Spyder Games LLC and Speedy Simulator Gaming LLC sued Fortnite Creative creator Thomas van der Voort, alleging that his map “Stealing Brainrots” copied protected elements of their Roblox game Steal a Brainrot. The complaint was filed October 23, 2025, in the U.S. District Court for the Northern District of California. It is a set of allegations, not a court finding.
What the lawsuit alleges
The complaint identifies Spyder Games LLC, a Louisiana limited liability company, and Speedy Simulator Gaming LLC, a Wyoming limited liability company, as plaintiffs. It names Thomas van der Voort as the defendant and says he was located in the United Arab Emirates. The case is numbered 3:25-cv-09122 and was filed in the court’s San Francisco Division. The complaint asserts copyright infringement and alleges that the plaintiffs own or control Steal a Brainrot.
According to the filing, van der Voort published a Fortnite Creative map called “Stealing Brainrots” on July 5, 2025. The complaint gives its map code as 3225-0366-8885. The plaintiffs contend that the map reproduced protectable expression from their game, including interface elements, in-game objects, artwork, level design, animations, design aesthetics, game pieces, and the selection and coordination of elements.
The plaintiffs say the alleged similarities go beyond what genre conventions or functional needs would explain. The complaint states: “The similarities are not merely the result of the games existing in the same genre or dictated by function.” That is the plaintiffs’ position in the filing; no court conclusion on the similarity or infringement question is established here. The complaint also characterizes the alleged infringement as willful, another claim rather than a finding.

What the plaintiffs are asking for
The complaint seeks actual damages, profits it attributes to the alleged infringement, fees, interest, and injunctive relief. These are requested remedies, not awards: the filing does not establish that the plaintiffs received money or an order restricting the map.
The filing also says Fortnite’s creator platform allows creators to receive engagement payouts. It does not establish that van der Voort earned a particular amount, so the platform’s payout system should not be mistaken for evidence of earnings in this case.

Did Fortnite or Epic Games get sued?
No. The complaint names Thomas van der Voort as defendant, not Fortnite or Epic Games. The dispute described in the filing concerns an experience made by a creator using Fortnite Creative; it is not a lawsuit naming Epic as a party.

Spyder Games and Speedy Simulator Gaming’s October 23, 2025 complaint says Steal a Brainrot had more than 5.95 billion plays and reached a peak of more than 20 million concurrent users. Those are figures asserted by the plaintiffs in a legal pleading, not independently verified current Roblox statistics. PC Gamer’s contemporary report also covered the dispute, but the figures should still be understood as claims made in the complaint.
