New York Attorney General Letitia James filed a state enforcement lawsuit against Valve on February 25, 2026, alleging that paid randomized loot boxes in Counter-Strike 2, Team Fortress 2 and Dota 2 amount to illegal gambling under New York law. Valve disputes that interpretation. The complaint is an allegation, and Valve’s request to dismiss is a legal argument—not a court ruling.
The central dispute is whether paying for a random chance at a virtual item counts as gambling when, as Valve argues, every buyer receives an item and those items are not “something of value” under the relevant statute.
What did New York sue Valve over?
The People of the State of New York, acting through the Attorney General, brought the case in New York County. It is a government enforcement action, not a private consumer class action. The complaint invokes New York Executive Law § 63(12) and alleges violations connected to the state’s gambling laws.
The lawsuit concerns paid loot-box features in Valve games, including Counter-Strike 2, Team Fortress 2 and Dota 2. New York’s complaint describes a buyer paying for a chance to receive a randomized virtual item. Why does New York say the loot boxes are gambling?
The State alleges that some rare virtual items have monetary value and can be exchanged for money, even though the items are cosmetic and do not change gameplay. Its case therefore turns not simply on whether an item affects play, but on whether a paid random outcome can produce something of value under the applicable law.
In a 2026 press release, Attorney General James said that one virtual item had “reportedly” sold for more than $1 million. That is the OAG’s characterization; the sale and price have not been independently verified here. James also said: “Illegal gambling can be harmful and lead to serious addiction problems, especially for our young people,” and described Valve’s features as “addictive, harmful, and illegal.” Those are the plaintiff’s public claims, not findings by a judge. No independent population-level statistic or study is established by the materials available for this article.

How does Valve respond?
In a May 18, 2026 memorandum supporting dismissal, Valve argues that a mystery-box buyer receives an item with each purchase, so the transaction does not involve the stake or risk required for illegal gambling. Valve also argues that the items do not count as “something of value” under the relevant statute.
Valve’s filing compares digital mystery boxes to baseball-card packs and other collectibles: in its view, people may enjoy the surprise of opening a pack, and the virtual items are aesthetic rather than gameplay-affecting. That analogy is part of Valve’s defense, not a court’s conclusion.

Has the court ruled, and what does the October 5 hearing mean?
No ruling on Valve’s motion is established by the information available for this article.
