Say what part of the work was affected, what the tool did, and what a person reviewed or changed. There is no universal rule that every AI-assisted game or creative work must carry a public label: legal duties depend on the jurisdiction and content, while platforms and publishers may set separate submission requirements.
What should an AI disclosure say?
A useful adaptable pattern is: “I used [tool or model] to [specific task] in [part of the work]. I reviewed and [edited, selected, or verified] the result.” Name a model or version when it is relevant or required. Describe human involvement honestly: do not call a game “AI-generated” if AI only helped with one isolated element, but do not hide substantial generated content behind a vague “AI-assisted” label.
For a game, be concrete about the affected material: for example, concept-art variations, a specific background texture, a draft dialogue passage, or a music layer. If relevant, explain the purpose and the human review. A disclosure should help someone understand what the tool contributed, not imply that every part of the game was made the same way.
Where should the disclosure go?
Place it in the context where the work is encountered, using a format people can perceive and understand. A credits or methods entry may suit a written disclosure; an adjacent caption or credits note can identify visual material. Audio or video may call for an audible or visible cue where the applicable rule or distribution context requires one. Follow a platform’s submission workflow when it provides one.

- Game or creative-work credits: identify the affected asset or category and the tool’s contribution rather than making an unexplained whole-work claim.
- A specific image, clip, or audio item: use an adjacent, legible note when that is the context in which the item is presented.
- Platform delivery: complete the platform’s own declaration or metadata fields; a public credits note is not necessarily a substitute.
- Provenance metadata: treat it as supplementary information, not as a visible disclosure or guaranteed record.
These are practical placement choices, not a claim that every game needs every kind of notice. The required combination, if any, depends on the relevant law, publisher, distributor, and platform.
Which kind of requirement applies?
Separate legal obligations from platform or publisher rules, professional guidance, and voluntary transparency. They can overlap, but satisfying one does not automatically satisfy the others.

What does the EU AI Act require for creative work?
The European Commission says the AI Act’s Article 50 transparency obligations apply from 2 August 2026. The Commission’s Code of Practice is a voluntary compliance aid; the underlying Article 50 obligations are legal obligations for actors and content within scope. Article 50(4) does not require a public label on every AI-assisted creative work.
Deepfake image, audio, or video
The cited Commission explanation covers AI-generated or manipulated image, audio, or video content that resembles real persons, objects, places, entities, or events and falsely appears authentic. Where such deepfake content is part of an evidently artistic, creative, satirical, fictional, or analogous work or programme, disclosure should be appropriate and should not hamper the work’s display or enjoyment. For a game, assess the actual content and context; the fact that an asset was made with AI alone does not establish that it is a deepfake within this rule.

Specified public-interest text
The rule also covers AI-generated or manipulated text published to inform the public on matters of public interest when there has been no human review or editorial control and no person has assumed editorial responsibility. The Commission says the disclosure obligation does not apply in that case where human review or editorial control occurred and a natural or legal person holds editorial responsibility. This is a specific category, not a general rule for game dialogue, scripts, or other fictional writing.
The Commission describes optional icons and placement guidance, but an icon by itself does not establish compliance. Where an applicable rule calls for disclosure, verify the complete current requirements rather than assuming a visible symbol or credits note is sufficient.

How do platform declarations differ from public labels?
Some workflows collect structured information for delivery rather than asking creators to add a public-facing caption. YouTube’s guidance for music partners says they can report generative AI use through DDEX or CSV delivery templates, choosing “Fully Gen AI,” “Partly Gen AI,” or “No Gen AI.” Its examples distinguish among different contributions:
- Fully Gen AI: a song created using generative AI.
- Partly Gen AI: arrangements developed with AI; recorded vocals over AI-generated layers; AI-assisted lyric or melody development later recorded in a studio; or AI-generated visuals accompanying fully human-performed audio.
- No Gen AI: routine pitch correction and AI mastering are examples in this partner guidance.
These are YouTube music-partner delivery classifications, not universal definitions of AI use. Use the applicable delivery documentation and current account workflow. Do not assume the same categories apply to an ordinary video upload, a game storefront, or another service.

Does AI use affect copyright, and does copyright affect disclosure?
They are separate questions. The U.S. Copyright Office’s 29 January 2025 summary says copyright protection for generative AI output can depend on whether a human determined sufficient expressive elements. It identifies human-authored work perceptible in an output and human creative arrangement or modification as examples; merely providing prompts is not enough. It also says AI assistance or the inclusion of generated material in a larger human-generated work does not, by itself, bar copyrightability.
That summary addresses copyrightability, not a general duty to disclose AI use. A creator should not infer that a work needs no disclosure because it may be copyrightable, or that a disclosure determines who owns copyright. The answer to each question depends on its own applicable rules and facts.
Can provenance metadata replace a visible notice?
No. OpenAI describes C2PA Content Credentials as a way to carry information about origin and history, such as the tool and creation time, but notes that common actions such as screenshots or file conversion can remove them. It also says watermark coverage varies by product, model, export path, file type, and creation date. OpenAI explicitly cautions that provenance signals do not replace visible labels, banners, or notices that may be required.
Use metadata as supplementary evidence where available. Do not promise that a provenance signal will remain intact through editing, conversion, or reposting, and do not rely on it to meet a platform, publisher, or legal disclosure requirement.
A practical checklist before release
- Map the contribution. List the game or creative elements affected and what the tool did to each; distinguish an isolated assist from substantial generated content.
- Check the applicable rules. Identify relevant jurisdictions, publication or publisher requirements, distributor terms, and platform submission fields. Do not assume a rule from one service applies elsewhere.
- Write a specific statement. Name the affected part, task, and tool or model when relevant. Explain the purpose and human review if useful or required.
- Choose the right place and format. Use a visible, accessible note for a public-facing disclosure where appropriate, and separately complete structured platform metadata when requested.
- Verify after delivery. Check that the disclosure is present in the released context and that any metadata is treated as supplementary rather than the only notice.
For consequential legal exposure, identify the creator’s location, the intended audience markets, the medium, and the distributor, then check the relevant primary rules. Requirements can also come from publishers, contests, marketplaces, unions, or professional bodies beyond the examples above.
