In the United States, emulator software is not automatically illegal, and owning a game does not automatically make every ROM or download lawful. The legal questions differ depending on what was copied, how it was obtained, whether it was shared, and whether copy protection was bypassed. A Ninth Circuit decision upheld particular intermediate copying during emulator development; it did not authorize copying or distributing games generally. Separately, the DMCA can restrict circumvention of technological measures.
What does “emulation” mean, legally?
An emulator is software that imitates the behavior of another device so software made for that device can run elsewhere. That description alone does not settle whether a particular emulator’s development, distribution, or use infringes copyright. Those questions depend on the code and other material involved, what acts were performed, and the circumstances.
It helps to keep four things distinct: the emulator program, a console’s BIOS or firmware, the game itself, and any keys or tools used to access protected material. Copying one does not automatically have the same legal analysis as copying another.
Does owning a game make downloading its ROM legal?
Not automatically. A ROM is a copy of game software. Owning a physical cartridge does not, by itself, establish that a particular downloaded file was authorized or that its copying and distribution are lawful. The cited emulator case does not approve ROM sites or decide every personal-backup scenario.

The relevant facts can include the source of the file, who made the copy, whether it was shared, and whether an exception applies. The available sources do not establish a universal rule that downloading a ROM is lawful whenever the user owns the game—or that every personal copy is unlawful. Treat the legality of possessing the original and the legality of obtaining or making a separate file as separate questions.
What did the Sony v. Connectix decision actually decide?
The specific holding
In Sony Computer Entertainment, Inc. v. Connectix Corp., 203 F.3d 596 (9th Cir. 2000), Connectix made intermediate copies of Sony’s PlayStation BIOS while reverse engineering the system to develop its Virtual Game Station emulator. The Ninth Circuit concluded that the intermediate copying at issue was fair use in those circumstances. Read the Ninth Circuit opinion.

What it does not establish
The decision supports the narrower point that making an emulator is not automatically copyright infringement. It is not blanket permission to copy protected code into any emulator, distribute BIOS or firmware, or distribute game files. Nor does it make all reverse engineering lawful. Fair use depends on the facts, and this is a Ninth Circuit appellate decision—not a nationwide Supreme Court ruling. Other U.S. jurisdictions and other countries may apply different law.
How does the DMCA change the analysis?
Copyright infringement and circumvention of copy protection are distinct legal questions. The U.S. Copyright Office explains: “The DMCA, codified in part in Title 17, section 1201, of the United States Code, generally makes it unlawful to circumvent technological measures used to prevent unauthorized access to copyrighted works, including copyrighted books, movies, videos, video games, and computer software.” The Copyright Office’s Section 1201 explanation describes the 2024 rulemaking cycle.

Section 1201 has separate prohibitions, exceptions, and exemptions. The analysis can depend on what the measure controls or protects, what act occurred, and whether a current exemption applies. The Copyright Office publishes exemptions with specific wording and conditions; they are not a general license for emulation or personal backups. See the current text of the triennial exemptions and Title 17, Chapter 12, including Section 1201. Owning a game should not be treated as an automatic exception to the anti-circumvention rules.
How do common emulation scenarios differ?

What does the 2024 Yuzu case mean?
Nintendo sued Tropic Haze, the company behind Yuzu. The case ended on March 4, 2024, with a consent judgment and permanent injunction that included provisions concerning Yuzu and circumvention materials. The result binds the parties and other persons covered by the order as specified in it; it was not a trial or appellate ruling that all emulators are unlawful. Read the judgment and injunction.

The outcome is relevant to the specific dispute and the conduct addressed in the order, including Switch keys and tools. It does not replace the fact-specific analysis for a different emulator, developer, or user.

What facts matter when assessing a particular case?
- What material is involved? Emulator code, BIOS or firmware, a game file, and keys are not interchangeable categories.
- What was copied and why? Temporary copying to study functional aspects during development differs from distributing a playable copy.
- Was protection bypassed? Analyze potential Section 1201 liability separately from copyright infringement, and check whether an exemption covers the exact activity.
- Where did the file come from, and where did it go? An original, a copy made by the user, an online download, and public sharing present different facts.
- Where did the conduct occur? The key case discussed here is Ninth Circuit authority. U.S. law outside that circuit and law in other countries may differ.
