Instead, the Commission said it would begin an exchange with industry and consumer representatives by the end of 2026, with the aim of drawing up an industry code of conduct for managing games at end of life. It also pointed to awareness and enforcement work around existing consumer rights. A code of conduct is not the same as a new binding EU rule requiring every publisher to preserve or convert every game.
Why are game publishers opposing the initiative?
Video Games Europe, the trade association representing Europe’s video game industry, set out its opposition in a statement dated 4 July 2025. It argued that ending online services must remain an option when an online experience is no longer commercially viable, and said companies give fair notice in line with local consumer-protection laws. The association’s position is that keeping a service running or adapting it for continued play can raise practical and legal problems; these are its arguments, not findings established by the Commission.

Service costs and technical dependencies
In its longer position paper, Video Games Europe said the proposal appeared to combine ongoing-service requirements with an end-of-life approach that could enable private servers. It argued that some online games depend on complex server systems and that adapting them for continued play could be prohibitively expensive or technically difficult. The association also said such requirements could limit developers’ choices about how to build and operate games. Video Games Europe statement, 4 July 2025 · Video Games Europe position paper.

The association raised concerns about player safety, data protection and moderation if private servers replace official services. It also cited potential rights-holder liability, intellectual-property rights and third-party licences as complications. Those concerns reflect the industry association’s case against the proposal; they do not establish that community servers would necessarily be unsafe or legally impossible.

What do supporters want to protect?
The campaign’s central concern is what happens to access when a publisher stops commercial support for a game. Its requested rules aim to prevent a game from becoming unplayable simply because its official service ends. The dispute is not only about whether a server stays online: it also concerns whether publishers should have to plan for end of life, what form a playable alternative could take, and who would be responsible for operating it.

The main points of disagreement are:
- Player access: Supporters emphasize continued play after a shutdown; the industry association argues that companies must be able to discontinue services that are no longer commercially viable.
- Mandatory rules or voluntary practice: The initiative sought rules, while the Commission’s proposed next step is engagement aimed at an industry code of conduct rather than a binding keep-playable obligation.
- Feasibility: Supporters seek an end-of-life solution; Video Games Europe says engineering work, server dependencies and licensing can make conversion or continued operation difficult or disproportionate.
- Responsibility for community servers: The association points to safety, data protection, moderation and liability risks if private servers take over from official services.
Do existing EU consumer rights cover game shutdowns?
The Commission says existing EU consumer law already provides important safeguards, but that does not mean every player is automatically entitled to a refund whenever a game shuts down. In its explanation, the Commission says providers must tell consumers before signup how long a contract lasts and how it can be ended. It also says digital-content rules provide remedies if content or services fail to conform to the contract or reasonable expectations, and that a proportionate refund may be available depending on the case.
