Start with a written brief and agreement that name every asset, where you may use it, the files you will receive, deadlines, revisions, and payment milestones. Paying an artist does not automatically give you copyright ownership: agree explicitly on a license or a written transfer, especially if you want to sell merchandise, run ads, or use the work beyond your stream.
1. Define what you need before contacting an artist
Describe your channel, audience, visual direction, and how each asset will appear. “Stream graphics” is too broad to price or approve reliably; identify the deliverables individually.
List the assets and their uses
- Graphics: starting, intermission, and ending screens; panels; alerts; overlays; logos; and channel avatars.
- Community assets: emotes, badges, and other platform-specific graphics.
- Motion and audio: animated stingers, transitions, or original music.
- Where each will appear: live streams, VODs and clips, social posts, other platforms, sponsor placements, paid ads, or merchandise.
Say which uses are essential now and which you may want later. A license for stream use may not include merchandise or advertising.
Specify technical and delivery requirements
For each item, state its intended platform and placement, required dimensions or other technical specifications, file format, and whether you need editable or source files. Ask about dependencies such as fonts, stock images, samples, premade elements, or collaborators. Confirm that the rights for those components cover your intended uses.

2. Agree on scope, schedule, approvals, and payment
Before work begins, get the practical terms in writing. There is no universal commission template or standard revision count established by the official sources cited here, so make the arrangement specific to the project.
- Deliverables: List each asset, its format, and any source files included.
- Milestones and dates: Set the expected delivery dates and payment stages.
- Approvals: Identify when you review concepts or drafts and how you give approval.
- Revisions: State how revision rounds work, what counts as a revision, and how requests beyond the agreed scope will be handled.
- Rights and fee: Define permitted uses, any exclusivity, and the fee for the rights you actually need.
Compare proposals on portfolio fit, technical readiness, schedule, revision process, source-file terms, third-party materials, license scope, and total price. No reliable market-wide commission-price benchmark was identified in the official sources cited for this article; ask artists for quotes against the same brief rather than treating an unsupported figure as a going rate.

3. Choose a license or transfer of copyright deliberately
A delivered file and a copyright are different things. The U.S. Copyright Act says transfer of ownership of a material object does not by itself convey rights in the copyrighted work; a transfer of copyright ownership generally requires a signed writing. See the [U.S. Copyright Act, sections 202 and 204](https://www.copyright.gov/title17/92chap2.html).
If the artist keeps copyright
Agree on a license that names the uses you need. Spell out whether it covers stream overlays and emotes, VODs and clips, social promotion, other platforms, sponsor placements, paid advertising, merchandise, edits or derivative versions, and sharing files with editors or production vendors. State whether the permission is exclusive or nonexclusive, whether credit is required, and whether the artist may display the work in a portfolio. These are negotiation topics, not universal legal requirements.

If you want ownership transferred
Say that a copyright transfer is intended and document it in a signed writing. Define what is transferred and identify any exclusions, such as third-party fonts, stock, or other material the artist cannot transfer. If broad or exclusive rights affect the fee, put the agreed scope and fee in the contract.
Do not rely on “work made for hire” as a shortcut
Under U.S. law, a commissioned work qualifies as a work made for hire only when statutory requirements are met, including a signed written agreement and an eligible category of work. The U.S. Copyright Office says the creator is generally the initial owner of visual or graphic art and notes that most visual arts works do not fall within the commissioned-work categories. State the intended license or transfer directly rather than relying on the label. 4. Clear rights in music and other embedded material
Ask what third-party components appear in the work and whether their terms permit your planned channel and commercial uses. For commissioned music, verify that the artist or vendor controls the relevant rights and can grant permission for the way you will use the track on Twitch. Buying a track or subscribing to a music service does not, by itself, establish permission for Twitch use. Twitch warns that a provider may offer permission without controlling all necessary rights. Its [DMCA & Copyright FAQs](https://www.twitch.tv/p/en/legal/dmca-guidelines/) state: “Even when you’re using an Extension, you are responsible for ensuring you have the necessary rights to any music used in content on your channel.”

Twitch lists brand-logo stream overlays as branded content. Its guidance says streamers are not expected to use the branded-content tool unless branded content is a central and intentional element of the livestream. For a specific sponsorship, check the current [Branded Content guidance](https://help.twitch.tv/s/article/branded-content-policy) and tool instructions, and disclose the sponsorship appropriately.

6. Keep the paperwork and understand platform copyright processes
Save the signed agreement, payment record, final files, and written permissions somewhere you can retrieve them if a platform claim arises. Twitch says it acts on complete copyright notifications and generally considers a user a repeat infringer after three copyright strikes; that is a statement of Twitch’s policy, not a prediction of how a particular claim will be handled. Review Twitch’s current [DMCA & Copyright FAQs](https://www.twitch.tv/p/en/legal/dmca-guidelines/) and [Terms of Service](https://www.twitch.tv/p/en/legal/terms-of-service/) before deploying assets. Twitch’s terms include a broad license for user content uploaded to the platform.
