That Time Atari Tried to Crack the NES—and Built Tengen’s Rabbit

Atari’s Tengen subsidiary developed the Rabbit lockout effort, but the court record complicates the story that Atari independently cracked Nintendo’s 10NES.

Atari did try to defeat the Nintendo Entertainment System’s 10NES lockout system, but the familiar story that it independently cracked the code is misleading. Atari Games’ subsidiary Tengen developed a lockout-system effort called Rabbit, yet the Federal Circuit’s account says Atari’s early attempts to decipher 10NES failed. The later copyright case centered in part on Atari obtaining a copy of Nintendo’s registered program through a false representation—not on a court-validated, clean-room breakthrough.

How the NES 10NES lockout system worked

Nintendo designed 10NES to keep unauthorized cartridges from running on the NES. A master chip in the console and a slave chip in an authorized cartridge acted like a lock and key: when the console recognized the cartridge’s coded response, it allowed the game to operate; without that response, the system refused to run it.

The Federal Circuit described this mechanism in its 1992 opinion, Atari Games Corp. and Tengen, Inc. v. Nintendo of America Inc. and Nintendo Co., Ltd..

Atari’s first attempts to analyze 10NES did not succeed

According to the 1992 opinion, Atari began trying to analyze and replicate 10NES in 1986. Its early work included monitoring communication between the console and cartridge chips, then chemically peeling layers from NES chips so analysts could inspect the object code under a microscope. The court says these efforts did not let Atari decipher the code sufficiently to replicate the system.

That distinction matters: studying a chip and attempting to reproduce its behavior are not the same as successfully cracking it. The appellate record does not describe Atari’s initial reverse-engineering effort as a successful independent solution.

What Tengen’s Rabbit effort was—and what changed

Tengen was Atari Games’ wholly owned subsidiary. It pursued NES-compatible games outside Nintendo’s licensing arrangement and developed a lockout-system effort known as Rabbit. The court record supports describing Rabbit as a compatibility effort; it does not establish that a court approved a lawful independent clone or that Atari decoded 10NES unaided.

The licensing backdrop helps explain the dispute. As recounted by the Federal Circuit in 1992, Nintendo controlled cartridge manufacture and limited each licensee, including Atari, to five new NES games per year. Atari and Tengen later sought to release compatible cartridges outside that arrangement.

The legal controversy took a consequential turn when Atari obtained a copy of Nintendo’s registered 10NES program from the Copyright Office after falsely representing that it needed the material for litigation. That episode became central to the copyright dispute. The Federal Circuit upheld the finding that 10NES’s original selection and arrangement of instructions contained protectable expression.

Why the 1990 and 1992 court decisions are not the same ruling

The Federal Circuit’s 1990 decision, Atari Games Corp. v. Nintendo of America Inc., concerned preliminary-injunction issues in the broader dispute. The court vacated the challenged injunction and remanded. That procedural ruling was not a final merits victory for Atari on every issue.

In 1992, the Federal Circuit addressed the copyright dispute over 10NES and affirmed the relevant conclusion that the program contained protectable expression. These decisions dealt with different matters, so the 1990 ruling should not be treated as settling the later copyright question.

What the record establishes about the “crack” story

  • 10NES paired a console master chip with an authorized-cartridge slave chip to block unauthorized games.
  • Atari’s documented analysis efforts began in 1986, but the court says those initial attempts did not decipher the system sufficiently.
  • Tengen pursued a compatible lockout-system effort called Rabbit.
  • Atari’s later acquisition of a copy of Nintendo’s registered program became central to the copyright dispute, and the Federal Circuit upheld the finding that the program included protectable expression.

A contemporaneous Atari employee message dated March 28, 1991 reported that a district-court order barred Tengen from manufacturing or selling its NES-compatible cartridges. That message records Atari’s understanding at the time; it is not a substitute for the court rulings.
