Licensing usually means receiving contractual permission to access software through an account, store or device. In neither case do you normally own the game’s copyright. A physical copy can often be kept or resold under local first-sale or exhaustion rules, while a digital purchase commonly remains a non-transferable license that can depend on account status, platform support, digital-rights management (DRM) and online servers.
Ownership, licensing and copyright are three different things
People use “buy” and “own” as if they describe the same transaction, but a game transaction can involve three separate rights:
As an Amazon Associate I earn from qualifying purchases.
- Ownership of a copy: You possess a particular cartridge, disc or other authorized copy and may have rights to keep, lend or resell that copy, subject to local law.
- A license to use software: The publisher or platform gives you permission to run the game under an end-user license agreement (EULA) and store terms. The permission may be limited, revocable or tied to an account.
- Copyright ownership: The copyright holder controls reproduction, distribution, adaptations and other exclusive rights. Buying a copy does not transfer those rights.
The practical question is therefore not simply “Did I pay?” It is “What exactly did I receive, what conditions apply, and what remains usable if the account, storefront or servers disappear?”

What a physical game copy usually gives you
Possession of a particular copy
A genuine cartridge or disc is a tangible item you can hold, store and ordinarily transfer. If you sell the disc, the buyer receives that physical copy rather than access through your personal account. In countries that recognize a first-sale or exhaustion doctrine, the copyright owner generally cannot control every later sale of that particular copy after the first authorized sale. The precise rule, however, depends on the country, the type of copy and any applicable exceptions.

Physical does not mean permanently playable
A cartridge or disc may work without a storefront account, but several dependencies can remain:
- The console may require an online check, account sign-in or a product code.
- A disc may contain only an installer while the playable data is downloaded later.
- Online multiplayer, cloud saves, leaderboards and downloadable content can stop working when servers close.
- A mandatory patch may no longer be available, leaving an unpatched version with bugs or missing features.
- Hardware failure, disc damage, region restrictions or accessory requirements can prevent use.
Physical ownership therefore improves control over the copy; it does not guarantee that every feature will remain available forever.
What a digital “purchase” normally means
The license is usually tied to an account
Digital stores commonly deliver permission to download and run a game rather than a transferable object. The permission is recorded against an account and enforced through authentication, DRM and device rules. You may be able to install the title on several authorized devices, but that does not turn the license into property that can be handed to another person.

Terms can change the practical bargain
The Federal Trade Commission said on April 18, 2024: “When you buy a physical item, you’ve got it. It’s yours. But when you click the ‘buy’ button on a digital product, it really depends.” The FTC explains that access may last only while an account or platform remains available, and that DRM can prevent use on another console brand. In many cases, the store’s changeable terms say the buyer received only a license to access the content.
The Australian Competition and Consumer Commission similarly warns that some games sell a license to play rather than a permanent copy. If an account is canceled or suspended, or support is discontinued, access may not be recoverable, including access to in-game purchases.

What a EULA can control
A EULA is a contract or set of contract terms governing use of the software. The exact wording differs by game and jurisdiction, but common provisions address:
- Which devices or operating systems are authorized.
- Whether one account or multiple household users may access the game.
- Copying, modification, reverse engineering and creation of derivative works.
- Commercial use, public performance, renting and redistribution.
- Account suspension, termination and what happens after termination.
- Remote patches, content substitutions, feature changes and data collection.
For example, Epic’s EULA prohibits copying, selling, renting, leasing, licensing, distributing or transferring the software. It also states that Epic may remotely patch software and modify, suspend, discontinue, substitute, replace or limit access, with game data potentially becoming unavailable without notice. That is an illustration of how a license can reserve broad operational control; another publisher’s terms may be narrower or broader.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errorsCan a platform revoke a game you paid for?
Payment alone does not answer this. Revocation risk depends on the contract, the platform’s technical design and local consumer law.
Account suspension or termination
If access is account-based, a suspension can block downloads and authentication even when the game was paid for. A termination may also affect add-ons, cloud saves and purchases attached to that account. The stated reason could involve fraud, chargebacks, cheating, unacceptable conduct or a breach of the EULA. Whether a platform must provide notice, an appeal process or a refund depends on its terms and the law where you live.
Delisting and storefront closure
A publisher can stop selling a title while existing license holders retain download rights, but that outcome is not universal. A store closure may remove the ability to redownload, authenticate or install a title. Local backups can help only when the platform permits offline launch and the files do not require a continuing server check.

Remote changes
Networked games can receive patches that alter balance, remove modes or replace content. A license normally does not promise that the software will remain unchanged. A physical disc can preserve its original build, but only if the console allows that build to run without a mandatory update.
Can you resell a digital game?
Digital resale is commonly restricted because the transaction is framed as a personal, non-transferable license rather than a copy sale. Account credentials are generally not transferable under store rules, and transferring an account can expose both parties to suspension or loss of other purchases. A download file also can be duplicated perfectly, making it difficult to identify which copy is the “used” one.
Some jurisdictions apply exhaustion or consumer rules differently to software, and courts have reached different conclusions about digital distribution. A right to resell a physical disc does not automatically create a right to resell a digital entitlement. Before attempting a transfer, check the store’s current terms, the game’s EULA and the law in your country. Do not assume that gifting functionality is the same as resale: a gift may create a new license under the platform’s rules rather than transfer your existing one.
Owning the copy is not owning the game’s copyright
The U.S. Copyright Office describes copyright as control over reproduction, derivative works and distribution, subject to statutory limits such as first sale. When you buy a cartridge or disc, you acquire that copy, not permission to manufacture additional copies, upload the game, distribute unauthorized downloads or create and sell an unlicensed sequel using protected characters and code.
Activities such as making a backup, extracting data or emulating a game can involve separate legal questions. Exceptions vary by country and may depend on purpose, technological-protection measures and whether the original copy is retained. A physical owner should not treat possession as a blanket exemption from copyright law.

What happens when servers shut down?
Offline-capable games
If the complete single-player program is on the cartridge or disc and no recurring authentication is required, the core game may remain playable after a server shutdown. A day-one patch, downloadable language pack or online account requirement can change that result.
Always-online games
Some titles perform game logic on remote servers or require a server handshake at launch. When those servers close, the purchased license may remain recorded in your account but provide no usable game. No local backup can recreate a service that runs remotely.
Hybrid games and in-game purchases
A game may have an offline campaign but depend on servers for multiplayer, events, inventory or purchased items. The campaign might survive while those features disappear. The ACCC specifically cautions that access to in-app purchases may not be recoverable after cancellation, suspension or discontinued support.
How to check what you are actually buying
- Identify the format. Confirm whether the product is a cartridge, a disc, a download code or an account entitlement. A boxed product can still contain only a code.
- Read the game EULA. Look for language about a license, transfer, termination, mandatory updates, authentication and server dependence.
- Read the store terms. Check whether the license is personal, whether accounts can be transferred and what happens after a storefront closes.
- Check launch requirements. Look for internet activation, a persistent online connection, a platform account, region limits and required hardware.
- Separate core content from services. Note which modes, saves, DLC and purchases need servers or a subscription.
- Check delisting and redownload policies. Determine whether an already purchased title can be redownloaded after it leaves sale and whether offline installers are allowed.
- Save evidence. Keep the receipt, product description and the version of the terms shown at purchase. These records can matter in a dispute about misleading representations.
Physical copy versus digital license
| Question | Physical copy | Digital license |
|---|---|---|
| What you receive | A particular cartridge or disc. | Permission to access software through an account or authorized device. |
| Transfer or resale | May be possible under applicable first-sale or exhaustion rules. | Commonly prohibited by account and license terms; legal treatment varies. |
| Account dependence | Often lower for the basic program, but not guaranteed. | Usually tied to the platform account and its authentication systems. |
| Server shutdown impact | Offline features may survive; online and server-dependent features may not. | Download, launch or purchased content may become inaccessible. |
| Updates and patches | You may retain the original build; updates can still be required for some features. | Remote updates can change or remove content under the EULA. |
| Copyright | You own the copy, not the game’s copyright. | You own neither the copyright nor usually a transferable copy. |
What consumer-protection law can change
Contract terms are not the whole story. Consumer-protection statutes may restrict misleading “buy” language, unfair terms, defective digital content or failures to provide promised functionality. The FTC’s explanation and the ACCC’s warning both emphasize that a seller’s presentation matters, not just the fine print. Remedies can include repair, replacement, refund or other relief, but eligibility depends on the country, the seller, the timing and the nature of the failure.
Do not assume that a broad EULA overrides every mandatory consumer right. Conversely, do not assume that a consumer guarantee creates permanent access to a service that was clearly sold for a limited term. For a specific dispute, preserve purchase records and obtain advice under the law that applies to your transaction.

Practical decisions for buyers
Choose physical when long-term independence matters
A physical copy is generally the stronger choice if you want to lend or resell the game, preserve an original version or reduce dependence on a storefront account. Verify that the disc contains playable data, that the console accepts the region and that offline play works before relying on it for preservation.
Choose digital when convenience matters more than transferability
Digital delivery can provide instant access, automatic updates and easy installation across authorized devices. Accept that those benefits come with account, DRM and platform risks. Keep the account secure, maintain recovery options and do not treat the purchase as an asset that can normally be sold to another person.
Treat online-only games as services
If the game requires a remote server to launch or run, evaluate it like a service subscription even when you pay once. The meaningful product is continued server operation, not merely the data installed on your device.

To own a video game usually means owning a physical copy; to license one means receiving conditional permission to access software. Neither status gives you the copyright. Physical ownership can support lending, resale and offline preservation, while digital licensing commonly ties access to an account, DRM, changing terms and server availability. The exact outcome for any title turns on its format, EULA, platform requirements and the consumer law in your jurisdiction.
