Short answer: there is no blanket right to train an AI model on a game demo. A demo usually combines copyrighted software, artwork, music, dialogue, cinematics, text and audiovisual recordings, each of which may have different owners and license terms. In the United States, fair use is a fact-specific defense rather than an automatic AI-training exception. In the European Union, text-and-data-mining rules can permit some copying of lawfully accessible works, but an effective rights reservation can require authorization, and covered general-purpose AI providers have additional duties under Article 53 of the EU AI Act.
The legally safer route is to identify every asset, preserve the exact demo EULA and platform terms, check how the demo was obtained, investigate rights reservations and third-party licenses, and obtain written permission when the position is uncertain. A preservation or research exemption does not by itself grant permission to build a training dataset.

What copyright does a game demo contain?
A “demo” is not one legal work. It is a package of components that can have separate copyrights, contracts and owners. The rights analysis therefore starts with an inventory rather than with the label “demo.”
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteExecutable code and scripts
Game software is generally treated as a literary work in the United States. That can include engine code written for the demo, gameplay scripts, shaders, tools, user-interface code and embedded data files. Copyright protects the code’s expressive elements, but not ideas, procedures, processes, systems or methods of operation. An AI system trained to recognize a general game mechanic is not automatically copying protected code; extracting, reproducing or memorizing source or executable code is a different and higher-risk use.

Art, models, textures and text
Concept art, character and environment models, textures, animations, fonts, menus, in-game writing and promotional images can each be protected pictorial, graphic, sculptural or literary works. A model may also include contributions from contractors or middleware licensors, so the publisher may not control every right needed for machine-learning use.
Music, dialogue and cinematics
Soundtracks, voice performances, sound effects, pre-rendered movies and captured dialogue can involve separate musical, sound-recording, performance and audiovisual rights. A demo license that covers playing the game may not cover reproducing those elements in a dataset, training a model to imitate a voice, or generating new music in a similar style.
Gameplay concepts and factual data
Copyright generally does not protect abstract ideas, game rules, procedures or methods of operation. It can still protect the particular expression of those ideas: the code implementing a mechanic, the written tutorial, the artwork, the arrangement of levels or the audiovisual presentation. Facts and metadata may have limited or no copyright protection in some jurisdictions, but database rights, contract terms, privacy rules or trademark law can still matter.

Section 107 of the U.S. Copyright Act provides a fair-use defense based on four factors. It does not state that AI training is lawful, and it does not shift the burden of clearing rights before copying. A court would evaluate the particular demo, dataset, model, purpose and outputs.

Purpose and character
Nonprofit scholarship, security analysis or a narrowly targeted experiment may receive more favorable consideration than commercial model development, but nonprofit status is not decisive. A commercial system can sometimes make a transformative use, while a noncommercial project can still infringe. Explain what the model is intended to learn, whether the copies are necessary, how much access the project makes available and whether the use creates a competing product.
Nature of the work
Creative game assets, music, narrative writing and cinematic performances are at the core of copyright protection. Published demos may be somewhat more accessible to fair-use analysis than unreleased material, but publication alone does not authorize copying. Software contains functional aspects as well as expressive code, so the exact material used matters.
Amount and substantiality
Copying an entire demo may be technically necessary for analysis, yet copying the whole work can weigh against fair use, especially when the model retains or reproduces expressive elements. Taking only code fragments, selected frames or statistical features can present a different question, but “small” does not automatically mean lawful if the portion is the work’s expressive heart.

Market effect
Courts can examine lost licensing opportunities, competition with the demo or game, substitution for art or music, and whether outputs let users obtain materially similar assets without paying. Memorization, near-duplicate outputs and a model marketed to replace licensed game content increase risk. A project that cannot plausibly affect an existing or reasonably foreseeable market is not automatically safe; it is only one part of the analysis.

The U.S. Copyright Office has said that it is examining AI-training questions. Its initiative, launched in early 2023, received more than 10,000 comments by December 2023. Part 3, “Generative AI Training,” was released in pre-publication form on May 9, 2025, with a final version expected later. Those policy materials do not create a categorical training license or resolve every pending dispute.
What EU text-and-data-mining rules change
EU text-and-data-mining (TDM) rules can allow certain reproductions of lawfully accessible works for mining. The permission is conditional, not universal: the work must be lawfully accessible, the use must fit the applicable exception, and rightsholders may reserve their rights in an appropriate manner.
Lawful access is a separate question from ownership
Downloading a demo from an authorized store does not erase its EULA, platform restrictions or third-party licenses. A copy obtained through an unauthorized mirror, bypassed access control or prohibited automated scraper may fail the lawful-access condition and create additional claims.
Rights reservations can require authorization
Where a rightsholder has expressly reserved TDM rights in an appropriate, machine-readable way, authorization is required for covered mining. Check the publisher’s website, repository metadata, robots or other machine-readable notices where applicable, and keep a dated copy of what you found. A reservation may apply to the publisher’s own assets while separate owners reserve rights in music, voice, middleware or supplied artwork.

Article 53 and general-purpose AI providers
Article 53 of the EU AI Act requires providers of covered general-purpose AI models to maintain a copyright-compliance policy and publish a sufficiently detailed summary of training content. The consolidated text displayed by the European Commission AI Act Service Desk is dated July 27, 2026. The obligations concern providers, not every individual who experiments with a local model, and their application depends on the system’s classification and the Act’s scope.
The Act can matter when training occurs outside the EU if the resulting general-purpose AI system is placed on the Union market, deployed in the Union or its output is used there, subject to the Act’s scope. Recital 105 states that use of copyright-protected content requires rightsholder authorization unless a relevant exception applies, and that an expressly reserved opt-out requires authorization for TDM by general-purpose AI providers.
Why the demo EULA and platform terms matter
Copyright and contract are separate layers. Copyright may leave an arguable fair-use or TDM path, while an EULA can restrict copying, reverse engineering, automated access, data mining, commercial use, redistribution or extraction. Whether a particular clause is enforceable depends on the contract, assent, governing law and jurisdiction, but it is important evidence and can create risk even when an infringement claim is uncertain.
Clauses to locate
- Definitions of “software,” “content,” “user-generated content,” “derivative works” and “authorized use.”
- Prohibitions on copying, extracting files, decompiling, reverse engineering, scraping, bots, automated queries or machine learning.
- Limits on research, benchmarking, commercial use, publication, redistribution and training or fine-tuning models.
- Choice-of-law, forum, arbitration, termination and remedies provisions.
- Notices that incorporate platform terms, privacy policies or separate content licenses.
Third-party rights can narrow the permission
A publisher may license an engine, soundtrack, font, voice, stock image or performance only for gameplay distribution. The publisher’s permission cannot exceed the rights it owns. Ask who owns each copied component and whether any license excludes model training, dataset redistribution, voice imitation or commercial exploitation.

Does ripping a demo for research or preservation permit AI training?
Not automatically. The Digital Millennium Copyright Act’s Section 1201 exemptions for video games are narrow preservation and access provisions, including certain circumstances involving abandoned or server-dependent games. They do not grant a general right to extract a demo, assemble a training corpus or distribute model weights. Circumventing DRM can raise separate legal and contractual issues even when the eventual research purpose is legitimate.
Keep the acquisition record: store, account, date, region, edition, installer, hashes and the EULA version. Record whether any access control was bypassed and whether the project retains the original files. Preservation copies should be segregated from training data unless a separate legal basis covers the latter.
A practical risk test for a proposed training use
Evaluate the proposal across all of these dimensions; no single favorable answer overrides the others.
| Question | Lower-risk indicators | Higher-risk indicators |
|---|---|---|
| Jurisdiction | Clear rule and counsel-approved use in the relevant country | Multiple countries, uncertain governing law or Union deployment without an opt-out review |
| Material copied | Unprotectable gameplay concepts or derived statistics that do not retain expression | Whole executable, source code, textures, models, music, dialogue, cinematics or distinctive text |
| Access and permission | Lawful acquisition, permissive EULA and written owner authorization | Prohibited scraping, DRM circumvention, restrictive EULA or missing chain of title |
| Purpose and economics | Documented, narrow research with limited access | Commercial corpus-scale training, model release or a product aimed at replacing licensed assets |
| Outputs and market effect | Filters against memorization and no asset-generation objective | Near-duplicates, voice or music imitation, code regurgitation or substitution for the demo |
| Controls | Opt-out handling, provenance, deletion, testing and audit logs | No source tracking, no deletion process or inability to identify training examples |
When you should obtain a written license
Seek a written license before copying when the EULA is restrictive, the project is commercial, the entire demo or expressive assets will be used, outputs could substitute for the game or its assets, an EU opt-out applies, or ownership is split among publisher and third parties. A permission from only the publisher may be insufficient for music, voice, middleware or commissioned art.
Terms a useful license should specify
- The exact demo title, build, platform, territory and version covered.
- Whether rights include downloading, extraction, reproduction, preprocessing, training, fine-tuning, evaluation, publication and model-weight distribution.
- Permitted purposes, commercial status, users, deployment countries and duration.
- Rules for memorization, output filtering, attribution, security, deletion and handling of opt-out requests.
- Representations about third-party permissions and a process for adding or removing assets.
Step-by-step clearance and compliance workflow
- Define the use. Write down whether the project analyzes gameplay, trains a classifier, fine-tunes a generative model, publishes weights or serves outputs to users.
- Inventory the assets. Separate code, binaries, art, models, textures, text, music, voices, cinematics, metadata and user-generated content. Note what is actually copied and what is only measured or referenced.
- Trace ownership. Identify the publisher, developers, contractors, performers, composers, middleware licensors and platform operator. Flag assets whose licenses are unknown.
- Preserve permission evidence. Save the exact EULA and platform terms, version date, purchase or download receipt, region, access method and any rights-reservation notice.
- Check technical access. Determine whether automation, extraction or DRM circumvention is prohibited or occurred. Stop and obtain advice if the project depends on bypassing an access control.
- Analyze jurisdiction. Apply the law where copying occurs and where the model is trained, offered, deployed or its output is used. For EU work, document lawful access and search for machine-readable TDM reservations.
- Choose a minimization plan. Exclude unnecessary expressive assets, prevent memorization, restrict access, and consider feature extraction or human-created annotations where they answer the research question.
- Obtain permissions or stop. Get a signed license from every necessary rightsholder when the legal basis is uncertain. Do not treat an informal email, a store purchase or a preservation exemption as broader permission than it says.
- Maintain records. Keep provenance, hashes, dataset versions, deletion requests, opt-out decisions, model evaluations and output-abuse reports so the project can demonstrate what it used and why.
How the common scenarios differ
| Scenario | Key issue | Practical posture |
|---|---|---|
| Training a classifier on screenshots to identify interface elements | Images remain expressive works; scope, purpose, access and outputs matter | Minimize copies, document the analysis and review the EULA and fair-use factors |
| Fine-tuning a code model on extracted demo scripts | Software copyright, extraction restrictions and code regurgitation risk | Prefer licensed code or written permission; test for memorization |
| Generating music or voices resembling the demo | Separate musical, sound-recording and performance rights | Obtain permissions from relevant owners and performers; do not assume publisher ownership |
| Preserving an abandoned, server-dependent demo | Section 1201 preservation rules are limited | Keep preservation separate from AI training and verify an independent training basis |
| Commercial general-purpose model trained on EU-accessible demos | TDM reservations and Article 53 duties | Honor opt-outs, obtain authorization where required, maintain a copyright policy and publish the required training-content summary |
What remains uncertain
The exact answer cannot be determined from the word “demo.” It depends on the title and build, EULA version, asset ownership chain, acquisition method, jurisdictions, training objective, model architecture, distribution plans and likely effect on the demo or related licensing markets. Fair use is decided after examining facts, not by a universal AI-training formula. EU TDM rules likewise depend on lawful access, the type of mining and the way rights were reserved.
For a live project, have qualified intellectual-property counsel review the asset inventory, EULA, proposed dataset and deployment plan. Retain the written opinion and every permission with the project records; do not rely on a later recollection of what the license allowed.
