Start by preserving evidence, identifying what kind of use occurred, and checking the law or contract that actually applies to you. In the United States, there is no single rule that automatically resolves every AI-generated voice clone, face replacement, or other digital replica. State right-of-publicity, privacy, reputation, consumer-protection and contract rules can overlap, while satire, criticism, news, biography, documentary and educational uses may receive First Amendment protection. The practical response is therefore fact-specific: document the material, assess the purpose and audience, use available platform or contract procedures, and obtain advice from a lawyer who handles the relevant state and claim type when the stakes are significant.
What counts as an AI voice or likeness replica?
A digital replica is generated or manipulated material that realistically but falsely depicts a real person. It can reproduce a voice, face, body, gestures or a combination of them. A synthetic recording that makes a person appear to endorse a product, a video that puts their face on another body, and an audio clip that makes them appear to say words they never spoke can all raise the same core question: was the person’s identity used without permission, and what legal interest does that use affect?

The technology does not determine the legal result by itself. A convincing clone used in a paid advertisement presents different issues from a parody posted as commentary. A fictional game character that merely resembles a public figure presents different issues from a clip that names the person and sends viewers to a product checkout page. The relevant facts include the degree of resemblance, whether the audience is likely to believe the person participated, the purpose of the use, where it appeared, and whether the person consented through a contract or license.
Why the United States has no one-step answer
Right-of-publicity protection is principally state-based. The scope, duration and available remedies can differ by state, and some states recognize post-mortem rights for heirs while others do not or protect them differently. Other legal theories may matter at the same time:

- Read Before You Buy — No Video Output: These adapters support charging and USB 2.0 data transfer, but cannot transmit video signals. Except for standard USB webcams (which use USB data only), they are not compatible with HDMI/DisplayPort cables, video-capable USB-C hubs, or docking stations with video output.
- Convert USB-A Ports to USB-C: Designed to connect USB-C earphones, cables, flash drives, card readers, and other USB-C accessories to standard USB-A ports. Plug-and-play with no drivers or software required.
- Aluminum Alloy Housing: Built with a sturdy aluminum alloy shell that aids in heat dissipation and protects against daily wear and scratches. Designed to maintain a stable and secure connection.
- Compact & Travel-Friendly: The ultra-compact design allows the adapter to stay plugged into your device without blocking adjacent ports or adding bulk, reducing wear and tear on your original USB ports.
- 12-Month Warranty: Backed by a 12-month manufacturer warranty for peace of mind. Designed to meet strict quality control standards for reliable everyday performance.
- Privacy: a use may implicate intrusion, disclosure or other privacy interests depending on the facts and jurisdiction.
- Reputation: fabricated speech or conduct can create defamation or related reputation issues if it is presented as fact and causes legally recognized harm.
- Consumer protection and false association: commercial material that implies a person endorsed a product, service or campaign can raise misleading-advertising or source-confusion questions.
- Contract: an employment, talent, licensing or collective-bargaining agreement may define what uses are permitted and what consent or payment is required.
These categories are issue-spotting tools, not guarantees of liability. A court may also weigh the creator’s expressive interests. Satire, parody, criticism, commentary, biography, documentary, newsworthy work and educational material can receive First Amendment protection. An unauthorized depiction is therefore not automatically unlawful merely because artificial intelligence was used.
How to stop an unauthorized clone: an evidence-first response
The sources available for this subject do not establish a universal takedown process that guarantees removal or compensation. You can still take disciplined steps that preserve options while the facts are fresh.
1. Capture the material before it changes
- Save the complete URL, the account or channel name, and the date and time you found the content.
- Take screenshots showing the post, caption, comments, view count, advertisements and any profile information that ties the material to its uploader.
- Download or otherwise preserve the audio or video in its original available format. Keep an untouched copy and a working copy for analysis.
- Record messages, emails, invoices, casting notices, licensing terms or other documents that might show consent, lack of consent, payment or a promised limitation.
- Note who appears to be targeted, what the replica says or depicts, who can see it, and whether it is being sold, boosted or used to collect personal information.
This documentation is practical evidence preservation, not a statutory filing requirement. Avoid editing the only copy, contacting the uploader in a way that could cause deletion before you preserve it, or publicly accusing a person before you know who created or distributed the material.

- an advertisement, endorsement, sponsorship or other commercial promotion;
- an impersonation intended to deceive people about an account, payment request or statement;
- defamatory or likely to cause professional, financial or personal harm;
- sexually explicit or intimate;
- news reporting, documentary, biography, criticism, parody or satire;
- an entertainment or game project using a performer under a contract; or
- a private message or limited-distribution work rather than a public post.
The classification does not decide the case. It helps a lawyer, platform reviewer or contracting party understand which facts may control the analysis.
3. Check the platform’s current reporting route
Use the service’s official help or reporting instructions as they exist when you act. Select the most accurate category—such as impersonation, privacy, deceptive commercial content, harassment or intimate material—and attach concise evidence. Policies and forms change, so do not rely on an old screenshot of a reporting page or assume that a copyright form is the right route for a voice or likeness claim. Keep copies of your submission, confirmation number and every response.
A platform may remove content under its policy even when a court would reach a different legal result, or it may decline removal because the material is expressive. A rejection is not a definitive ruling on your underlying rights.
4. Notify the relevant employer, licensee or union representative
If the replica concerns a production, game, advertisement or other project, review the agreement and send notice through the contract’s designated contact. A performer may also have a union or employment procedure. State exactly what use you authorized, what use you did not authorize, and what remedy the agreement specifies. Do not assume that a general appearance release automatically covers every synthetic use; read the language governing voice, image, digital replicas, media, duration and reuse.

5. Get jurisdiction-specific legal advice when the consequences matter
Consult an attorney familiar with the state involved and with publicity, privacy, impersonation, reputation or performer-contract disputes when the material affects income, safety, employment, a major release or an ongoing scam. Bring the preserved files, timeline, account information and relevant agreements. State law varies, and the U.S. Copyright Office has identified gaps in existing federal protections. A lawyer can assess possible claims, demand letters, emergency relief, subpoenas or negotiations without promising that any particular remedy will succeed.
Commercial use, impersonation and expressive use
Commercial promotion and false endorsement
An advertisement that uses a recognizable voice or face to suggest sponsorship can be more legally sensitive than a news story because it links identity to a sale. Look for a call to action, product placement, affiliate link, paid boost, brand account, fabricated testimonial or language such as “I recommend.” Preserve evidence of the commercial connection, including the landing page and any disclosure. The central questions may include whether viewers would believe the person participated, whether the use is likely to confuse the source of the endorsement, and what state and federal consumer-protection rules apply.
Fraudulent impersonation
A clone used to request money, credentials, account access or urgent action can create immediate safety and financial risks. Warn affected contacts through a trusted channel, secure compromised accounts, and report the material to the service involved. Keep records of payment instructions, phone numbers, wallet addresses and timestamps. The legal theory may involve fraud, identity misuse, consumer protection or other offenses in addition to publicity or privacy rights. Do not send money to an impersonator in an attempt to “test” the clone.

Defamatory or harmful fabricated statements
Determine whether the audience could reasonably understand the clip as a factual statement about you, rather than obvious fiction, parody or commentary. Record the exact words, context and distribution. Defamation law includes publication, fault, meaning and damages requirements that vary by jurisdiction; a synthetic voice alone does not eliminate those requirements.

Satire, parody, criticism and reporting
Expressive uses can be protected even when they are unauthorized and unflattering. Context matters: labels, surrounding commentary, editing, the target of the joke, the audience and whether the work is reporting or selling something can all affect the analysis. A takedown request can still be made, but neither the request nor the fact that AI was used proves that removal is legally required.
What performers should check before signing
For performers covered by applicable SAG-AFTRA agreements, union materials describe consent provisions that must be clear and conspicuous and identify how a digital replica will be used and the specific medium. The same materials explain that a new use or different project can require consent again and payment under the applicable contract terms, and that conflicting voucher language does not override those protections. These statements are contract- and coverage-specific; they are not a universal rule for every performer, employer, creator or licensing deal.
Before signing any agreement that involves synthetic performance, ask the contracting party to answer these questions in the document itself:

- Which project, character, campaign or episode is covered?
- In which media and territories may the replica appear?
- How long does the permission last, and does it survive termination?
- What compensation applies to the initial use, later episodes, training, localization, advertising and other reuse?
- Can the permission be transferred, sublicensed or assigned to another company?
- What approval, notice or renewed-consent process applies to a new use, a different medium or a materially changed performance?
- What happens to stored files, models, embeddings and derivative outputs when the project ends?
These are practical questions to negotiate, not an exhaustive legal test. Have counsel or your union review language that is ambiguous, perpetual, transferable or broad enough to cover uses you did not intend.

Federal developments and what they do—and do not—mean
On July 31, 2024, the U.S. Copyright Office announced its Part 1 digital-replica report after reviewing more than 10,000 responsive comments to its artificial-intelligence notice of inquiry. The report addressed videos, images and audio digitally created or manipulated to realistically but falsely depict an individual. It concluded that existing protections have gaps and recommended federal legislation covering the knowing distribution of unauthorized digital replicas.
“Given the gaps in existing legal protections, the Office recommends that Congress enact a new federal law that protects all individuals from the knowing distribution of unauthorized digital replicas.” — U.S. Copyright Office, July 31, 2024 announcement
That recommendation is not itself a law. The retrieved text of the NO FAKES Act of 2025 identifies S. 1367 as introduced in the Senate on April 9, 2025 and referred to the Senate Judiciary Committee. Introduction and referral do not mean enactment. Bill status, state statutes and agency guidance can change, so verify the current position before relying on any legislative summary.

| Situation | Primary questions | Possible first steps |
|---|---|---|
| Paid advertisement or endorsement | Is the use commercial, and would it imply sponsorship or approval? | Preserve the ad and landing page; report deceptive or impersonating content; review publicity, consumer-protection and contract options. |
| Scam or account impersonation | Is someone seeking money, credentials or access while posing as you? | Warn contacts, secure accounts, report the account and preserve payment and message records. |
| Defamatory fabricated statement | Would a reasonable audience read it as a factual claim, and what harm followed? | Preserve exact wording and distribution; obtain advice on jurisdiction-specific reputation claims. |
| Film, documentary, game or commentary | Is the work expressive, newsworthy, satirical, critical or educational? | Assess First Amendment concerns before demanding removal; a lawyer can weigh context and any commercial tie-in. |
| Contracted performance | What did the agreement authorize, for which medium and period? | Compare the actual use with the consent language; use the agreement’s notice, grievance or payment procedure. |
| Replica of a deceased person | Does the relevant state recognize a post-mortem publicity right, and who may enforce it? | Identify the governing state and estate authority; preserve the use and seek advice before acting. |
The table is a triage framework, not a prediction. The same content can fit more than one row, and the applicable state, contract, audience and evidence can change the result.
Common mistakes that weaken a response
- Assuming AI makes every use illegal: expressive and newsworthy uses may raise constitutional protections.
- Relying on a single nationwide rule: publicity and related claims are heavily dependent on state law and facts.
- Ignoring the contract: a release, employment agreement or collective-bargaining agreement may control consent, payment and reuse.
- Waiting to save evidence: posts can be edited, deleted, geo-blocked or moved to another account.
- Using the wrong platform form: a copyright complaint may not address impersonation or publicity concerns, and an impersonation report may not resolve a contract dispute.
- Overstating certainty publicly: accusing a named person without reliable evidence can create additional legal and safety problems.
- Assuming a takedown equals a legal judgment: platform policy decisions and court decisions answer different questions.
A compact incident checklist
- Preserve the original URL, files, screenshots, dates, account details and messages.
- Describe the use: commercial, impersonating, defamatory, explicit, expressive or contract-related.
- List any consent, release, license, union term or employment agreement that may apply.
- Report through the platform’s current official process and save the ticket or confirmation.
- Notify the relevant employer, licensee, union or security team if the project or account is connected to one.
- Protect accounts and warn affected contacts if fraud or credential theft is involved.
- Obtain advice from counsel familiar with the governing jurisdiction and claim type when the impact is material.
Limits of what can be promised
No general guide can promise removal, damages, an injunction or a particular settlement. The cited U.S. sources do not provide one universal incident-response procedure, and the legal landscape continues to develop. Your strongest next step depends on the evidence, the purpose and audience of the replica, the applicable state, the person’s living or deceased status, and the exact wording of any agreement. Treat platform instructions, statutes, bill status and contract terms as current documents to verify—not assumptions to carry forward from an older incident.
