Nintendo’s Arbitration Terms: What the 2025 and 2026 Agreements Say

Nintendo has separate dispute-resolution terms for Nintendo Accounts, Switch 2, and purchases. Their dates, scope, exceptions, and opt-out procedures differ.

Can Nintendo stop you from filing a lawsuit? Its agreements require individual arbitration for covered disputes in applicable jurisdictions, but they also include exceptions and opt-out procedures. The terms do not establish that every lawsuit is barred or that a court would enforce a clause in a particular case. The documents also have different dates and scopes: Nintendo Account User Agreement changes took effect in May 2025, Purchase and Subscription Terms were updated in August 2026, and the Switch 2 User Agreement is effective September 2026.

These are separate updates, not one new EULA amendment

Nintendo has made changes to more than one agreement. Its official change summary identifies May 2025 changes to the Nintendo Account User Agreement, including Section 16 dispute-resolution terms. Separately, Nintendo’s Purchase and Subscription Terms were updated in August 2026, and the Switch 2 User Agreement has a September 2026 effective date.

These documents should not be treated as interchangeable: they address different services or transactions and use different section numbers. Nintendo says its summaries are not comprehensive and are not a substitute for reading the full applicable terms; see its official EULA update summary.

What Section 7 of the Switch 2 agreement says

Section 7 of the Switch 2 User Agreement is titled “Dispute Resolution; Binding Individual Arbitration; Class Action Waiver.” Nintendo’s text states: “This arbitration provision precludes you and Nintendo from suing in court, having a trial by jury, or participating in a class action.” That is contractual language describing Nintendo’s position in the agreement, not a court ruling about whether the clause applies or can be enforced in a particular dispute.

The section does not apply, under its stated terms, to residents of Argentina, Brazil, Chile, Colombia, Costa Rica, Mexico, Peru, Quebec, and Uruguay, or where applicable law prohibits it. It also provides an opt-out procedure in Section 7(J). Those are the agreement’s stated limits, not a complete account of every consumer-protection rule that might apply.

What happens before arbitration

The Switch 2 terms describe a sequence rather than an immediate requirement to file with an arbitrator:

  1. Attempt informal dispute resolution. The agreement says the parties must try to resolve a dispute informally before arbitration.
  2. Proceed to individual arbitration if unresolved. For claims covered by Section 7, the agreement provides for binding individual arbitration and identifies procedures from arbitration providers.
  3. Follow coordinated-filing procedures when applicable. The terms set out processes for coordinated filings. They also say courts may enforce bellwether and mediation processes and enjoin filings that do not comply.

The May 2025 Nintendo Account User Agreement update also includes an informal-resolution requirement and procedures for coordinated filings in Section 16. The Purchase and Subscription Terms have a separate Section 12, with their own dispute-resolution language, exceptions, and opt-out process.

How the opt-out and exceptions affect you

For the Switch 2 agreement, the opt-out procedure is in Section 7(J). The Purchase and Subscription Terms likewise describe an opt-out process in their Section 12. The exact steps and any deadline are governed by the specific agreement; consult that section in the version applicable to your account or transaction rather than assuming one document’s process applies to another.

If you are considering whether a claim is covered, first identify which agreement applies, then check its effective date, dispute-resolution section, geographic exclusions, and opt-out language. Whether an arbitration clause is enforceable or applies to a particular claim is a separate legal question that these contract terms alone do not answer.
