s own shop name is prominent, and the listing says nothing about licensing or sponsorship. The relevant questions are still whether the image or name functions as a source cue, whether the game owner sells related costumes or event services, and whether the sales channels overlap. The analysis does not end with “one costume” or “unofficial.”
Example: a recurring apparel collection
A store launches shirts and jackets under a character name, uses a similar emblem on labels, and promotes the line with “official gear” language. The name and emblem now operate much more like brand identifiers, while apparel and entertainment merchandise may be closely related goods. Similarity, channels, purchaser expectations, strength, intent, and any mistaken inquiries all deserve careful review before launch.

Pick the symptom - the matching free tool is one click away.
Example: a critique event
An organizer advertises a ticketed discussion using a character image in a poster and clearly identifies the event as independent commentary. That context may differ from selling merchandise under the image, but a disclaimer or expressive purpose does not resolve every trademark or other intellectual-property question. The organizer should examine the actual design, wording, sponsorship implications, and distribution channels.
Keep the analysis current
Recheck the assessment when you change a name, logo, packaging, product category, sales platform, advertising audience, or event format. A use that appeared remote can become related when you add apparel, paid media, a recurring service, or a storefront name. Preserve dated screenshots and search results so counsel can see what was reviewed and how the commercial presentation evolved.
