In most major digital storefronts, buying a game gives you a personal license to access and use the software, not ownership of its copyright or an unrestricted copy. Your access can be tied to an account, limited by DRM and online services, and subject to the store’s contract. A disc or cartridge gives you possession of physical media and usually makes lending, resale and preservation easier, but it still does not transfer copyright and may require patches, an account or functioning servers.
“Ownership” actually covers four different things
Arguments about whether players “own” games often combine separate legal and practical ideas. Checking each one gives a more accurate answer than treating a digital purchase as either full ownership or no rights at all.

Copyright ownership
The developer or publisher normally keeps copyright and the exclusive rights to reproduce, distribute, adapt and commercially exploit the game. Paying at a storefront does not transfer those rights to you. The transaction grants permission to use the software under specified conditions.

A disc or cartridge is a tangible object you can physically possess. You can generally hand that object to another person, lend it, or offer it for resale, subject to the platform’s terms and applicable law. Possessing the media still does not give you copyright, and the software on it may be governed by an end-user license agreement (EULA).

Contractual access
A digital storefront account records your license. The account, rather than a detachable object, is usually the practical key to downloading and launching the game. Steam’s EULA states: “Your license confers no title or ownership in the Content and Services.” That wording describes a license to use the content, not a transfer of title.
Service dependence
Authentication, digital-rights-management (DRM) checks, patches, account status and online servers can determine whether a game continues to run. A license can therefore provide ongoing access without promising that every version will remain available forever.
How a digital game license works
The account is part of the transaction
When you buy a download, the store normally adds a license to your account. You install the client or console software, sign in, and the platform checks that entitlement. Losing access to the account, violating its rules or encountering a platform outage can prevent access even though you paid for the game.

Game EULAs commonly prohibit transferring an account or selling a second-hand digital copy. The World Intellectual Property Organization reports that these agreements often describe digital transactions as non-transferable licenses and bar account transfers or resale. A family member cannot automatically inherit your library, and there is usually no lawful way to detach one digital license and attach it to another person’s account.

Future updates are not automatically guaranteed
Valve’s Subscriber Agreement says users are not entitled to future updates or enhancements unless the law requires them. A store may continue patching a game, stop patching it, or replace files with a newer build under the terms of the agreement. “Buying” access today is not the same as purchasing a promise of all future content.
Physical media: more possession, not unrestricted ownership
A compatible disc or cartridge gives you something you can keep outside a storefront account. That difference matters for lending, resale and preservation, but it has limits.
- The disc or cartridge can be handed to another person, while the recipient may still have to accept the game’s EULA.
- Online features, downloadable content and account-bound entitlements may not transfer with the media.
- Many releases require a day-one patch or later download; the original data on the disc may be incomplete or outdated.
- Games that require authentication or active servers can stop working even when the disc is in your drive.
- A physical copy remains tied to compatible hardware. A disc from one console family cannot necessarily run on another.
Physical media improves your control over the copy you hold, but it does not turn the software into your copyrighted property.
Digital license and physical copy compared
| Issue | Digital storefront license | Physical disc or cartridge |
|---|---|---|
| Transfer and resale | Usually personal, account-bound and non-transferable; EULAs commonly prohibit account transfer and second-hand sales. | The media can generally be lent or sold, but the recipient may need to accept an EULA and online entitlements may not follow. |
| Offline play | Depends on DRM, an account check and the platform’s offline mode. | The installed data may work offline, but patches, authentication or servers can still be required. |
| Revocation and delisting | A license contract may reserve suspension or revocation rights, and a delisted title may disappear from a store. | You retain the object, but online services or required downloads can still be withdrawn. |
| Portability | Usually limited to supported devices and the purchasing account; DRM can block use on another console brand. | Limited by the disc or cartridge format and compatible hardware; it does not automatically work across console families. |
| Refunds | Controlled by the storefront policy and mandatory local law; starting a download can end a statutory withdrawal period in some regions. | Usually treated as a goods transaction, with remedies determined by local consumer law and the seller’s policy. |
| Preservation and backup | Depends on continued account access, the ability to redownload and the storefront’s servers. | You retain the original media, although it may need patches, replacement hardware or a working service. |
| Continuing costs | Potential costs include subscriptions for online play, patches or downloadable content, and replacement hardware. | The same online, patch and hardware costs can apply; the initial media is not a guarantee of a complete offline version. |
Can a digital game be removed after you buy it?
Delisting is different from revocation
A store can stop selling a title while leaving existing licenses in customer libraries. In other cases, a contract may allow suspension or revocation of access. California’s AB 2426 legislative materials describe a digital license that “may be unilaterally revoked by the seller.” The statute’s disclosure rules address how sellers describe a digital good; they do not convert every purchase into unrestricted ownership.

California’s disclosure rule
California AB 2426 materials say a seller using “buy,” “purchase” or similar ownership language must provide a conspicuous license disclosure or obtain affirmative acknowledgment. Where applicable, the acknowledgment must state that the purchaser is receiving a license to access the digital good and that access may be unilaterally revoked by the seller. This is a disclosure requirement, not a guarantee that a license cannot later be limited.
What happens when a storefront closes?
If a storefront shuts down, your practical options depend on whether the title is already installed, whether activation still works, whether downloads remain available and whether the game’s servers continue operating. A physical copy may let you reinstall the base data, but it cannot restore a closed authentication service or missing online infrastructure.
Offline play, DRM and portability
Check the exact offline path
“Supports offline play” can mean several different things. Some games need one online activation and then run offline; others require a periodic sign-in; some modes work offline while multiplayer, cloud saves or progression do not. Before buying, look for the platform’s documented offline mode and test whether the game launches after signing out or disabling the network.

DRM can restrict devices
The U.S. Federal Trade Commission identifies DRM as a mechanism that can prevent a game from being used on another console brand. A license for one platform does not imply a right to a competing platform’s version, even when the title has the same name. Compatibility can also change after an operating-system, console or launcher update.

Servers are part of some games
A single-player campaign may be playable without servers, while matchmaking, leaderboards, cloud saves or licensed music require a connection. If the server is shut down, only the offline portion may remain. No physical format can preserve a service that exists exclusively on a publisher’s network.
Resale, inheritance and sharing
With a physical copy, resale normally means transferring the object. The buyer may need their own account, patches or downloadable licenses, and any code redeemed to the original account may be unusable. With a digital license, the account is generally non-transferable, so selling the account can violate the EULA and expose both parties to suspension.
Account sharing is not a substitute for ownership. A platform’s family-sharing feature, where offered, grants permissions under that platform’s rules; it does not create a transferable title. If you want another person to have independent control, a separately licensed copy is usually required.

EU and United Kingdom digital-content withdrawals
Steam’s EU and UK guidance says the statutory withdrawal period for digital content ends when downloading begins or after 14 days, whichever is sooner, once the consumer has consented to early supply. That rule concerns the withdrawal right for digital content; other mandatory remedies may apply when the product is defective or does not conform to the contract.

Other jurisdictions
Consumer protections are not uniform worldwide. EU law includes mandatory protections for digital content and distinguishes digital-content contracts from sales of goods. Other countries and states may provide different cancellation, conformity or warranty rights. Read the policy for the country attached to your account, not a policy written for another region.
Practical refund step
Before downloading, record the storefront’s current refund deadline and the conditions for playtime, activation or early access. Keep the order receipt and note whether you consented to immediate delivery. If the game is faulty, contact the seller even when a voluntary refund window has expired, because mandatory local rights can be broader.
What the 2025 consumer data says
The Australian Competition and Consumer Commission reported in 2025 that 56% of surveyed game players were unaware that some digital-store purchases provide a license rather than ownership. The finding does not determine any individual contract, but it explains why the wording on a checkout page and the EULA deserve attention.
Use this checklist before paying
- Read the current EULA. Look for ownership language, suspension or revocation clauses, transfer restrictions and the law governing the contract.
- Confirm the account relationship. Determine whether the game is permanently attached to your account and whether family sharing or inheritance is permitted.
- Identify DRM and activation. Check for an always-online requirement, a first-launch activation, periodic sign-ins or limits on the number of devices.
- Verify offline behavior. Find out which modes work without a network and whether you can reinstall after a storefront or server closure.
- Check the platform and edition. A license for one console, PC launcher or operating system does not automatically cover another. Separate the base game from DLC, expansions and virtual currency.
- Investigate server dependence. Read the publisher’s support information for multiplayer, cloud saves, authentication and shutdown plans.
- Record refund terms before download. Note the deadline, playtime limit and the point at which early delivery waives a withdrawal right in your region.
- Compare a physical release if possession matters. Confirm that the disc or cartridge is compatible, contains meaningful playable data and does not rely on a one-time code already redeemed by someone else.
- Plan preservation. Keep installation media, patches where lawful, receipts and account-recovery information. A backup cannot bypass DRM, but it can protect against a damaged disc or a lost local file.
How to choose between digital and physical
Digital is a better fit when convenience dominates
A digital license is convenient when you value instant delivery, multiple-device downloads within one platform ecosystem, automatic patching and not having to store media. Accept that convenience is conditional on the account, the platform and the services named in the contract.
Physical is a better fit when control and resale matter
A disc or cartridge is preferable when you want a tangible backup, the ability to lend or resell the media, or a better chance of reinstalling the base game after a store delists it. Confirm the game’s patch and server requirements first; physical media cannot guarantee a permanently playable online service.
The precise answer to “Do I own my digital games?”
You own the account credential and whatever consumer rights your jurisdiction grants, but in most storefronts you license the game software. The publisher keeps copyright, the store’s contract defines access, and DRM, updates, servers and account status can affect continued use. Physical media gives you possession of an object and often more practical control, yet it still does not transfer copyright or guarantee indefinite access to every feature.
