There is no reliable way to guarantee a recorded bhajan will avoid a YouTube copyright claim or live interruption. India’s Copyright Act includes a limited exception for music used in the course of a bona fide religious ceremony, but that does not automatically clear every devotional livestream or its replay. The safer practical route is to get permission for the specific recording and online use, ask the relevant rights owner to allowlist your channel in Content ID, and be ready to stop playback if YouTube detects a match.
Does India’s religious-ceremony exception cover a YouTube livestream?
Section 52(1)(za) of the Copyright Act, 1957, describes an exception for the performance of a musical work, or communication to the public of a musical work or sound recording, in the course of a bona fide religious ceremony. The Copyright Office’s official exceptions page, last updated 16 July 2026, gives the statutory wording: Exceptions to infringement under the Copyright Act, 1957.
The phrase “in the course of” matters. The provision is not a blanket exemption for any devotional programme, any track described as a bhajan, or indefinite online availability after an event. The official text does not explain whether a particular online transmission, a replay that remains available afterward, or a devotional programme that is not legally a bona fide religious ceremony qualifies. Those applications should be treated as unresolved, not assumed in your favor.
A legal exception and YouTube’s automated copyright systems are also separate issues. A Content ID claim or live interruption is not a final court ruling on whether a particular use infringes; YouTube says it does not decide ownership disputes. But the possibility of a legal defense does not stop automated detection or guarantee that a stream stays up.

Why a bhajan can still trigger a claim or interrupt a live stream
YouTube scans live streams for third-party matches
YouTube says every live stream is scanned for matches to third-party content, including another live broadcast. If it identifies such content, YouTube may replace the stream with a placeholder image and warn the streamer to stop using it. If the content continues, the stream may be interrupted or terminated. A copyright strike can also end a live stream. See YouTube’s guidance on copyright issues with live streams.
An archived replay can receive a claim afterward
If you archive the livestream, YouTube says Content ID claims are made after the live stream is complete. A stream that ran to the end without interruption is therefore not automatically cleared for its replay. Decide in advance whether you need the archive and how you will respond if a claim arrives.

“Bhajan” does not identify who owns the recording
Rights can exist in both the composition and the particular sound recording. YouTube explains that record labels commonly hold master-use rights, while publishers and collecting societies may administer composition rights and public-performance licensing. A singer’s or devotional group’s permission should not be assumed to cover a commercially released recording or all the rights needed for your use. See YouTube’s overview of music rights management.
How to reduce the risk before going live
- Identify the exact track and recording. Record the title, performer, album or release, and where you obtained the file. An old or traditional composition does not by itself establish that a modern recording is free to use.
- Confirm who controls the relevant rights. Ask about the composition and the specific master recording. If different parties control them, determine whether you need permission from both.
- Get permission that matches your intended use. Request written permission for the exact recording and for a live online transmission. If you want to keep the replay, ask whether the permission also covers the archived video, including its territory and duration.
- Ask the rights owner to allowlist your channel. YouTube recommends that creators with a licence ask the content owner to add their channel to the Content ID allowlist. Do this before the event and retain the owner’s confirmation. YouTube warns that a licensed stream can still be interrupted without allowlisting, even if the licence limits territories.
- Prepare a response if a match appears. Have a replacement track or a way to stop playback promptly. If YouTube warns you to stop using detected content, continuing it can put the stream at risk.
- Choose what to do with the replay. If an archive is not essential, consider whether to disable it. If you keep it, understand that it can receive a Content ID claim after the live stream has ended.
Keep the permission and allowlist confirmation accessible during the event. These steps reduce risk; they do not guarantee a claim-free stream.

What other music-use options do—and do not—guarantee
YouTube lists permission, Creative Commons material used according to its terms, copyright exceptions such as fair dealing, public-domain material, and YouTube Audio Library or Creator Music as possible safer-use paths. It explicitly warns that none guarantees avoiding a copyright issue such as a claim or strike. See YouTube’s copyright guidance.
Do not rely on U.S. “fair use” explanations as the test for a stream in India. YouTube notes that copyright rules vary by country; for a specific disputed use or interpretation of Section 52(1)(za), seek India-specific legal advice.

If YouTube detects the bhajan during your event
- You see a warning or placeholder: Stop the detected track or switch to a track for which you have the necessary permission. YouTube says a stream can be interrupted or terminated if the content remains.
- You have a licence but the stream is interrupted: Check whether the relevant content owner actually allowlisted your channel. YouTube says licensing alone does not prevent interruption when a channel is not allowlisted.
- The live event ends, then a claim appears: Review the claim and the scope of your written permission. YouTube says archive claims may be made after the stream is complete; an uninterrupted live event is not clearance for the replay.
- You believe the claim is mistaken: Use YouTube’s available dispute process only if you have a genuine basis, such as rights or permission that applies to the exact material and use. A platform claim is not a court decision, but a dispute is not a substitute for obtaining missing rights.
