The claim deadline was January 4, 2021, so players cannot file a new claim through this settlement.
What the Big Fish Games lawsuit alleged
The related cases, Kater v. Churchill Downs, Inc. and Thimmegowda v. Big Fish Games, Inc., alleged that the defendants violated Washington gambling laws and the Washington Consumer Protection Act by selling virtual chips in Big Fish Casino, Jackpot Magic Slots, and Epic Diamond Slots. The defendants denied the allegations and denied violating any law. The parties settled to avoid the uncertainty and expense of continued litigation; the court did not decide the merits of the underlying claims. Read the court-authorized settlement notice.
The case concerned the virtual chips and games named in the lawsuits. It was not a ruling that all social-casino games are illegal gambling, nor was the settlement an admission of wrongdoing or a judgment that the defendants were liable.
What the judge approved
On February 11, 2021, the U.S. District Court for the Western District of Washington granted final approval, confirmed the settlement class, and dismissed the actions with prejudice under the settlement terms. The court wrote: “The Court hereby grants final approval to the Settlement and finds that the Settlement is, in all respects, fair, reasonable, and adequate, and in the best interests of the Settlement Class.” That finding concerned the settlement’s fairness, not whether the defendants had violated gambling or consumer-protection laws. Who the settlement class covered
The approved class generally included people in the United States who played Big Fish Casino, Jackpot Magic Slots, or Epic Diamond Slots on or before preliminary approval of the settlement. The definition included exclusions, such as the defendants and related entities and people who properly and timely opted out. It did not encompass all customers of online gambling services. The official notice sets out the class definition and exclusions.

How much the settlement was worth—and how payments were determined
The settlement fund totaled $155 million. It covered valid class-member payments as well as notice and administration costs, court-awarded attorneys’ fees and costs, and incentive awards for class representatives. Churchill Downs reported contributing $124 million and Aristocrat contributing $31 million in a company filing. The court-authorized notice describes the fund and payment terms; Churchill Downs’ filing confirms the contribution split and approval date.
The notice did not promise an equal or predetermined payment to each eligible player. An individual’s share depended in part on spending on in-game purchases in the three games, whether the claim might be subject to a dispute-resolution provision in Big Fish Games’ Terms of Use, and the number of valid claims. The full $155 million did not go directly to players.

Can you still submit a claim?
No. The official notice required valid claim forms to be submitted by January 4, 2021. It stated that filing a timely, properly completed claim was the only way to receive a settlement payment. That deadline has passed, and this settlement is not a current claims opportunity. The official notice gives the expired deadline and claim requirement.

Under the settlement’s historical terms, a class member who did not opt out was bound by the settlement and released the claims covered by it, even without filing a payment claim. Opting out meant no settlement payment but could preserve the right to pursue released claims. Objecting meant asking the court to reject the proposed settlement while remaining in the class. Those were options tied to deadlines that have passed; they are not available now.
