Using an aimbot in Fortnite is against Epic Games’ rules, and Epic can ban or suspend the account. Whether it is also illegal under public law depends on where you are and what happened: violating a game’s rules does not automatically mean a crime has been committed.
What does “illegal” mean here?
There are two separate questions: whether Epic permits aimbots in Fortnite, and whether using one violates a law. The answer to the first is clear: Epic prohibits cheating and software used to gain an unfair advantage. The second depends on the jurisdiction and the facts, so it is not accurate to say that every person who uses an aimbot has committed a crime.
Epic’s Terms of Service include a North Carolina governing-law provision for many disputes between Epic and users, except where applicable law requires otherwise. Why an aimbot violates Fortnite’s rules
An aimbot automates or improves aiming to give its user an advantage. Epic’s Terms of Service and Community Rules prohibit cheating and unauthorized software used to gain an advantage. Epic says it does not officially support third-party software and advises players to use it at their own risk. What can Epic do?

In its Fortnite anti-cheat announcement, Epic stated: “Illegal conduct that breaks our rules will result in a ban at minimum, and may also involve legal repercussions and the loss of money made from these offenses.” This is Epic’s warning about its enforcement position; it does not establish that every aimbot user has committed a crime. It can lead to legal action in particular circumstances, but that is different from saying every user faces the same legal outcome. In 2017, Epic filed a complaint in U.S. federal court against Mason Foret alleging copyright infringement and breach of contract connected with a Fortnite aimbot. What to do if you are concerned about your account or legal exposure
- Do not use or continue using an aimbot or other cheating software in Fortnite.
- For an account sanction, consult Epic’s account-ban information and the appeal options available for your account.
- If you have received legal papers or face an actual legal dispute, seek advice from a lawyer qualified in your jurisdiction. The outcome depends on local law and the specific conduct involved.
