How to Document a Police Encounter and Preserve Evidence Safely

A practical U.S.-oriented guide to staying safe, recording context, preserving original footage, writing a factual timeline, and following up after a police encounter.

Put safety first: keep a safe distance, do not obstruct officers, and do not physically resist. If it is safe to record, capture the encounter continuously and preserve the original file without editing it. As soon as you can, write a factual timeline, identify witnesses, and make a separate backup. Recording laws, complaint channels, and deadlines vary by location and circumstances.

During the encounter: prioritize safety

Do not put yourself at risk to get footage. Stay at a safe distance, avoid interfering with officers, and follow instructions rather than physically resisting. If an instruction creates an immediate conflict, prioritize your safety and seek legal advice afterward. When recording is safe

The First Amendment generally protects recording law-enforcement officials performing their duties in public when the recorder is lawfully present. That is not a blanket rule for every location or situation: property owners may restrict recording on private property, and privacy or notice rules concerning other people can vary by state. If you can record safely, keep the video continuous when practical. Include visible landmarks or street signs and enough surrounding activity to help show where the encounter happened and how it unfolded. If you are driving, do not hold a phone while driving; a hands-free dashcam or a passenger recording may be safer alternatives. ACLU recording guidance.

If an officer takes or asks to inspect your phone

The ACLU’s general rights summary says that, if you are not under arrest, an officer needs a warrant to confiscate your device or view its contents without your consent. If you are arrested, an officer may take the phone but still needs a warrant to search its contents. This summary is not a substitute for advice about your specific circumstances. What to write down as soon as you can

Make a contemporaneous account in your own words while details are fresh. Keep direct observations distinct from information you learned later. Use approximate times if necessary, and mark them as approximate rather than presenting them as exact.

  • When and where: date, approximate time, exact location, and nearby landmarks.
  • Who was involved: agency, officer names, badge numbers, patrol-car numbers, and the number of officers. Note identifying details you could actually see; do not guess.
  • What happened: the sequence of events, statements you heard, any reason given for a stop, requests or commands, searches, force, weapons, and how the encounter ended.
  • Witnesses: names and contact information, if they are willing to provide them.
  • Injuries and treatment: injuries you noticed, when and where you sought care, and any related records.

How to preserve video and other digital evidence

  1. Keep the original file intact. Do not crop, trim, add captions to, or otherwise alter the original video or photo. Editing can remove context that may matter later. The ACLU advises preserving original recordings without edits. ACLU recording guidance.
  2. Make a separate copy. Copy the original photo or video to another device so your only copy is not at risk of loss or deletion. A separate device such as an external drive is one option; no particular product is required. ACLU recording guidance.
  3. Keep a simple transfer note. Record who made the file, when and where it was recorded, when you copied it, and who received a copy. This is practical recordkeeping, not a formal chain-of-custody protocol.
  4. Label any edited version as a derivative. If you need a shorter clip to explain the footage, make a separate copy for that purpose and retain the unedited original.
  5. Share thoughtfully. Consider privacy, safety, and possible case concerns before posting footage publicly. The ACLU recommends sharing documentation with the affected person’s loved ones or attorney so they can decide whether and when to share it. ACLU recording guidance.

How to document injuries and witness accounts

If you are injured, seek medical care. When it is safe and appropriate, photograph injuries and keep records related to treatment; note when and where you received care. Photographs and medical records can help preserve details that may change over time. ACLU documentation guidance.

Write down witness contact details and, if they choose, ask witnesses to preserve their own original recordings and share them with you or your lawyer. Do not pressure anyone to provide a statement or recording.

Where to take a complaint or legal concern

The appropriate channel depends on what happened and where. The ACLU recommends documenting the encounter, collecting witness contact information, and submitting a written complaint to the agency’s internal affairs division or a civilian complaint board; anonymous complaints may be possible in many cases. Check the relevant agency or local board’s current instructions rather than assuming one process applies everywhere. ACLU complaint guidance.

The U.S. Department of Justice describes federal laws covering certain categories of law-enforcement misconduct and provides information on DOJ complaints. If a complaint or legal claim may follow, contact a local attorney or civil-rights organization promptly. Deadlines, recording rules, evidence requests, and preservation procedures depend on the jurisdiction and circumstances; the sources cited here do not establish one universal deadline or records-request process.

What agency-camera policies do—and do not—tell you

Federal guidance on body-worn-camera programs discusses agency practices such as informing subjects about recording, handling state-law consent differences, and keeping an activated camera running through an encounter, with stated exceptions. A DOJ consent decree for specified LAPD investigations requires collection and preservation of appropriate evidence, including canvassing for witnesses where appropriate and subject to applicable state law.
