Nintendo won its French case against Dstorage, the operator of the 1fichier file-hosting service, with a reported €935,000 damages award left in place after an appeal. The result is a notable outcome in Nintendo’s fight against unauthorized game sharing, but the available reporting does not establish a universal rule that file hosts are automatically liable for users’ uploads.
What was Nintendo’s case against 1fichier?
The dispute concerned Dstorage, which operated 1fichier, a file-hosting service. It was a French case about hosting and sharing content, not Nintendo’s separate actions involving a U.S. SwitchPirates moderator or circumvention devices in the Netherlands.
HotHardware reported on March 7, 2025, that the Judicial Court of Paris ordered Dstorage to pay Nintendo €935,000 in damages in 2021. The report says Dstorage appealed through France’s highest court and lost, leaving the damages award in place. The original judgments and exact dates in the appeal chain are not available in that reporting, so the amount and procedural history should be understood as reported by a secondary source, not independently confirmed from court documents. What did Nintendo say about the outcome?
In a corporate statement quoted by HotHardware, Nintendo said “the French Supreme Court leaves no doubt that sharehosting providers like 1fichier.com are not a safe haven for storing and sharing illegal content.” The statement was not attributed to a named Nintendo representative, and it is Nintendo’s characterization—not wording verified from the court’s judgment.

Nintendo also argued that pirating its games “increases the risk that this will interfere with the functionality and experience that playing legitimate Nintendo games on authentic Nintendo hardware provides.” That is the company’s stated position; the reporting does not establish it as a court finding or an independently demonstrated causal conclusion.
Does the decision make file-hosting services automatically liable?
That conclusion is not established by the available account. It reports the result in one French dispute, but does not provide the judgments’ reasoning, the precise legal test applied, or a definitive account of the ruling’s precedential scope. The decision should not be treated as proof that every hosting service is liable whenever a user uploads infringing material, or that the same damages or outcome would follow in another case.
